• Consent:
• Concise, transparent, intelligible, accessible form.
• Clear and intelligible language.
• Indirectly obtained data- now must inform subject as well unless
impossible/disproportionate.
Data Protection Officers
• Required for:
public authorities;
core activities include regular and systemic monitoring, or, large
scale processing of special categories – will recruitment
businesses need one?
• To be independent of business.
• Consider nominating person if no DPO
Data Subject Access Requests
•30 days to respond
•No charge (except
copies/unreasonable)

Enforcement:
2 levels:
1. Greater of 2% worldwide turnover or 10,000,000 Euros for:
Record keeping, data processor contracts, data security, notification
failure, DPOs, Design and default.
2. Greater of 4% worldwide turnover or 20,000,000 Euros for:
Breaches of principles, consent requirements, subject rights, international
transfers.
Note: Joint and severally liable with other controllers and/or processors.
How do I prepare?
GDPR Preparation chart – who is leading?

Audit/Gap Analysis – what data have you currently got – where did it
come from?
Accountability (Record keeping) - audit trail demonstrating decision
making
Document Review – privacy notices, obtaining consent, suppliers,

  • 19. Consent not necessary the silver bullet… • Business Necessity • Legal Requirement • Consent: • Concise, transparent, intelligible, accessible form. • Clear and intelligible language. • Indirectly obtained data- now must inform subject as well unless impossible/disproportionate.
  • 20. Data Protection Officers • Required for: public authorities; core activities include regular and systemic monitoring, or, large scale processing of special categories – will recruitment businesses need one? • To be independent of business. • Consider nominating person if no DPO

  • 22. Enforcement: 2 levels: 1. Greater of 2% worldwide turnover or 10,000,000 Euros for: Record keeping, data processor contracts, data security, notification failure, DPOs, Design and default. 2. Greater of 4% worldwide turnover or 20,000,000 Euros for: Breaches of principles, consent requirements, subject rights, international transfers. Note: Joint and severally liable with other controllers and/or processors.

Training/Awareness – the first thing the ICO will ask if a breach Audit/Gap Analysis – what data have you currently got – where did it come from? Accountability (Record keeping) - audit trail demonstrating decision making Document Review – privacy notices, obtaining consent, suppliers, employees Response Processes – how will you handle a breach or deal with a SAR?
