The modern concept of patents dates to 1421, Florence, Italy, when the city-state granted the first recorded patent to Filippo Brunelleschi, for the design and use of a ship, the Badalone ("seagoing monster"). The Badalone was intended to ferry supplies up the Arno river to the city for the building of the Florentine cathedral dome, of which Brunelleschi was the designer. He demanded and was duly awarded legal protection for his invention, being given the right for three years to burn any competitor's ship that incorporated his design. Alas, the Badalone sank during delivery of a load of white marble intended for use in constructing the dome. http://www.patenthawk.com/#About_Patents

Editor's Notes

  1. Sybaris: (Greek colony near present-day Corigliano, Italy, if a confectioner or cook invented an unusual or outstanding dish, no-one else could prepare it for one year The modern concept of patents dates to 1421, Florence, Italy, when the city-state granted the first recorded patent to Filippo Brunelleschi, for the design and use of a ship, the Badalone ("seagoing monster"). The Badalone was intended to ferry supplies up the Arno river to the city for the building of the Florentine cathedral dome, which Brunelleschi was the designer of. Alas, the Badalone sank during delivery of a load of white marble intended for use in constructing the dome. In 1421, the government of Florence award the world's first patent to Filippo Brunelleschi for a means of bringing goods up the usually unnavigable river Arno to the city. He demanded and was duly awarded legal protection for his invention, being given the right for three years to burn any competitor's ship that incorporated his design. How brutal and primitive! Now, of course, we take a much more civilized approach to patent infringement: We sue, destroying not just the boat but the factory, the business, the distributors' business, and the future ability of all those who ever worked on the infringing object to earn a living ever again... In England in 1449, King Henry IV granted that country's first patent for stained glass manufacturing. In England during this time, a patent was a government-granted monopoly, so could be as much a right to manufacture or trade as well as the right to deny others to do so. Parte Veneziana: The world’s oldest patent law, the Parte Veneziana, dates back to the Renaissance and was enacted by the Venetian Senate on March 19,1474. The Venetian Senate passed this first patent law in 1474, granting limited duration monopoly for original devices. This law embodied the principles of patent protection as we know them today. The Vienna exhibition was held in the midst of a cholera epidemic which understandably somewhat reduced the willingness of potential participants to attend. However, despite this drawback and prompted by the concerns about piracy, a congress was organised alongside the Exhibition to discuss the issue of patents and moves to harmonise them. Paris Convention for the Protection of Industrial Property The Paris Convention for the Protection of Industrial Property , signed in Paris , France , on March 20 , 1883 After a diplomatic conference in Paris in 1880 , the Convention was signed in 1883 by 11 countries: Belgium , Brazil , France , Guatemala , Italy , the Netherlands , Portugal , Salvador , Serbia , Spain and Switzerland . 1963: Strasbourg - The basis for the harmonisation of European Patent Law was established through the 1963 Strasbourg Convention on the Unification of Certain Points of Substantive Law on Patents for Invention. The Treaty makes it possible to seek patent protection for an invention simultaneously in each of a large number of countries by filing an "international" patent application. The Convention on the Grant of European Patents of 5 October 1973 , commonly known as the European Patent Convention (EPC), is a multilateral treaty instituting the European Patent Organisation and providing an autonomous legal system according to which European patents are granted.
  2. Replication of R&D results costs a total of 20-60 billion ( thousand million) in Europe every year! Figures are estimates of the European patent office and other institutions. Lesson learned: -> Review the literature AT THE BEGINNING of any project!
  3. Re-Inventing the wheel Problem of excessive wear (or even explosion) of aircraft wheels due to the high acceleration when touching the ground. small pockets on the side of the tires that make the wheel spin in the wind without the need for an additional electrical motor. Already applied for patent in 1929!!! Note: Special thanks to patent examiner Domenico Golzio for contributing this example.

  7. Thank you helen. And now I am going to tell you some things to remeber, things to watch out for when you are searching for patents.
  8. the numbers of patent documents are not harmonised wordwide but they do have some things in common. All the patent document numbers consist of a country code, a series of numbers and a kind code.
  9. IBM as policy has only one name, whereas Philips has so many variations that they even have an internal database.
  10. Theodor Hänsch was the nobel prize winner, and if you look for him you find his name in many different ways. How would you expect to find it if you were looking for it? Please use the T mark up at the top of your screen to write on the screen your suggestions. Or you can also use the chat. You even find it without the diacritics and eventhough it is wrong, it appears like this in some databases.
  11. AEG has always been called AEG but they file or they used to file applications using the name LICENT or LICENTA ... as you can see in the example. This is done in order to hide key applications! Aventis used to be called Hoechst and before they were actually called AVENTIS they were already filing as AVENTIS: In 1999 it became Aventis and it lasted until 2004 when they became SANOFI EVENTIS.
  12. MRI = Magnetic Resonance Imaging SCUBA = Self-Contained Underwater Breathing Apparatus LASER Light. Amplification by the. Stimulated. Emission of. Radiation. What is now an acronym was not always an acronym and this has to be taken into account and one might have to search for what the acronym letters stand for!!!
