It has been observed that in some occasions, staff are smoking in their offices. Smoking in side offices is 2nd. degree violation of HR code of conduct and below are the penalties for smoking in no smoking areas: Violation 1st occurrence 2nd occurrence 3rd occurrence 4th occurrence 5th occurrence Breaching health instructions pinned at workplaces, or smoking in workplaces where smoking is not allowed. Written warning Written warning Written warning Written investigation and warning Termination of service with end of service benefits “Company No Smoking Policy” is clear when it comes to smoking in offices, and this is also a breach of the following UAE laws and regulations: 1.) Administrative Resolution No 92 - 2009 2.) Local order No 11 – 2003 3.) Administrative Resolution No 30 – 2007 4.) Federal Law No 15 – 2009 5.) Dubai Municipality Manual of Regulating Smoking in Public Places – 2009 As per federal law No. 15 – 2009, “Violation of the provisions of this Law, the Competent Authority shall receive an immediate fine of AED 500 to be paid against reconciliation. In case of failure of reconciliation, the incident shall be referred to the criminal trial, where the violator shall be punished by a fine of minimum AED 3,000 and maximum AED 10,000. Recurrence of violation shall be resulted in recurrence of punishment”. All Company employees are hereby advised to comply with the above Laws, Regulations and Company No Smoking Policy.
