• SEP date of declaration as to the letter of assurance
• SEP list of standards the SEP is declared for
• The declarant/affiliate are prepared to grant licenses = prepared / not prepared

Assessment of the “Mode of Action Landscape” for particular disease areas is of high interest for pharmaceutical companies. To enable identification of upcoming, established and vanishing modes of action over time and clinical phases it is crucial to have tools for integration and comparison of drug pipeline data from various sources, including informative visualizations of changes in the landscape. The BizInt Smart Charts product family including VantagePoint - Smart Charts Edition (VP-SCE) enables these analyses and was therefore selected for evaluation. Data was integrated from different key drug pipeline databases, and the newly developed VP-SCE provided opportunities to use in-house data for normalization of important field content such as the highly diverse lists of “Mode of Action” generated by the pipeline databases. Using an example of pipeline data in the field of breast cancer we will show how the data was curated and processed to reach the final landscape, and how the programs can be applied in the most effective way. Examples of visualizations for facilitated decision-making will also be shown. To this end, our presentation will provide insight on the value of integrating and visualizing both external and internal data from drug pipelines employing these tools.

WIPO started work in the area of patent analytics in 2010 with a Development Agenda project on “Developing Tools for Access to Patent Information” which resulted in the production of a series of Patent Landscape Reports (WIPO’s patent landscape reports can be found here). These reports, prepared in cooperation with various UN Agencies, non-governmental organizations, research institutes and national IP Offices, analyze patent activity in various topics in the areas of public health, food and agriculture, environment and energy, and disabilities. The key findings are often summarized in an infographic. In 2013 WIPO started working also on awareness raising and capacity building in the area of patent analytics. Apart from various workshops organized on this topic, WIPO published in September 2015 the “Guidelines for Preparing Patent Landscape Reports”. The Guidelines describe the objectives and motivations for preparing Patent Landscape Reports (PLR) and other types of patent analysis, the tasks associated with patent analytics, as well as the stages in the preparation of PLRs, providing also some insights from WIPO’s experience in the area. Since 2015 WIPO is exploring open source tools for patent analytics purposes in the framework of the preparation of a Manual on Open Source Tools for Patent Analytics. Open source tools are typically used by other disciplines, usually business/data analysts, statisticians, IT professionals and scientists, rather than with regard to patent data. Nevertheless, in recent years they started emerging as an alternative and/or a complement to ready-to-use tools, providing flexibility and adaptability in different analysis types. In view of the necessary programming related to this type of tools, WIPO developed step-by-step instructions in the Manual with example datasets, and will provide capacity building activities with training on patent analytics for Technology and Innovation Technology Support Centers (TISCs) around the world (for more information on the TISC program please visit www.wipo.int/tisc) .

This presentation will give some guidelines on how to create a meaningful Patent Landscapes. Generating patent landscaping reports seems simple, but it isn’t. For making patent landscapes you have to take several different issues into consideration. It’s important at the start to already have in mind what kind of landscape report you are going to prepare, and choose a topic of interest, but preferable not one that is too broad. It’s also extremely important to have a clean (80-90% relevance) dataset that the landscape is based on; otherwise the outcome will be rubbish. And of course, do not use landscapes for questions that require a legal opinion (like Freedom-to-operate conclusions!!). Patent landscapes are not aimed to be as precise as other patent searches. Some more important issues has to be taken in account and are presented.

Understanding competitors’ patent portfolios and protecting their own intellectual properties are key questions for pharmaceutical companies. Extracting and analyzing the chemical space covered by these patents is an extremely complex and time consuming challenge and requires many communication rounds between IP experts and members of drug discovery teams. ChemAxon has been working with researchers in the industry to develop tools to help in this area by building and analyzing project specific databases based on high quality computer-assisted extraction of chemical information from patent documents. These databases can be useful across the full drug discovery process from idea generation to lead candidate selection, drug design and creation of new patents. This way we can eliminate these rounds of communication, because IP experts can precisely translate the content of patent documents to the language of chemistry which is more comprehensible to other actors. This presentation will discuss the results of this development and technologies developed or used, namely: English and Chinese Name to Structure, which dramatically speeds up the extraction process; Markush Editor that helps draw complex Markush structures more easily, Structure Checker and Markush Validation, which confirm the quality of extracted information. We will also introduce our search, enumeration and hit visualization and our latest improvements that allow overlap analysis between Markush structures.

