A public defender is a lawyer appointed by the court to represent defendants who cannot afford private counsel, while a private attorney is one hired by the defendant. Most defendants would choose a private attorney over a public defender because private attorneys often have smaller caseloads and can therefore spend more time on each case. A recent case supports choosing a private attorney because public defenders in some areas had such large caseloads that they could not effectively represent all of their clients.
