assists its clients in overcoming obstacles
encountered in complying with the
Skills Development and Employment Equity Acts.
We furthermore implement interactive
Human Resources Management systems, spanning from
sourcing to termination, which allow the client organisation
to take control of the processes created therein, or to
alternatively let HRDNA manage it for them remotely.
About HRDNA

The company is owner-led and managed by
a seasoned Human Resources professional with extensive
experience in managing HR departments for large corporates as
well as creating and growing HR departments for new entrants.
The above allowed him to lead large teams to the achievement
of people related processes. It also allowed him to see the
myriad ways in which South African organisations fall short
when they focus on implementing these processes without
real integration with other business functions.
Companies get entangled with the complexities of HR and
compliance issues to such a degree that they lose sight of
their purpose. From this realisation was HRDNA born.

1. B-BBEE - Non-compliance in terms of skills
development has a knock-on effect for your
B-BBEE rating. With the inception of the new
sectoral codes of good practice on B-BBEE skills
development has increased in weighting quite
drastically. This means that, if all else remains the
same, and your company does what it did last year
and before that, you are likely to see a B-BBEE rating
of at least two levels lower than before. Total
compliance is a requirement for any verification on
skills development elements.
2. Claiming of grants - When your WSP and ATR is
submitted to your SETA you get acces to the following:
- Mandatory grants: 20% of all skills levies paid, and
- Discretionary grants: Tuition fees paid for your
learners enrolled on PIVOTAL programmes.
Both of the internal transformation strategies are attached to serious risk factors if the company does not comply.
Be assured that neither skills development, nor employment equity ompliance depend only on reporting and neither
of these strategies can be dealt with a month or two before the submission deadlines. The supporting documentation
to your skills and equity reports are numerous and require quite some attention, training and proof of consultation.
The department of labour has intensified its random audits
to a level where they currently manage to inspect about 20%
of designated employers annually. This means that your
organisation has a 1 in 5 chance of being audited this year.
If found non-compliant, the department can institue the
following penalties:
The greater of R1 500 000 or 2% of the employer's annual turnover
- In case of no previous contravention
The greater of R1 800 000 or 4% of the employer's annual turnover
- In case of no previous contravention of the same provision only
The greater of R2 100 000 or 6% of the employer's annual turnover
- A previous contravention within the previous 12 months
The greater of R2 400 000 or 8% of the employer's annual turnover
- Three previous contraventions
The greater of R2 700 000 or 10% of the employer's annual turnover
- Four previous contraventions
Labour Relations
Labour Relations
HRDNA offers the following labour relations services:
Chairing and overseeing disciplinary hearings and appeal hearings,
Facilitating poor performance and incapacity counselling meetings,
Drafting and implementing disciplinary codes and procedures,
Advising management and negotiating with relevant parties over wage agreements,
CCMA and Bargaining Council DRC preparation, subject to the rules of the CCMA,
Assisting and advising employers during strikes, go-slows, lockout procedures, picketing
and all other forms of industrial action,
Organisational restructuring management - Retrenchments and changing conditions of employment
Administration and implementation of contracts of employment,
Management of the grievance process,
Union interaction and management of the relationship with the relevant union(s),
Consultation with workplace forum(s),
Development and implementation of a strategically aligned Industrial relations policy

About HRDNA Passionate about people / serious about compliance HRDNA is an independent consulting firm that assists its clients in overcoming obstacles encountered in complying with the Skills Development and Employment Equity Acts. We furthermore implement interactive Human Resources Management systems, spanning from sourcing to termination, which allow the client organisation to take control of the processes created therein, or to alternatively let HRDNA manage it for them remotely.

About HRDNA Cobus van Dyk, The company is owner-led and managed by a seasoned Human Resources professional with extensive experience in managing HR departments for large corporates as well as creating and growing HR departments for new entrants. The above allowed him to lead large teams to the achievement of people related processes. It also allowed him to see the myriad ways in which South African organisations fall short when they focus on implementing these processes without real integration with other business functions. Companies get entangled with the complexities of HR and compliance issues to such a degree that they lose sight of their purpose. From this realisation was HRDNA born.

Compliance Interaction Broad-based black economic empowerment Skills development Employment Equity We partner with expert B-BBEE consultants who ensure overall compliance with the B-BBEE Act and who lead the client’s transformation strategy in line with its business objectives. HRDNA ensures the client’s compliance with the skills development and employment equity Acts to positively impact their B-BBEE scorecard and to avoid the legislated penalties. HRDNA ensures full compliance with the EEAct by implementing the following requirements: 1. Appointment of committee, 2. Training of committee, 3. Facilitation of quarterly committee meetings, 4. Drafting and implementation of EE plan, 5. Drafting and implementation of relevant policies, 6. Annual EE reporting. HRDNA ensures full compliance with the SDAct by implementing the following requirements: 1. Appointment of committee, 2. Training of committee, 3. Facilitation of quarterly committee meetings, 4. Drafting and implementation of Workplace skills plan, PIVOTAL training plan and ATR. 5. Ensuring implementation of planned training, 6. Assisting with claiming of grants (Mandatory and discretionary) 7. Liaising with SETA’s as the client’s SDF.
  • 10. Associated risks Skills development Employment Equity 1. B-BBEE - Non-compliance in terms of skills development has a knock-on effect for your B-BBEE rating. With the inception of the new sectoral codes of good practice on B-BBEE skills development has increased in weighting quite drastically. This means that, if all else remains the same, and your company does what it did last year and before that, you are likely to see a B-BBEE rating of at least two levels lower than before. Total compliance is a requirement for any verification on skills development elements. 2. Claiming of grants - When your WSP and ATR is submitted to your SETA you get acces to the following: - Mandatory grants: 20% of all skills levies paid, and - Discretionary grants: Tuition fees paid for your learners enrolled on PIVOTAL programmes. Both of the internal transformation strategies are attached to serious risk factors if the company does not comply. Be assured that neither skills development, nor employment equity ompliance depend only on reporting and neither of these strategies can be dealt with a month or two before the submission deadlines. The supporting documentation to your skills and equity reports are numerous and require quite some attention, training and proof of consultation. The department of labour has intensified its random audits to a level where they currently manage to inspect about 20% of designated employers annually. This means that your organisation has a 1 in 5 chance of being audited this year. If found non-compliant, the department can institue the following penalties: The greater of R1 500 000 or 2% of the employer's annual turnover - In case of no previous contravention The greater of R1 800 000 or 4% of the employer's annual turnover - In case of no previous contravention of the same provision only The greater of R2 100 000 or 6% of the employer's annual turnover - A previous contravention within the previous 12 months The greater of R2 400 000 or 8% of the employer's annual turnover - Three previous contraventions The greater of R2 700 000 or 10% of the employer's annual turnover - Four previous contraventions
