Who is concerned ?
> Government departments, agencies and
enterprises within the meaning of the Auditor
General Act
> Municipal bodies, school bodies and health and
social services institutions (upon future decree)
Govnmt departments and agencies responsibilities
> Participate to developing the SD strategy
> Participate to the selection of SD indicators
> Prepare a SD action plan in relation to the strategy
> Report annually on their contribution and
progress towards strategy implementation

> Promote SD within their jurisdiction
> Support stakeholders in their efforts towards
sustainability
Responsibilities of the Sustainable Development,
Environment and Parks Department
> promoting sustainable development within the
Administration and among the general public, and
fostering joint and cohesive action in order to
harmonize interventions;
> coordinating the efforts of the government
departments to define, renew or revise the
components of the sustainable development
strategy, including sustainable development
indicators, and recommending the adoption of the
strategy and indicators by the Government;
Responsibilities of the Sustainable Development,
Environment and Parks Department (ctnd)
> coordinating efforts to prepare periodic assessments of the
implementation of the sustainable development strategy within the
Administration and, at least every five years, drafting, an
implementation status report and submitting it to the Government
for approval;
> enhancing knowledge and analyzing experiences elsewhere in the
field of sustainable development;
> advising and providing expertise and assistance to the
Government and third persons as regards sustainable
development to help achieve the objectives of the strategy and to
ensure that the principles of sustainable development are applied
and complied with.

> Foster a concerted approach and a synergy
of interventions in keeping with all the
principles of sustainable development
> State the roles and responsibilities of each
player or certain members of the
Administration in order to ensure internal
efficiency and coherence
> Should reflect the range of concerns of
citizens and communities
> Specify monitoring mechanisms or means
Sustainable Development Strategy (ctnd)
> SD information and education measures to be
implemented
> Development of tools or models for the design,
determination and analysis of projects in terms of
SD
> Mechanisms to be implemented to encourage the
participation of various stakeholders
> Means selected to foster an integrated approach
and the coherence of the interventions at local,
regional and national level, including Native
communities

> Appointment of an assistant auditor general
bearing the title of Sustainable Development
Commissioner
> Identification of SD indicators
> Means (performance indicators and mechanisms)
to monitor the implementation of the strategy and
action plans
> Production of annual reports on the activities
aimed at achieving SD
Green Fund
> Establishment of a Green Fund
> Dedicated to the financing of measures or
programs carried out by the minister of SD,
Environment and Parks to promote SD
> Support municipalities and NGO working in the
environmental field
> Funded by revenue derived from fees or other
amounts collected under the Acts or regulations
under the administration of the Minister;
environmental fines; compensation funds;
punitive damages, etc
Modification of the Charter of human rights and
freedoms
> Adding a new right to the economic and social
rights listed in the Charter of human rights and
freedoms
> Affirming the right of every person to live in a
healthful environment in which biodiversity is
preserved, to the extent and according to the
standards provided by law
Public participation
> Public audiences on the SD Plan and legislation project held in
21 municipalities of the province.
> 582 memoirs received
> More than 630 people took the floor
> 3500 participated to the audiences
> More than 4000 recommendations were recorded.
> Before its unanimous adoption by National Assembly, a further
version of the legislation was submitted again to public
consultation in the form of parliamentary committee hearings
Public participation
Provisions of the SD Act include :
> Submitting the strategy and any review of it to public
consultation in the form of parliamentary committee
hearings
> Integrating in the strategy information and education
measures on SD and mechanisms to be implemented
to encourage the participation of the various
stakeholders in society
> Giving the Minister the function of promoting SD
among the general public
> Making public action plans, annual and other
progress reports

