L’affermarsi del pluralismo religioso pone quotidianamente le istituzioni dinanzi a
casi che riguardano la concretezza della vita personale e familiare dei cittadini, italiani,
comunitari e non, che si evidenziano per la loro novità e per la comune caratteristica di
avere origine da una appartenenza religiosa. Anche di fronte a situazioni che fanno parte
della dimensione ordinaria della vita umana, come l’alimentazione o (per quanto tragica) la
sepoltura, o ad altre che invece attengono a circostanze straordinarie (come la restrizione
in un carcere), ci si può trovare dinanzi all’esigenza di assicurare l’esercizio del diritto di
libertà religiosa.
Non sempre si è preparati. E’ noto, la dimensione spirituale tocca corde profonde
dell’identità personale e, per tanti, anche comunitaria e la rivendicazione di spazi e diritti,
operata da “altri” a volte muove una reattività, tanto paradossale quanto in profondo
contrasto con le premesse stesse delle reazioni. Le istituzioni più vicine ai cittadini, i municipi
innanzitutto, sono chiamati a svolgere il ruolo fondamentale di veicolo di conoscenza, di
normalizzazione delle situazioni, di integrazione delle diverse anime della cittadinanza che
vive nel proprio territorio. Un ruolo quindi che deve necessariamente essere illuminato e
che trova il suo punto di luce nei principi e nelle garanzie costituzionali, cornice e condizione
per una convivenza pacifica e rispettosa delle esigenze più profonde dei singoli e delle
comunità familiari e sociali in cui vivono.
Si ritiene utile, pertanto, proporre un piccolo compendio degli aspetti della libertà
religiosa oggetto di disciplina normativa, per esporne in modo sintetico ma speriamo
esaustivo i contenuti. Uno strumento di lavoro, quindi, che possa servire da primo
orientamento a quanti, a partire dai soggetti istituzionali chiamati a garantire l’applicazione
della normativa, si trovano a dover rispondere ad una esigenza magari inedita per la comunità
rappresentata. I destinatari possono poi essere le stesse comunità religiose, specie se di
nuova origine: in tal caso ci auguriamo che il volume possa essere veicolo di trasmissione
della nostra cultura, che esprime nel diritto, seppur in maniera sempre imperfetta, i valori
di libertà e uguaglianza universale, che non di rado sono propri delle stesse religioni.
