-Bernice-買賣 美容護膚契約書暨
客 ;以下簡稱甲方,戶
-Bernice 化妝保養品公司;以下簡稱乙方。
茲甲乙雙方成立美容保養品理療之買賣契約,雙方約定條款如下:
第一條:(美容之定義)
本契約所謂美容,係指以本公司化粧保養品,配合提供服務美容之手技、美容設備儀器
等,為保養護理客 臉部及身上肌膚,所實施之綜合指導服務的非醫療行為之專業護膚戶
課程。美容之項目包括:臉部及身上專業護膚;美容諮詢及其相關商品之販賣等。
第二條:(權利義務之依據)
雙方關於美容之權利義務,依本契約條款之約定定之;本契約未約定者,依有關法令及
誠信原則規定。
第三條:(未成年人之訂約)
甲方於訂約時若為限制行為能力人者,須得其法定代理人之允許或承認,本契約始為有
效。
甲方為無行為能力人者,須由其法定代理人代為及代受意思表示之。
第四條:(服務處所之選擇)
契約有效期 甲方得於契約成立之店家接受乙方美容師之美容相關服務,而為保障甲方內 ,
乙方必須遵守下列條款:
一、若甲方對乙方美容的個人服務感到不滿者,有權選擇其他美容師提供服務或提出三
天 退費要求。內
二、甲方若因故發生遷移、搬家等之 況者無法再接受乙方的服務,有權提出三天 退費狀 內
要求。
第五條:(專業護膚課程及附屬商品之 明)說
乙方應將甲方得接受美容實施之條件,以及甲方所選擇之化妝品 容、性質、效用及之總內
價、與附贈的專業護膚課堂數、服務期間、建議效果,於訂約同時向甲方做充 明白之份 說
明,並應提供相關之資料下訂立本契約。
乙方應將為甲方所提供之服務 容留作記 ,並予甲方簽名確認之,且於記 後至少保內 錄 錄
留三年,以供核對。
依個資法為基準,乙方不得在未獲甲方允諾之下將甲方之任何個人資料及記 洩漏予無錄
關之第三人。
第六條:(業者之詢問及處置義務)
甲方於實施美容課程前應先告知乙方目前有無因罹患疾病現正治療中,是否屬過敏性體
質、是否曾有過任何皮膚疾病,現有無服用任何藥物、過去是否曾發生過皮膚敏感的現象,
及其他不利於接受專業護膚之 況。狀
甲方對於乙方之詢問應誠實告知,否則須自負其責。
第七條:(收費及付款方式)
本契約之 品及包含之專業護膚課程費用計新台幣       元。產
甲乙雙方須於訂約之同時銀貨兩訖。
第八條:( 券之使用)卡
乙方如以護膚 、護膚券等方式作為提供服務之憑證者,應向甲方 明其使用方式、服務卡 說
容、使用時段、使用地點、使用次數及有效期間等項目,並應將該等項目載明於護膚 、內 卡
護膚券之上。
前項所謂有效時間係指美容服務預定開始日起    年  月之期間 ,但嗣後甲乙內
雙方 有約定期限者,不在此限。另
第九條:(業者得解除或終止契約事由)
甲乙雙方若有下列事由之一時,得提前中止美容契約之全部或一部 :份
因天災、政府法令等不可抗力或不可歸責於乙方之事由,致不能履約者。
甲方因疾病或健康情形不佳,難以完成契約之課程者。
第十條:(終止契約後業者之附隨保護義務)
甲乙雙方於實施美容課程次數結束後或期限屆滿時,本契約即自動終止,但甲方若有美
容、護膚、及皮膚健康等相關疑問需諮詢者,乙方仍有義務為其協助或提醒告知。
第十一條:(消費者之變更)
甲方經乙方之同意後,得將其依契約所應享受及負擔之權利與義務移轉予其他第三人。
第十二條:(業者之保密義務)
乙方因甲方參加本契約之美容課程,而知悉或持有甲方課程紀 及其他相關之個人隱私錄
資料者,應予保密,並不得為
不當使用。乙方違反前規定致甲方受有損害者,應負賠償責任。
第十三條:(換貨之規定)
乙方所交付甲方之美容用品及化妝品,若有任何包裝上的瑕疵或 品變質現象,可於七產
日 向乙方要求換新貨退換。內
第十四條:(其他)
本契約未詳盡事宜,概依相關法令規定 理。甲乙雙方若因本契約而致訴訟,合意以台辦
灣 地方法院為第一審管轄法院。
第十五條:本契約乙式貳 ,甲乙雙方各執乙 為憑。份 份
