On the Bench… <ul><li>Mark plays five-a-side football every Monday at a local leisure centre. </li></ul><ul><li>One evening a bench had been left by the wall on one side of the hall. </li></ul><ul><li>Mark noticed that the bench had been left out, but did nothing about it. </li></ul><ul><li>Twenty minutes into the match, he ran straight into the bench. </li></ul><ul><li>He fell badly on his right arm. </li></ul><ul><li>Mark spent the rest of the evening in casualty. </li></ul><ul><li>He had a small cut above his eye, his shin was heavily bruised, and his right arm was broken.. </li></ul>

Counting the cost… <ul><li>Mark is self employed builder, and because of his injuries, he had to take a month off work-without pay. </li></ul><ul><li>He had two tickets for a music festival, costing £100 each. </li></ul><ul><li>With a broken arm, he was unable to drive and the tickets were unused. </li></ul><ul><li>Special damages </li></ul><ul><li>Loss of earnings: 4 weeks at: £450 </li></ul><ul><li>A week: £1,800.00 </li></ul><ul><li>Replacing glasses, damaged in the accident: £100.00 </li></ul><ul><li>Taxi fares, when unable to drive: £40.00 </li></ul><ul><li>Music Festival tickets, unused: £200.00 </li></ul><ul><li>General Damages </li></ul><ul><li>Pain and suffering from broken arm, a badly bruised shin, minor bruising to the head. </li></ul>

Solicitor… <ul><li>The local authority should have made sure there was enough room around </li></ul><ul><li>The sports hall, to play football, and make it safe. </li></ul><ul><li>The leisure centre staff should have the responsibility to make the sports hall Safe. </li></ul><ul><li>This responsibility was failed due to not putting the bench away safely. </li></ul><ul><li>This caused mark’s injuries so he should get the full losses paid and the inconveniences. </li></ul>
  5. 5. Local authority Lawyer… <ul><li>The local authority lawyer believes that mark is responsible for his accident as he saw the bench but did not make the choice to put it away. </li></ul><ul><li>They will not pay for the injuries that mark made because it is not their responsibility, as mark witness the bench before his accident, therefore it is his fault. </li></ul>
