copyright owner and performer, it may
constitute an infringement under Copyright
Act 1987.

1) reproduces in any material form, performs, shows or plays or distributes to the public,
2) imports any article into Malaysia for the purpose of trade or financial gains;
3) makes for sale or rent any infringing copy;
4) sells, rent or by way of trade, exposes or offers for sale or rent any infringing copy;
5) distributes infringing copies;
6) possesses, otherwise than for his private and domestic use, any infringing copy;
7) exhibits in public any infringing copy by way of trade;
8) makes or has in his possession any contrivance used or intended to be used for the purpose of
making infringing copies

Elias Idris, 64, had sued Yusof and his actor-director
son Syamsul and their company, Skop Production
Sdn Bhd for copyright infringement over his novel,
Aku Bohsia.
The novelist claimed there were many similarities
between his book and the movie, Bohsia: Jangan
Pilih Jalan Hitam, in terms of plot, characters and
message.

Injuction
• Elias granted an injunction order to prevent the respondents,
their agent from further publishing, broadcasting,
distributing, and reproduction of the film without his
written consent.
Account Profit
• The respondents ordered to deliver all infringed copies and
goods to Elias or his nominee.
• Given an order for accounts to be taken to identify profit
received from the alleged copyright infringement and monies
to be paid to Elias including with interests, and awarded
him RM40,000 in legal costs.
