for over 20 years, which the
U.S. now supports. EMV
eliminates duplicate card
fraud, which comes from
fraudsters copying the
magnetic stripe data and
reusing it. There have been
dramatic results in decreased
card-present fraud when
other countries have
implemented it.
Exception
to the Rule
Liability remains
with the card issuer
in the event of a
fallback transaction.
This occurs when
a transaction is
initiated between
a chip card and a
chip terminal but
chip technology
is not used due to
card reader error,
damaged EMV chip,
etc. and the transaction
is ultimately completed
via magnetic stripe.

fraud:
October 1, 2015 marked a major milestone in the U.S. payments landscape. As of that date, liability for
card-present counterfeit credit and debit card transactions shifted from issuers to merchants, unless those
merchants have migrated to contact and contactless EMV-enabled POS technology.
