PRESUMED INNOCENT, BUT EFFECTIVELY HELD CAPTIVE, VIRGINIA MAN’S LIFE IS A
SHAMBLES
Franklin, Virginia, April 30, 2010: After allegedly striking a drunken man with his vehicle, Jason Yanna
has been subjected to a travesty of the legal system which has ruined his life.
While on a business trip in southeastern Massachusetts, Mr. Yanna allegedly hit a drunken man who ran
into the road. According to reports, the man had been arguing with his wife prior to suddenly running
out in front of Mr. Yanna's vehicle. Even though he was traveling approximately ten miles an hour
under the speed limit, Mr. Yanna was unable to avoid the drunken man.
On April 23rd, 2009, Mr. Yanna was charged with Negligent Operation of a Motor Vehicle. Summoned
to appear on June 4th, 2009, the case was dismissed without prejudice. However, on the same day, Mr.
Yanna was issued a new citation for the same charge.
Prior to June 12th, 2009, Mr. Yanna was able to continue to work, but not allowed to drive a company
vehicle. On July 8th, 2009, Mr. Yanna was placed on unpaid leave by his employer.
Despite the fact that all charges were dropped by the police department, the District Attorney is still
pushing the case. The District Attorney's office has called numerous pre-trial hearings. These hearings
have only lead to still more hearings, leaving Mr. Yanna in legal limbo and without a paycheck. Adding
insult to injury, Mr. Yanna must travel from Virginia to Massachusetts for each hearing.
After more than a year of this legal “ping-pong” the issue is still being dragged through the court
system. With no previous criminal record, and out of work, Mr. Yanna has had to sell everything of
value in order to survive. Mr. Yanna now stands to lose his house.
Recently, Mr. Yanna's right to a speedy trial was yet again delayed with a tentative continuance date of
July 17th, 2010.
Innocent until proven guilty, but outrageously “imprisoned” by an ineffectual court system, Mr. Yanna
seeks to warn the public that this could just as easily happen to them!
