Cabinet welcomes the achievements highlighted by President Jacob Zuma during his site visit to the Port of Port Elizabeth in the Eastern Cape, to assess progress made on the implementation of the Operation Phakisa: Oceans Economy initiative. Government has unlocked investments amounting to about R17 billion in the Oceans Economy. Since its inception, over 4 500 jobs have been created in various sectors.

1. Implementationof keygovernmentprogrammes
1.1. Cabinetwelcomesthe achievementshighlightedbyPresidentJacobZuma duringhissite
visittothe Portof PortElizabethinthe EasternCape,to assessprogressmade onthe
implementationof the OperationPhakisa:OceansEconomyinitiative.Governmenthasunlocked
investmentsamountingtoaboutR17 billioninthe OceansEconomy.Since itsinception,over4500
jobshave beencreatedinvarioussectors.
Two of the nine tugboatsbeingbuiltbythe SouthernAfricanShipyardsforTransnetNational Ports
Authority(TNPA) inthe Portof Durbanare destinedforthe Portof Port Elizabeth.PresidentZuma
launchedthe firsttugboatinPort Elizabeth,namedthe Mvezo,afterthe birthplace of former
PresidentNelsonMandela.
The TNPA has allocatedoverR7 billiontoimprove ourports.The Presidentviewedthe refurbished
and reconstructedslipwayandlead-injettieswithinthe Portof PortElizabeththatwill be able to
accommodate 12 more vesselsascomparedtothe current two.
1.2. Cabinetthanksall taxpayerswhohave partneredwithgovernmentinthe 2015/16 financial
yearto take ourrevenue collectiontoR1 trillionforthe firsttime.Thisisaclear demonstrationof
the strengthof our thrivingeconomyevenunderdifficultcircumstances.
It isthroughthe tax contributionsof compliantSouthAfricansandthe effective collectionbythe
SouthAfricanRevenue Service thatgovernmentisbetterable toprovide much-neededservicesthat
contribute toimprovingthe livesof SouthAfricans.
1.3. CabinetwelcomesPresidentZuma’sannouncementof 3 August2016 as the date for the
2016 Local GovernmentElections.Governmentispleasedthatthe tworegistrationweekendson5 –
6 March and9 – 10 April sawlarge numbersof potential votersvisitingthe votingstations,especially
first-time votersandthe youth.

Smart ID cards online andavoidlongqueues.
Thiscollaborationwithfourmajorbanks – ABSA,FNB,NedbankandStandardBank
– to introduce anonline applicationplatformforSmartID cards and passportswill enable customers
to visitDHA kioskstosubmittheirfingerprintsand picturesafterhavingmade appointmentsand
paymentsonline.
eChannel ispartof the department’soverall modernizationstrategytomove servicesfrompaperto
digital,aprocesswhichwill includethe cleaningof the populationregister.
1.5. Cabinetwelcomesthe successof the recentlyheldImbizoFocusWeekunderthe theme
‘Togetherwe move SouthAfricaforward’,whichsaw governmentofficialsinteractingwith
communitiesthroughoutthe country.
Cabinetcommendsthose SouthAfricanswhoparticipatedinover36programmesacross the
country,whichensuredthatgovernmentrespondedtoidentifiedcommunityneeds.The Imbizo
FocusWeekhas empoweredcommunitieswithinformationongovernmentprogrammes.
1.6. The Departmentof Human Settlementshostedaverysuccessful UnitedNations(UN)
conference dealingwithinformal settlements,emphasisingthe phenomenal rate of urbanisation
and the growthof slums.Nowone billionpeople inthe worldlive inslums.SouthAfricahassince
1994 builtmillionsof housesaspartof ensuringabetterlife forall.
2. Bills
Cabinetapprovedthe followingdraftBills:
2.1. Critical Infrastructure ProtectionBill of 2016 to be publishedinthe GovernmentGazette for
publiccomment.
The Bill repealsthe National KeyPointsAct,1980 (Act102 of 1980), andseekstoalignthe processof
identifyinganddeclaringcritical infrastructuresinatransparentandaccountable manner.Itwill also