The pressures of pharmaceutical research and development demand increasing efficiency from scientists. High-quality decisions must be made faster and encompass all available information. At the same time there is a growing desire to better utilize the multi-billion dollar research investment recorded in laboratory notebooks and bioassay databases. Key values for data integration in a data exploration environment include gathering data from disparate E-notebooks and bioassay databases into a single searchable “virtual” system and increased discoverability by accessing data through a system designed for exploration. Key benefits are better chemistry decisions through easier access to broader data and reduced time for preparing patent filings. The ability to interlink in-house and reported assay data with in-house and published chemistry provides a data-rich environment for developing insights and predictive models. We will discuss our experience with integrating information from journals, patents, bio-assay databases, and E-lab notebooks to address these needs.

The valuation of intellectual property is becoming an increasingly important component of realising return on R&D; investment, overall business strategy and IP portfolio management. Like other forms of property, the value of intellectual property is determined by what the buyer is prepared to pay for its perceived value, and what the seller is willing to accept. This is ultimately decided by negotiation. However, there is much that can be done to substantiate the value in support of the position of either the seller or the buyer. From the seller’s viewpoint, being able to place the IP accurately on the competitive landscape is critical to establishing how important the IP is, and hence its perceived market value. On the buyer’s side, the accurate assessment of the market position held by the IP on the technology landscape against competition will help determine whether this is a blocking technology, or whether it can ultimately be worked around. This is a combination of science and art. There are also special considerations to be factored in for the chemical technology space. In all cases, IP information and analysis tools play a central role in providing support for valuation of IP. This presentation will use a case study approach to examine the issues and provide insight into how organizations can more accurately assess the importance of their IP, and hence the current and potential market value of that IP.

Christopher Southan (The IUPHAR/BPS Guide to PHARMACOLOGY, UK) While the raison d'être of patents is Intellectual Property (IP) there is a growing awareness of the scientific value of their data content. This is particularly so in medicinal chemistry and associated bioactivity domains where disclosed compounds and associated data not only exceeds that published in papers by several-fold and surfaces years earlier, but is also, paradoxically; completely open (i.e. no paywalls). Scientists have traditionally extracted their own relationships or used commercial sources but the last few years have seen a “big bang” in patent extractions submitted to open databases, including nearly 20 million structures now in PubChem. This tutorial will: Outline the statistics of patent chemistry in various open sources Introduce a spectrum of open resources and tools Enable an understanding of target identification, bioactivity and SAR extraction from patents and connecting these relationships to papers Cover aspects of medicinal chemistry patent mining Include hands on exercises using open source antimalarial research as examples The focus will be on public databases and patent office portals, since these can be transparently demonstrated. However, the essential complementarity with commercial resources will be touched on. Those engaged in Competitive Intelligence will also find the material relevant.

The UK IP Office commissioned research with CambridgeIP to examine some of the questions raised by the UK government's Hargreaves Review of IP and Growth. The study focuses on two broad issues: a) the effects of patent thickets on innovation and market dynamics; and b) the role of technology standards and patent pools as a possible response to the emergence of patent thickets. Our research was based on a case study of the emerging space of Telehealth, and particularly on the use of patents for wireless-‐enabled medical devices. Our methodology used a combination of patent landscaping around 5 technology areas, interviews with industry experts, and scholarly literature review.

