5. Sexual Misconduct - Title IX
Georgia State University does not discriminate on the basis of sex in its education
programs and activities and prohibits such discrimination by students, faculty and staff.
Nondiscrimination on the basis of sex is mandated by Title IX of the Education
Amendments of 1972 (20 U.S.C. §§ 1681 et seq.) and the corresponding implementation
regulations (34 C.F.R. Part 106).
Title IX prohibits sex discrimination. Sex discrimination constitutes sexual misconduct and
includes both sexual harassment and sexual violence. At Georgia State University, the term
sexual misconduct encompasses sexual harassment, sexual exploitation, non-consensual
sexual contact, non-consensual sexual intercourse, dating violence, domestic violence and
stalking.
Did you know sexual misconduct is any kind of unwanted sexual contact, including sexual
contact with someone who is unable to give legal consent due to intoxication or being
underage? Would it surprise you to learn that hooking up with your girlfriend or
boyfriend while they are drunk, posting or sharing revealing photos of someone without
their consent, or showing or sending revealing photos to someone who does not want to
see them can all constitute sexual misconduct?
