The United States Department of Education (Department) disposed of Mr.
HilbertÂ's March 4, 1999 complaint against the Council of the Section of
Legal Education and Admission to the Bar (Council) on October 21, 1999.
Ms. Naomi Randolph, Supervisor, Accreditation and State Liaison cited
the following in an October 21, 1999 enclosure to Dean James White,
Consultant on Legal Education to the American Bar Association: "Although
many of the issues raised in your complaint involved the CouncilÂ's
standards and policies, our review of the documentation that Â* the
Council submitted [ ] conclude that the Council acted in accordance with
both the SecretraryÂ's Criteria for Recognition and its own policies and
procedures." Moreover, Ms. Randolph "found that Mr. HilbertÂ's complaint
against the Chicago-Kent Law School [was] not based on any violation of
CouncilÂ's accreditation standards."
In addition, the American Bar Association Section of Legal Education and
Admissions to the BarÂ's Rule 24 provides that the "decision of the
Consultant is final and is not subject to appeal within the
Association." AMERICAN BAR ASSOCIATION STANDARDS FOR APPROVAL OF LAW
SCHOOLS Rule 24(g) (1998) (Kurt Snyder, Assistant Consultant on Legal
Education to the American Bar Association, June 24, 1999).
During its investigation, the Department informally adjudicated the

Ms. Naomi Randolph closed the investigation on or about October 21, 1999
and thanked Dean James White "for the thorough information and
investigation provided in your response to our inquiry, as well as the
timely response to this complaint." As such, Code of Federal
Regulations, §602.27(f)(2) provides: "The accrediting
agencyÂ*Resolve(s) the complaint in a timely, fair, and equitable
manner." 34 C.F.R. pt. 602 (1999). The standard definition of fair
provides: "hav[ing] qualities of impartiality and honesty; just; equal
as between conflicting interests." BLACKÂ'S LAW DICTIONARY 412 (6th ed.
1994). Moreover, a standard definition of equitable provides:
"conform[ing] to the principles of justice and right." BLACKÂ'S LAW
DICTIONARY 372 (6th ed. 1994).
As such, pursuant to Code of Federal Regulations, §602.27(f), Mr.
Hilbert formally petitions the Department to revisit the complaint filed
against the Council. 34 C.F.R. pt. 602 (1999).
