Arbitration and Conciliation Act, 1996
• Deals with domestic arbitration, international
commercial arbitration and enforcement of
foreign arbitral awards.
• law relating to conciliation
• Based on UNCITRAL Model Law, Model Law on
International Commercial Arbitration, 1985
and the UNCITRAL Conciliation Rules, 1980.
3. • 2001: 16th Law Commission, 176th report-
Undertook complete Review of ACA-1996
• 2003: ACA (Arbitration and Conciliation) bill
introduced.
• 2004 : JUSTICE B.P. SARAF COMMITTEE - in-depth
study of the analysis of the recommendations of
the 176th Report of the Law Commission and all
aspects of the Arbitration and Conciliation
(Amendment) Bill, 2003.
4. • 2004: Changed act introduced, Standing
Committee rejection.
• Ground= substantial intervention by court in
the arbitration process.
5. New Law
• 2013: 246th report of Law Commission (20th)
AP Shah recommended changes in ACA-1996.
• Settle the case in nine months or the Judge
shall be debarred.
• Extension can be given by high court.
• Spell Out the CONFLICT OF INTEREST, if any.