Cited references and citing references link patent documents through time and by subject. As citations do not depend on text search, they can be particularly useful for identifying patents from the Asian languages. Using forward and backward citations can enhance subject retrieval and provide added competitor information. Tools for searching and viewing patent citations, both forwards and backwards are now standard on most commercial patent information platforms. An overview of these will be presented. When using patent citations for search and analysis, it’s important to understand their origin. I will start by going back to basics and present an overview of the different types of patent citations, and how to use them wisely.

Patent documents from the United States have a number of different types of citations associated with them. The majority of the citations are communicated between the examiner and the applicant via forms 892 and SB08. Form SB08 is better known as the Information Disclosure Statement (IDS) and is used by the applicant to communicate the prior art references that they are aware of. Form 892, on the other hand, is referred to as the List of References cited by examiner. This is the list of references identified during the examination process and represents the prior art used for the various office actions that take place during prosecution. In all cases, citations on Form 892 are hand-picked by the examiner, based on their relevance to the application at hand, and can be considered to be highly likely to be on the same topic as the case. During this presentation, various methods, by way of a case study, will be explored for identifying and analyzing examiner citations coming from US patent documents including blocking citations that have been used in an office action during the examination of a subsequent patent application.

I have devised a method to extract useful insights for the development of new products or services from patents in specific technology fields by using the analysis and cognition capabilities of GPT-4 based ChatGPT. I have applied this to the fields of generative AI, metaverse, and Web3-based fintech. For the case study, in the generative AI field, I examined Google's patent US10452978 "Attention-based sequence transduction neural networks" (this patent describes the transformer architecture, which is the basis of most large language models (LLMs) for generative AI); in the metaverse field, I looked at Meta's patent US11302063 "3D conversations in an artificial reality environment"; and in the Web3-based fintech field, I explored nChain's patent US10776761 "Virtual currency system." I input into ChatGPT a guideline consisting of five key steps: identifying the main purpose of the patent invention, summarizing the technological innovations in the patent claims, describing potential products or services based on the technology, identifying the main industry participants, and evaluating competitive advantages. The outputs generated from the method described can provide valuable insights for various business applications: Patent licensing promotion: By identifying the main purpose, technological innovations, and potential products or services related to a patent, businesses can better understand the value proposition of their intellectual property. NFT financialization is the most important element of NFT monetization innovation to overcome the low liquidity and high price volatility of almost all NFTs currently. NFT Fractionalization splits a NFT into smaller fungible tokens that represent partial ownership of the NFT. The NFT is locked in a smart contract and the ownership remains with the original holder. Fractionalization can unlock liquidity for NFT owners and cheapens access to valuable NFTs, and improves the NFT market spectrum. An issue with fractionalization is a reconstitution after ractionalization. Buyout auctions alleviate the reconstitution problem to some extent. *NFT fractionalization protocols: NFTX (https://nftx.io/), Fractional (https://fractional.art/), NFT20 (https://nft20.io/), Unic.ly (https://www.unic.ly/), Szns (https://www.szns.io/) NFT Lending uses NFT as collateral for loans. 1. 1 Big Data Analysis for Standard Essential Patents The IPlytics Platform is an intelligence IP analytics SaaS. The IPlytics Platform uses big data frameworks to intelligently connect and analyze multiple data sources. The IPlytics Platform data sources cover over 80 million patent documents for 98 worldwide countries, over 60 million scientific articles, information regarding over 3 million companies, about 2 million standards documents from 96 standard setting organizations including over 200,000 standard essential patents (SEPs) declared at the major standard setting organizations (SSOs).

The SEP data provides direct links to the patent and standards database as well as the following information: • SEP declaring company • SEP contact person for licensing questions • SEP contact address of the declaring company • SEP date of declaration as to the letter of assurance • SEP list of standards the SEP is declared for • The declarant/affiliate are prepared to grant licenses = prepared / not prepared • The declarant/affiliates commits to license under = FRAND / Royalty-Free conditions • Are there specific licensing conditions = Yes/No • The declarant / affiliate is proprietor of IPR(s) = Yes/No • Subject to condition that those who seek licenses agree to reciprocate = Yes/No • The patent is standard essential = Yes/No