3. furtherensure thatall critical infrastructuresforthe national securityof the countryare identified
and adequatelyprotected.
The Bill providesforthe settingupof an institutional frameworktomonitorandadministerthe
protectionof the critical infrastructures.Itfurtherdefinesthe functionsof the bodythatwill advise
the Ministerof Police inthe declarationof critical infrastructures.
2.2. The Communal PropertyAssociationsAmendmentBillof 2016 to be publishedforpublic
comment.The Bill amendsthe currentCommunal PropertyAssociationsAct,1996 (Act28 of 1996).
The Bill will strengthenthe democraticgovernance processof the existingCommunal Property
AssociationsorexistingTrustentitiesthatoverseecommunal land.The amendedBillprovidesfor
the settingupof the Registrarinthe Departmentof Rural DevelopmentandLandReform, and
definesthe functionsof thisoffice.Once thisBill ispassedintolaw,itwillstrengthenthe regulation
of governance institutionsandenhance State supporttothem.
It will enable communitiestoacquire,holdandmanage propertiesthrougheffectivestatutorily
establishedadministrationentitiessupportedbygovernment.
2.3. The introductionof the International ArbitrationBill of 2016 to Parliament.The international
arbitrationprocessisan essentialtool fordoingbusinessacrossthe bordersof the country.It will
improve accesstojustice servicesforcompaniesdoingbusinessoutside the countryandforeign
companiesinSouthAfrica.The Bill repealsthe RecognitionandEnforcementof ForeignArbitral
AwardsAct,1977 (Act40 of 1977) and alsoamendsthe currentProtectionof BusinessAct,1978 (Act
99 of 1978). The proposedBill alignswiththe Model Law onInternational Commercial Arbitration,
whichhas beenadoptedbythe UN CommissiononInternational Trade Law.
2.4. The publicationof the draftNational ResearchFoundationAmendmentBillof 2016 inthe
GovernmentGazette forpubliccomment.The Bill amendsthe National ResearchFoundationAct,
1998 (Act23 of 1998).
The Bill will improve SouthAfrica’scompetitivenessinresearchdevelopmentandinnovation
througheffective,adequate andcoordinatedmanagementof publicengagementwithscience,and
improvedresearchinfrastructure provisionandaccess.Itwill alsoimprove the responsivenessand
effectivenessof researchdevelopmentandinnovationprovision,toimprove the qualityof lifeof
SouthAfricansthroughbetteralignmentwithgovernmentpriorities.
3. KeyCabinetdecisions
3.1. Cabinetadoptedthe White PaperonPolicing.The draftWhite Paperwasfirstpublishedfor
publiccommentinMarch 2015. The paperprovidesforapolice service thatisbiasedtowardsactive
citizenryandrespondstothe existingpolicingenvironment.ItalsoprovidesforaSouth African
Police Service andmetropolice thatisaccountable andprofessional.The White Paperalsocallsfor

4. the establishmentof aNational Police Boardwhich,amongstothertasks,willbe responsible for
settingupthe objective criteria forthe recruitment,selectionandappointmentof new recruitsin
the police services.
3.2. Cabinetadoptedthe White PaperonSafetyandSecurity.The White Paper,whichhas
alreadybeenoutforpublicconsultationinFebruary2015, focusesonan integratedand
developmental approachtosafetybeyondpolicing.Itseekstoguide onpreventative safety
measuresforcommunities.The White Paperidentifiesall the relevantdepartmentsandcommunity-
basedorganisationsthatcontribute tothe safetyof communities.
3.3. Cabinetapprovedthe draftPolicyonthe CustomaryPractice of InitiationinSouthAfricaand
approvedforthe Departmentof Traditional Affairstocommence draftingnational legislationon
initiation.The policyhasalreadygone throughanextensive publicconsultationprocesswith
relevantstakeholders.
The policyprovidesguidelinesthatensure the protectionof the traditional customof the annual
initiationof youngboyswithoutcompromisingtheirsafety.Thisformspartof the stepsthat
governmentistakingtoreinforce appropriateandacceptable customs.Itrestoresanacceptable
level of accountabilitytothose thatruninitiationschoolsandparentsthatsendtheirchildrento
these schools.
3.4. Cabinetapproved the recommendationsmade bythe Committee of Inquiryonthe
feasibilityof tradinginrhinohornsasone of the optionstopreserve the country’srhinopopulation.
The recommendationswereendorsedbythe Interdepartmental Technical AdvisoryCommittee and
the Inter-Ministerial Committee appointedtoinvestigate the possibilityof legalisingcommercial
international trade inrhinohorn.
The recommendationsendorse SouthAfrica’sintegratedstrategicmanagementapproachto
resolvingthe poachingof rhinoand illegaltrade inrhino.The committee recommendsthatthe
currentmode of keepingthe country’sstocklevelsbe keptasopposedtothe tradinginrhinohorns.
The country’sstrategicapproach entailssecurity;communityempowerment;biological
management;responsivelegislative provisionsthatare effectivelyimplementedandenforced;and
demandmanagement.
3.5. Cabinetapprovedthe following2016 commemorative coindesigns:
a) The National GeographicCoinSeries –BigCats Initiative:‘The Cheetah’.
b) The Sterling-silvercrownandtickeycoinseries‘SouthAfricaninventions –
‘Dolosse’.

