Legal and Ethical Considerations
Copyright
Copyright law originated in the United Kingdom from a concept of common law; the Statute
of Anne 1709. It became statutory with the passing of the Copyright Act 1911. The current
act is the Copyright, Designs and Patents Act 1988. Copyright is an automatic right and arises
whenever an individual or company creates a work. To qualify, a work should be regarded as
original, and exhibit a degree of labour, skill or judgement.
Interpretation is related to the independent creation rather than the idea behind the creation.
For example, your idea for a book would not itself be protected, but the actual content of a
book you write would be. In other words, someone else is still entitled to write their own
book around the same idea, provided they do not directly copy or adapt yours to do so.
I will not be breaking the law of copyright because all my work used in the magazine covers
will be my own individual work. I am taking the photos myself therefore the images will be
100% my own work.
Obscenity Law
The act was created in 1959 , For the purposes of this Act an article shall be deemed to be
obscene if its effect or (where the article comprises two or more distinct items) the effect of
any one of its items is, if taken as a whole, such as to tend to deprave and corrupt persons
who are likely, having regard to all relevant circumstances, to read, see or hear the matter
contained or embodied in it.
In this Act “article” means any description of article containing or embodying matter to be
read or looked at or both, any sound record, and any film or other record of a picture or
picture. The purposes of this Act a person also publishes an article to the extent that any
matter recorded on it is included by him in a programme included in a programme service.
My magazine will stick to these laws because my magazine cover will cause no offence or
contain any explicit material that will break the obscenity laws.
Discrimination Laws
The Equality Act 2010 makes persons rights not to be discriminated against stronger.
Discrimination means treating someone worse than other people because of who they are.
The groups of people who have the right not be discriminated against have also been
extended. People who belong to these groups have what are called protected characteristics. It
is illegal to discriminate against anyone because of their:

In my magazines there will be no discrimination in any of the material I will produce there
will be no homophobic or racist language that will break any of the Discrimination laws.
Ethics
Ethics in media are used in many things such as magazines, newspapers and TV. It means
sticking to the rules of what is accepted and what is not accepted in terms of material
produced by a media institution. In turns of morals it’s what different people find acceptable.
What may be offensive to one person may not be offensive to another. My magazine is aimed
at teenagers. On this type of magazine the morals would be questioned for example; someone
swearing on the front cover may go against the morals of someone for example an older
person. My magazine will not have any thing on it that may go against my target audience’s
morals, such as Swearing, poses of models, unsuitable clothes e.g. underwear and Sexuality.
Contingency Plan
If it rains then I will have to change my location too indoors. . Also if models are not
available I will use a different model named Jack Welsh and Olivia Occconor.