Le plan de développement durable du Québec répond aux attentes de la population telles qu’elles ont été exprimées entre autres lors du Forum des générations et lors de la tournée de consultation du ministre. Au cours de cette consultation, le ministre a reçu plus de 580 mémoires comprenant plus de 4000 recommandations. Les audiences se sont tenues dans 22 villes du Québec entre le 17 janvier et le 17 mai 2005 et ont réuni plus de 3500 participants. Ce plan est appuyé au plus haut niveau de l’appareil politique Il faut donc s’y préparer en connaissant mieux les implications de cette démarche ainsi que les moyens et les outils déjà en place; ce que j’aimerais faire avec vous aujourd’hui.
  2. Le plan de développement durable répond à des enjeux bien identifiés et soulève des défis incontournables. Apprendre à sortir de nos silos respectifs et travailler en collégialité Comment ? : en inscrivant nos actions sectorielles dans un plan d’ensemble, une stratégie gouvernementale commune.
  3. Viser une continuelle amélioration de la qualité de vie de la population dans un contexte où les moyens sont limités.
  4. Dorénavant les principes de développement durable devront teinter toutes les décisions de développement, que ce soit dans les politiques, les programmes ou les actions.

Maître Paule Halley, professeure à la Faculté de droit de l’Université Laval, affirmait ce qui suit dans un article récent sur le projet de loi sur le développement durable : « Dans son Plan de développement durable, le gouvernement présente les moyens qu’il entend mettre de l’avant en vue d’impulser ce changement important de culture institutionnelle face au développement économique et social. C’est la future Loi sur le développement durable qui mettra en oeuvre les instruments identifiés pour opérer ces changements. L’Avant-projet de loi sur le développement durable, déposé le 25 novembre 2004, confirme la volonté politique du gouvernement de mettre en oeuvre le développement durable en soumettant son action à l’examen d’un commissaire au développement durable et à l’évaluation critique de la population par le biais d’obligations de transparence et de reddition de comptes. Ce cadre législatif aura pour effet de rendre la mise en oeuvre du développement durable au sein de l’administration publique québécoise moins discrétionnaire et plus transparente. »

Le projet de loi instaure un nouveau cadre de gestion au sein de l’Administration pour que l’exercice de ses pouvoirs et de ses responsabilités s’inscrive dans la recherche continue d’un développement durable. Le projet de loi donne une définition du développement durable qui est celle proposée par le Rapport Brundtland en 1987 et largement reconnue par la communauté internationale. La vision à long terme du développement durable prend en compte le caractère indissociable des dimensions environnementale (milieu de vie), sociale (mode de vie) et économique (niveau de vie) des activités de développement.

Le projet de loi visera dès son adoption tous les ministères et organismes de l’administration publique; Puis, au moment jugé souhaitable par le gouvernement, et après consultation de ces derniers, le projet de loi s’appliquera aux organismes municipaux, aux institutions d’enseignement et aux établissements de santé et de services sociaux.

La loi fournit aux ministères et organismes un guide permettant de mieux réfléchir aux façons de réaliser le développement et d’inscrire la pensée du développement durable dans les interventions : ce sont les 16 principes qu’ils devront prendre en compte dans la réalisation de leurs actions. Ces principes universellement reconnus reprennent ceux qui ont été adoptés par les Nations Unis lors du Sommet de la Terre de Rio de Janeiro en 1992. Ces principes reflètent les dimensions environnementales, sociales et économiques. Par exemple, la prise en compte du principe de précaution se manifeste actuellement dans le secteur forestier par la mise en place de certaines des mesures recommandées par le rapport Coulombe. La confection des plans de sécurité publique est un autre exemple de prise en compte du principe de précaution. Le principe de subsidiarité, pour sa part, trouvera son écho dans la négociation des transferts de responsabilités avec les municipalités. L’adoption du principe de protection du patrimoine culturel vient confirmer l’importance que nous accordons à notre identité culturelle.
  12. Cette stratégie doit être adoptée par le gouvernement au plus tard un an après l’entrée en vigueur de la loi sur le développement durable.

Déjà quelques ministères ont entrepris l’élaboration de leurs plans d’action (MDDEP, MRNF, MESS) qui comportent à la fois des actions existantes et des actions nouvelles.