5. The coin designs,togetherwiththeirproclamations,willbe printedinthe GovernmentGazette,and
will thenbe manufacturedandsoldthroughthe normal channels.
4. Upcomingevents
4.1. PresidentZumawillbetweenthe 18 and 22 April 2016 undertake workingvisitstomember
statesof the SouthernAfricaCustomUnion(SACU) whichincludeNamibia,Botswana,Lesothoand
Swaziland.The visitswill enhance the importantrole
that SACU playsinpromotingregional integrationandeconomicdevelopmentof all itsmembers.
4.2. The Presidentwillundertake aState Visittothe IslamicRepublicof Iranon 23 and 24 April
2016 to strengthenpolitical andeconomicengagementsbetweenthe twocountries.
4.3. The Presidentwillleadthe National FreedomDaycelebrationson27 April 2016 in Limpopo,
Giyani Stadiumunderthe theme:“Togetherbuildingbettercommunities –Local Governmentis
everyone’sbusiness”.
Cabinetcallsonall SouthAfricansandsectorsto demonstrate theirpatriotismbyparticipatinginthe
variouseventscommemoratingFreedomMonth.
4.4. Duringthe upcomingweeks,Parliamentwillbe holdingdepartmental BudgetVotes.The
respective departmental Executiveswill unpacktheiroperationalplansforthe 2016/17 financial
year.Membersof the publicwill be informedaboutservice-deliveryprogrammesof government.
5. Cabinet’spositiononkeyissuesinthe environment
5.1. Cabinetwelcomedthe response andsubsequentapologybyPresidentZumatothe
ConstitutionalCourtjudgmentrelatingtocompliancewithremedialactionssetoutina reportof the
PublicProtector.
Cabinetisstudyingthe judgmenttoestablishif there are anyotheractionstobe undertakento
strengthenthe role of the PublicService.
The Constitutional CourtjudgmentreinforcesandassertsSouthAfrica’sconstitutional democracy.
5.2. Cabinetnotedthe actionsbythe fourbanksthat gave notice to close the bankaccount of a
company.WhilstCabinetappreciatethe termsandconditionsof the banks,the actsmay deter
future potential investorswhomaywantto do businessinSouthAfrica.Cabinethasendorsedthat
the Ministersof Finance,LabourandMineral Resourcesshouldopenaconstructive engagement
withthe banksto finda lastingsolutiontothismatter.

6. 5.3. Cabinetcongratulatedthe Ministerof Health,DrAaronMotsoaledi,whoreceivedthe
USAID-TBinternational awardinrecognitionof hisleadershipinthe global fightagainsttuberculosis
(TB) as well aschampioningSouthAfrica'sandregional initiatives
inthe screening,treatmentandpreventionof TB;TB/HIV co-infectionandmulti-drugresistantTB.
5.4. Cabinetwelcomesthe nominationof SouthAfricaasthe 2016 recipientof the Distinguished
DiplomaticService Awardbythe WorldAffairsCouncilinWashington,DC.Asthe firstAfrican
countryto receive thisaward,itrecognisesthe country’soutstandingcommitmenttoglobal
education,internationalaffairsandglobal communicationstoadvance ournational interests.
Cabinetcommendsthe Ministerof InternationalRelationsandCooperation,MsMaite Nkoana-
Mashabane,forher contributiontoSouthAfrica’sinternationalengagements,whichare drivenby
the visionof a “unitedAfricancontinentthatispeaceful,democratic,non-racial,non-sexistand
prosperous,andwhichcontributestoajustand equitable world.”
5.5. Cabinetwelcomesthe appointmentbyPresidentZumaof Advocate JanLekhoaMothibi,as
the Head of the Special InvestigatingUnit,andwisheshimall the bestinhisnew responsibilitiesof
combatingcorruptionandmaladministration.
5.6. Cabinetconveysitsheartfeltcondolencestothe Makwetufamilyandthe PanAfricanist
Congress onthe passingof Mr Clarence Makwetu.Mr Makwetuwill be rememberedforhis
immense contributionandpersonalsacrificestothe liberationmovementandthe establishmentof
the newdemocraticSouthAfrica.The PresidentdeclaredaSpecial Provincial OfficialFuneral forthe
liberationstrugglestalwart.
5.7. Cabinetconveysitsheartfeltcondolencestothe Naidoofamilyonthe passingof Mr
KumaranNaidoo.Mr Naidoo wasthe ActingDirector-General of the Departmentof Economic
Development.He previouslyservedasthe Chief FinancialOfficerof the Departmentof Trade and
Industry.Mr Naidoohascontributedimmenselyinfinancialmanagementwithinthe PublicService.
5.8. Cabinetexpresseditsappreciationonthe contributionmade byMr WilliamSmith,who
servedasCabinetSecretariat.MrSmithretiredat the endof March afterservingthe PublicService
for 27 years.Cabinetwisheshimwellonhisretirement.

7. 6. The Cabinetwasbriefedaboutthe Reportof the Commissionof InquiryIntoAllegationsof
Fraud,Corruption,ImproprietyorIrregularityinthe StrategicDefenceProcurementPackage (Arms
ProcurementCommission) whichwasreleasedbythe Presidentthismorning.
The Report hasfoundno evidence of wrongdoing,bribery,fraudorcorruptioninthe arms
procurementprocess,AsGovernmentwe welcomethe findingsof the Commission.We have been
vindicatedaswe have statedovermanyyearstht there wasno wrongdoingandthatthe
procurementhadbeenabove board.
We trustthat the findingswill bringclosuretothislongdrawnoutmatter.
We joinPresidentZumainthankingJustice WillieSeritiandJudge ThekisoMusi,all the witnesses,
