National Calamity Act, 1982 <ul><li>Preamble of the National Calamity Act, 1982 </li></ul><ul><li>Where as it is expedient to make arrangement for the operation of relief work and the maintenance of people’s convenience with a view to protect the life and property of the people. </li></ul><ul><li>The Act was enacted on the advice and with the consent of the then parliament in 2039 BS (1982 AD). </li></ul>

Natural Disaster Relief work means: <ul><li>Any relief work to be carried out in the area affected or </li></ul><ul><li>Likely to be affected </li></ul><ul><li>In order to remove the grief and inconvenience caused to the people. </li></ul><ul><li>Rehabilitation of the disaster victims. </li></ul><ul><li>Protection of the life and property of the people. </li></ul><ul><li>Prevention measures and advance preparation. </li></ul>

Government Institution, Partners, Procedures <ul><li>The Ministry of Home Affairs (MoHA) is designated as the lead agency responsible for implementation of the Natural Calamity (Relief) Act, 1982. </li></ul><ul><li>Currently, Various agencies of Government of Nepal are assigned with different aspects of Disaster Risk Management. </li></ul><ul><li>Central Natural Disaster Rescue Committee is chaired by the Home Minister. This committee is accountable for preparing National Policies and ensuring its implementation. </li></ul>

Government Institution, Partners (Contd.) <ul><li>MoHA is also responsible for Rescue and Relief Works, Data Collection and Dissemination of Funds and resources. </li></ul><ul><li>Increasing involvement of the Academicians, researchers, UN agencies, INGOs, Local Bodies and civil societies in the Disaster Response. </li></ul>

  8. 8. <ul><li>Close down of the governmental or non governmental offices, educational institutions. </li></ul><ul><li>Prohibition of the activities in disaster area that may cause adverse effect on relief work. </li></ul><ul><li>Deputation of the employees of governmental or non governmental offices or of institutions. </li></ul><ul><li>Evacuation or cause to be evacuated the people from the affected area to the areas of safety. </li></ul>In order to carry out relief works the govt. may give orders to any one concerned to undertake any or all the following works:
  9. 9. <ul><li>Requisition of the movable and unmovable property of any individual or institution on temporary basis for a prescribed period, if such property is required to be used for the purpose of relief works. </li></ul><ul><li>Evacuation or cause to be evacuated the goods and commodities from the affected area to the areas of safety. </li></ul><ul><li>Requisition and use of the means of transportation owned by non governmental offices, association and individuals of the concerned District for fixed period of time. </li></ul>In order to carry out relief works (Contd.)
  10. 10. <ul><li>Requisition of the food grains, clothes, medicine, construction materials and other items belonging to non governmental offices, institutions and individuals of the concerned district and distribute it to the victims. </li></ul><ul><li>Try to save the real estates, factories, temples, shrines, and religious places including other significant objects and places. </li></ul><ul><li>Constitute and operate the aid groups. </li></ul>In order to carry out relief works (Contd.)

Three Year Interim Plan (Major Policy) <ul><li>3-Year Interim Plan (2007-2010) recognizes disasters as one of the major impediments of national development process , and tries to address DRM tasks by devoting one separate chapter on DRM (Chapter 26) </li></ul><ul><li>The Plan recognizes for DRM the need to foster collaboration and coordination among key players and institutions active in different sector of national economy </li></ul>
