Answer Question No. 1 which is compulsory and any FOUR questions of the
remaining. All questions carry equal marks.
1. Write a comprehensive note on each of ANY FOUR of the following:
a) Blood Banks and working of blood banks in India.
b) Post-mortem examination.
c) Pecuniary and Territorial jurisdiction and powers of -
i) District Consumer Redressal Forum
ii) State Consumer Redressal Commission and
iii) National Consumer Redressal Commission
d) Arrest of a person by a Police Officer and his duties before arrest and
after arrest vis-a-vis rights of the arrested person.
e) Patient's rights
f) Bail
2. For the negligence committed by doctor / consultant / nurse working in a
hospital/nursing home also be held liable to pay compensation to the patient
suffered due to such negligence. Explain the principle involved in such cases,
also furnishing a few decided cases on the application of that principle.
3. Enumerate the Judicial authorities before whom the patient who has suffered
due to negligence of the doctor in the course of treatment, to proceed against
such doctor for relief.
4. Explain with supporting reasons, whether patient's rights charter enforced in
the United States of America (USA) are required to be enforced in India with
or without any charges, if any, in the same.

5. 5. Explain as to on application of what criteria and principles the Courts decide
as to the doctor's negligence during the course of adjudication of a case
claiming compensation by a patient on the ground of suffering physical pain,
mental agony and monetary lossdue to negligence of doctor.
6. Cana doctor seekcompensation from a patient, whose complaint is dismissed
by the court holding that the allegations are false, vexatious due to which the
doctor hassuffered lossof reputation, mental agony and monetary lossin the
professional income. If so, what is the procedure he should adopt? Explain.
