The Australian heavy vehicles laws have changed
On October 1, 2018
amendments to
Australia’s Heavy
Vehicle National Law
came in to force,
including new Chain
of Responsibility
(CoR) legislation.
This legislation has
wider ranging powers
and tougher penalties
when it comes to
managing the safety
of your fleet.
It requires every
business using heavy
vehicles (over 4.5
tonnes) to take a more
proactive approach
to safety.

Everyone in your transport chain is now responsible
Everyone with a role in your transport
supply chain, both on and off the road,
is now collectively responsible for the
safety of your transport operations.
This means everyone from your directors and
management team to your consigners, dispatchers,
loaders, contractors, partners and drivers all now
share the responsibility of the business being safe
and compliant, both on and off the road.

The wider Chain of Responsibility legislation has been developed to

• Prosecution is no longer dependent on a
road offence actually taking place.
• Now, prosecutors only need to establish
that your business, or someone within it,
hasn’t taken adequate precautions to avoid
a foreseeable risk for charges to be laid
against all those responsible in the chain.

• Those found responsible for a breach
could be liable for a fine of up to
$300,000 or five year’s imprisonment.
• Companies could also face a fine of up to
$3 million…
...so it pays to ensure your business is doing
everything possible to proactively manage
the risk.

Taking all ’reasonable steps’ to comply
Everyone in your chain needs
to ensure they have taken all
reasonable steps to ensure their
actions are, or were, in line with
the road transport laws.
‘Reasonable steps’ requires
everyone involved in your chain,
not just your drivers, to collectively
do everything possible to prevent
a breach of the law occurring.

Taking reasonable steps can include (but is not limited to):
• Implementing good business
management, monitoring, safety practices
and training for your drivers and support
staff.
• Ensuring loads are weighed, measured and
secure at all times.
• Carrying out regular vehicle checks and
maintenance.
• Ensuring schedules are set with realistic,
achievable timeframes and are adhered to.
• Ensuring loading and unloading activities
are carried out efficiently so that drivers
are not unreasonably delayed.

Taking reasonable steps can include (but is not limited to):
• Ensuring goods are packed securely.
• Advising management of any delays.
• Regularly engaging with other
(external) parties in your chain to
ensure safe practices are being
followed.

• Designing contracts and business
agreements to ensure drivers and all other
parties in your chain adhere to the law.
