(Article 48)
โข GREVIO notes with concern that mediation is carried out by lay mediators
with only a small amount of training and that they may not be able to
recognise the power dynamics at play in intimate partner violence.
โข GREVIO urges the Finnish authorities to introduce clear protocols
and guidelines on mediation in domestic violence cases with a view
to ensuring that:
โข all law-enforcement and prosecution staff are aware that mediation is
prohibited in cases of repeated violence;
โข all offers of mediation are accepted entirely voluntarily;
โข an offer of mediation does not result in the discontinuation of criminal
investigation and prosecution in violence against women cases.
โข In addition, GREVIO urges the Finnish authorities to reconsider the
power vested in the police to propose mediation as a criminal
justice measure in domestic violence cases, because having this
power might jeopardise the effectiveness of criminal investigations.

The aims:

โข The law does not determine the actual mediation
methods
โข The law is flexible and leaves room for the application of
RJ
โข However, some lower level legal sources downplay how to
apply RJ and the law is interpreted in a conservative way

20. WHAT KINDS OF CASES CAN BE MEDIATED IN
FINLAND?
โข Basically, all kinds of crimes
โข Crimes that are assessed as eligible for mediation, taking into account the
nature of the offence, the relationship between the parties and other issues
related to the crime as a whole
โข Parties have to be able to understand the meaning of mediation
โข Not allowed, if victim is a minor with a special need for protection because of
his/her age or the quality of the crime
โข Mediation has to be in harmony with victimโs interests
โข The suspect must mostly confess what has happened
โข In principle, mediation is available in all phases of the criminal proceedings
โข Equally complainant offenses & offenses under public prosecution
โข Both childrenโs and adultsโ cases: no age limits
โข As the last resort, mediation office defines whether the matter is suitable for
mediation

is suitable for mediation, they must inform the parties of the
possibility to mediate and refer them to mediation.

25. Mediation can have legal effects
โข Mediation can have various effects on the criminal procedure:
โข the police may stop the investigation
โข the prosecutor may drop charges
โข the judge may impose a lighter penalty or no penalty at all
โข The legal authorities consider each case separately and decide
how much they put weight on VOM
โข Complainant offences: if victim withdraws his/her request for a penalty,
the investigation is discontinued
โข Offences under public prosecution: the prosecutor can press or waive
charges regardless of a mediation agreement and the victimโs
preferences
