2. QARD-E-HASANA
•The word “qard” is derived from Arabic “qirad” which means to
cut. It is called qard as it cuts certain part of the lender’s property by
giving loan to the borrower.
•Hasan is also an Arabic word which originates from “ihsan”, which
means kindness.
Therefore, the term “al-qard ul-hasan” means beneficial loan
which is provided without charging any return or profit or interest. If
a return in any from is associated with the loan, it will not be a qard-
e-Hasana.
“Who is he that will loan to Allah, a beautiful loan,(QARZE-E-
HASNA) which Allah will double and multiply many times? It is
Allah that gives (you) want or plenty and to Him shall be your return
” -Sura Baqara 2:245
3. CONCEPT OF MUSHARAKAH
•'Musharakah' is a word of arabic origin which literally means
sharing.
•In the context of business and trade it means a joint enterprise in
which all the partners share the profit and loss of the joint venture.
•"sharikah" means "sharing" and in the terminology of islamic Fiqh,
it has been divided into two kinds:
1) shirkat-ul-milk:
It means joint ownership of two or more persons in a
particular property.
2)shirkat-ul-'aqd:
means "joint commercial enterprise".

•shirkat-ul-wujooh
4. Rules of Musharakah:
1)The ratio of profit sharing between all parties should be determined and
mutually agreed at the conclusion of EVIDENCES the contract in the form of
percentage of profit, not a sum of money or percentage of capital.
2) Loss sharing, except in the case of deceit or TYPES negligence, is according
to percentage of shareholding.
Management of Musharakah:
•Each partner has a right to take part in its management and to work for it.
•The partner may agree upon a condition that the management shall be carried
out by one of them, and no other partner shall work for the musharakah.
concept of mudarabah:
"Mudarabah" is a special kind of partnership where one partner gives
money to another for investing it in a commercial enterprise. The investment
comes from the first partner who is called "rabb-ul-mal", while the management
and work is an exclusive responsibility of the other, who is called "mudarib".
Distribution of the profit:
It is necessary for the validity of mudarabah that the parties agree, right at
the beginning, on a definite proportion of the actual profit to which each one of
them is entitled.
5. COMBINATION OF MUSHARAKAH AND MUDARABAH
A contract of mudarabah normally presumes that the mudarib has not invested
anything to the mudarabah. He is responsible for the managment only, while all
the investment comes from rabb-ul-mal. But there may be situations where
mudarib also wants to invest some of his money into the business of
mudarabah.
Project financing:
In the case of project financing, the traditional method of musharakah or
mudarabah can be easily adopted. If the financier wants to finance the whole
project, the form of mudarabah can come into operation. if investment comes
from both sides, the form of musharakah can be adopted.
sharing in Gross profit only:
financing on the basis of musharakah may be difficult in a business. The
major difficulties in these cases arise in the calculation of indirect expenses,
like depreciation of the machinery, salaries of the staff etc. In order to solve this
problem, the parties may agree on the principle that, instead of net profit, the
gross profit will be distributed between the parties, that is, the indirect expenses
shall not be deducted form the distributable
6. ISLAMIC MODE OF FINANCING-II
"Murbahah" is, in fact, a term of Islamic Fiqh and it refer to a particular
kind of sale having nothing to do with financing in its original sense. If a
seller agrees with his purchaser to provide him a specific commodity on
a certain profit added to his cost, it is called a "murabahah" transaction.
some basic rules of sale:
• subject of sale must be existing at the time of sale.
•The subject of sale must be in the ownership.
•The subject of sale must be in the physical or constructive possession of
the seller when he sells it to another person.
•The sale must be instant and absolute.
•The sale must be unconditional.
Bai'Mu'ajjal (sale on deferred payment basis):
A sale in which the parties agree that the payment of price
shall be deferred is called a"Bai'Mu'ajjal".

7. FEATURES OF MURABAHAH FINANCING
•It is not a loan given on interest.
•Murabahah is complete valid characteristics.
•Murabahah cannot be used as a mode of financing except where the client needs funds.
•The financier must have owned the commodity before he sells it to his client.
•The commodity must come into the possession of the financier.
Issues involved in Murabahah financing:
• Deferred payment.
•securities against murabahah price
•guaranteeing the murabahah
•penalty of default
•calculation of cost in murabahah
Basic mistakes in Murabahah financing:
•False assumption
•In some cases, they never intend to employ these funds to purchase a specific
commodity.
•sale of commodity to the clients is effected before the commodity is acquired form the
supplier.
•International commodity transactions are often resorted to for liquidity management.
