2. I. For a conviction:
the prosecution (DA) must establish beyond
a reasonable doubt that the defendant
committed the crime with intent
3. II. Defendant may present evidence to prove
that:
A. No crime was committed
A. Alibi- Evidence that the defendant was
somewhere else at the time of the crime
- DNA Evidence- Biological evidence that
can be used to support an alibi
4. B. No criminal intent was involved
1. Act was excusable or justifiable:
Ex. Self-defense, defense of property,
defense of others
5. C. Act that was committed by defendant
was not criminally responsible
1. Infancy- Children under the specified
age of the state are not criminally
responsible
7. 3. Insanity- People that have a mental
disease or disorder that do not know the
difference between right and wrong
2 possible outcomes:
a. Not guilty by insanity
b. Guilty but mentally ill
8. 4. Entrapment- When a person committing
a criminal act was persuaded by a law
enforcement officer
9. 5. Duress- When a person commits a crime
as a result of a threat of immediate danger
10. 6. Necessity- When a person is compelled
to react to a situation in order to protect life
