EDITOR'S NOTE
Where to begin from? Just three months into the Organisation and I was
given an important task of being the Editor of our Newsletter “Palm
Insights” – our launch edition. Being the editor of Palm Insights has not
only been challenging but also a great learning experience in terms of
soliciting information and making various drafts before we all agreed on
the FINAL version. Palm Insights is a team effort where each one of us has
shared the knowledge and experience to make it a success.
I would especially like to Thank- Mr. Amit Singh for his vital inputs & Ms. Vaishali Tyagi who has worked hard to edit
and set the entire information for the launch issue.
The idea of this newsletter is to engage our Customers, Business Associates & our Employees on a monthly basis and
provide insights on the Company’s Performance, Industry Updates, Regulatory Developments, Expert’s opinion on
various topics of interests valuable to our Customers & Partners.

6. After the first wave of Covid that hit the country in 2020 ,
IRDA had decided, to allow Insurance Companies to offer
Short Term Covid Specific Health Policies, which were
introduced in June 2020. The Policy Period of such policies
was less than a year and were valid till March, 2021.
Now that the second Covid 19 wave has hit the country
really hard and this strain being more deadly and fierce,
IRDA has decided to extend the timeline to offer and
renew Covid Policies up to September 20,2021.
One the most popular Covid Policy is called the Corona
Kavach Policy which is available both for an Individual
Customer as well as Corporates under a Group Covid
Policy. Corona Kavach is an indemnity-type policy that
reimburses hospital bills up to the sum insured limit,
subject to terms and conditions.

8. Case Reference Given by the Petitioner-The
Petitioner had referred and relied upon the
observation in judgment of Hon’ble Supreme Court
in the case Biman Krishna Bose v/s United India
Insurance Co. Ltd. reported in III (2001) CPJ 10(SC)
held that –‘A renewal of insurance policy means
repetition of the original policy. When renewed, the
policy is extended and the renewed policy in the
identical terms from a different date of its
expiration comes into force. In common parlance,
by renewal the old policy is revived and it is sort of
a substitution of obligation under the old policy
unless such policy provides otherwise .It may be
that on renewal, a new contract comes into being,
but the said contract is on the same terms and
conditions as of the original policy.’
CASE STUDY
Policy since 1993 which was getting renewed by paying
Renewal Premiums. The Same Policy was renewed by The
New Mediclaim Policy in 2012.

Vidal Health TPA Pvt. Ltd.
Claim Denial Reason- The treatment given was on
OPD basis which is excluded as per the terms and
conditions of the Medicaim Policy 2012. But not
excluded in mediclaim Insurance Policy 1993.
Fact: The Complainant’s wife Mrs. Sudha Nevatia reduce
her vision in her left eye in month of February 2016. After
examination by the doctor, it was confirmed that there
was problem in her left eye and she was advised to
intravitrel and the same was conducted on 15/02/2016. .
She was also advised to take two more Lucentis injections
at monthly interval and regular monitoring for the said
treatment. The Insured incurred the expenses of Rs
44,850/-towards the same. The claim was lodged by the
Petitioner and declined by the Respondent.
Certificate Given By the Hospital-Intravascular
injection cannot be done in OPD as it needs the
sterile environment, the same was performed in
UB Operation Theatre under aseptic sterile
condition. If the said treatment is done in normal
OPD and without taking proper hygienic
precautions, the Petitioner would have suffered an
irreparable loss to her eyes.
Order Passed by South Mumbai District
Consumer Disputes Redressal Forum The
Respondents were jointly and severally directed to
pay to the Petitioner a sum of Rs.44,850/- along with
interest thereon @ 6%p.a. from 26/02/2016 till
realization of the said amount , to pay a sum of Rs.
10,000/- towards the compensation for mental
agony, to pay Rs. 5,000/- towards the cost of
litigation.
