CHAPTER ONE: INTRODUCTION
1.1 Introduction
Research states that half of marriages in the United States will end in divorce, and about half of American children will experience the divorce of their parents before the age of 18 (Amato, 2000; Copen et al., 2012). According to the US Census Bureau, The rate of divorce in America is computed as the number of divorces relative to 1,000 married ladies, during the late 1980s and early 1990s; the rate of divorce reached a historic high of 22.6 divorces (United States Census Bureau, 2013). Research has focused on the reasons that's “why” and methodology that is “how” divorce affects children’s adjustment, given a large number of children that are affected by divorce. Research regularly shows a negative correlation between parental divorce and children wellbeing.
For example, children coming from divorced families tend to deal more harshly with life’s circumstances, by experiencing depression and get stuck forming close relationships with others. Children also tend to have antisocial behaviors. In addition to these measures, establishing and developing a close intimate relationship is an important indicator of how children adjust to their parents’ divorce. Research has found parental divorce to have a significant adverse effect on children’s relationship, such as intimacy and establishing trust and close relationship with others (Daly, 2003). Among children of divorce, few studies have examined boys and girls emotional perspective about divorce. There is less research on the long-term effect of parental divorce and coping strategies about how children focused on divorce.
The rates of divorce rose a dramatic 79 percent in Divorce on Children the United States between 1970 and 1977. Although these escalated rates have since declined, many marriages still end up in divorce. According to the US Census Bureau (2013), in the 1970s, children were considered better off living with one parent than living with both parents during and amidst conflict, abuse, or both. The performer Miley Cyrus described why she broke up with her fiancé, Liam Hemsworth, at the age of 21, this way: I was so scared of ever being alone, and I think, conquering that fear, this year, was actually bigger than any other transition that I had, this entire year . . .I don’t ever want to have to need someone again, where you feel like, without them, you can’t be yourself. (Effron 2013) Are individualism and marriage the oil and water of modern relationships, unable ever to fully mix together? If people pursue marriage primarily to make themselves happy and then judge the relationship on the basis of their own happiness, then marriage will be unstable, always facing the risk that one partner or the other will feel unfulfilled and turn away. In fact, that may be why divorce has become a prominent feature of the relationship landscape. Maybe that’s not a bad thing. If it means that the relationships that do survive are built on genuine mutual happiness or satisfaction, then the modern family order may be an improvement over the past. But if the experience of divorce, or the threat of divorce, looms large in modern families, then we all live under a cloud of family uncertainty. Individual freedom is a cherished value for most people. But uncertainty comes with risks, especially for children, who are the most vulnerable to the stress of family transitions (Cherlin 2010). This is the central dilemma of divorce that we confront. For the Children’s Sake Of course, there is nothing wrong with loving oneself if that means recognizing and respecting one’s own needs and desires. But how is individual happiness to be balanced against family commitments, including marriage? This is as much a moral question as a practical or psychological one. "Lifting the Corporate Veil" is a legal concept that refers to the judicial act of disregarding the separate legal personality of a corporation or limited liability company (LLC). Normally, a corporation is considered a legal entity separate from its shareholders or members, meaning that the personal assets of shareholders or members are protected from the liabilities of the corporation. However, there are certain situations where courts may decide to "pierce" or "lift" the corporate veil, holding shareholders or members personally liable for the debts or actions of the corporation.
Here are some common scenarios in which courts might lift the corporate veil:
Fraud or Illegality: If shareholders or members use the corporate structure to perpetrate fraud, evade legal obligations, or engage in illegal activities, courts may disregard the corporate entity and hold those individuals personally liable.
Undercapitalization: If a corporation is formed with insufficient capital to conduct its intended business and meet its foreseeable liabilities, and this lack of capitalization results in harm to creditors or other parties, courts may lift the corporate veil to hold shareholders or members liable.
Failure to Observe Corporate Formalities: Corporations and LLCs are required to observe certain formalities, such as holding regular meetings, maintaining separate financial records, and avoiding commingling of personal and corporate assets. If these formalities are not observed and the corporate structure is used as a mere façade, courts may disregard the corporate entity.
Alter Ego: If there is such a unity of interest and ownership between the corporation and its shareholders or members that the separate personalities of the corporation and the individuals no longer exist, courts may treat the corporation as the alter ego of its owners and hold them personally liable.
Group Enterprises: In some cases, where multiple corporations are closely related or form part of a single economic unit, courts may pierce the corporate veil to achieve equity, particularly if one corporation's actions harm creditors or other stakeholders and the corporate structure is being used to shield culpable parties from liability.

- 2. According to data from the Bowling Green State University (BGSU), the rate of “gray divorce” (splitting up at the age of 50 and older) has more than doubled since 1990. That year, the divorce rate for those aged 45 to 54 was at 13.1 percent, 55 to 64 was at 5.1 percent, and 65 and older was at 1.8 percent. These rates went up to 18.0 percent, 12.0 percent, and 5.09 percent, respectively, in 2017. Challenges and Opportunities BGSU professor, Susan Brown, says a gray divorce can affect the finances of former couples. The wealth of people getting divorced after age 50 tends to drop by about 50 percent. Experts do not find this surprising since divorce involves dividing a family’s resources. Although financial challenges exist, opportunities may also be explored. For example, couples who were married for at least 10 years and did not remarry before turning 60 may claim Social Security spousal benefits from their ex-spouse’s work record. Some divorcing couples may also dip into their 401(k) without getting a tax penalty before turning 59.
- 3. Despite the effects of gray divorce on finances, former spouses may still live comfortably with the right division of assets. Divorce attorneys help older adults throughout the entire process of divorce to make sure both parties get a fair share of their resources. Division of Assets In New York, the court distributes marital property fairly and equitably since it is an equitable state. The court will interfere with the process when the couples cannot agree on property division and debt, and when they do not have a prenuptial agreement. Divorcing couples also get spousal support, depending on the case. The court decides whether to award support after reviewing certain factors, including: • The length of the marriage • The ability of each spouse to be self-supporting • The status of the case and the parties involved A Reuters report explains divorce gets more complicated financially the older couples get and the longer marriage they have. Couples aged 50 and older should make their divorce collaborative make the process easier.
