eIDAS
(Regulation (EU) No 910/2014)
Main rule:
An electronic signature shall not be denied legal effect and admissibility as
evidence in legal proceedings solely on the grounds that it is in an electronic
form or that it does not meet the requirements for qualified electronic
signatures.
Contract law
(local acts)
Main rule:
A contract of sale need not be concluded in or evidenced by writing and is not
subject to any other requirement as to form. It may be proved by any means,
including witnesses*

Basic electronic signatures may be used – unless explicit exceptions are provided
for under applicable law.
Exceptions:
• Electronic signatures may not be used at all (e.g. purchase of real estate)
• Written form requirement in law requires AdES or QES
• Local KYC-regulations that refer to use of AdES or QES
