This study examined the practice and predictors of self-medication among adults in both urban and rural areas of Sri Lanka three decades after market economic reforms. The study found that self-medication was more prevalent in urban areas (12.2%) compared to rural areas (7.9%). Conditions of acute onset and short duration were common reasons for self-medication. Predictors of self-medication differed between settings and included factors like household size, drug availability, symptom count, and satisfaction with medical services. The study concluded self-medication is a initial response for less severe diseases based on past experience and recommended its findings be used to shape policy and education programs.

3. - наявність майнової і моральної шкоди. Майнова шкода – це будь-яке зменшення наявного
майна (позитивна шкода) або неодержання доходів, що їх мав би одержати кредитор, якби
зобов’язання було виконане (упущена вигода). Моральна шкода може полягати у
приниженні честі, гідності, престижу або ділової репутації, моральних переживаннях у
зв’язку з ушкодженням здоров’я тощо;
- протиправна поведінка (дія чи бездіяльність) заподіювана шкоди;
- вина заподіювача шкоди. Вина – це психічне ставлення особи до своєї протиправної
поведінки. У цивільному праві існує презумпція вини боржника, тобто особа, яка не
виконала зобов’язання чи вчинила позадоговірну шкоду, вважається винною, поки не доведе
протилежного. Вина може бути у формі умислу чи необережності. За деякі дії, у
передбачених законом чи угодою випадках, може наступати відповідальність без вини. До
таких випадків належать: невиконання грошового зобов’язання; втрата, недостача чи
пошкодження майна зберігачем; заподіяння шкоди джерелом підвищеної небезпеки;
- причинний зв’язок між протиправною поведінкою і завданою шкодою.
Склад цивільного правопорушення є підставою для
притягнення до цивільно-правової відповідальності і включає:

5. Договірна відповідальність настає в разі порушення умов договору.
Позадоговірна відповідальність настає у випадку заподіяння шкоди майну чи здоров’ю, якщо між
заподіювачем шкоди і потерпілим не було цивільно-правового договору.
Якщо у цивільних правовідносинах є кілька зобов’язаних суб’єктів, наступає один з таких видів
відповідальності:
- часткова (дольова);
- солідарна;
- субсидіарна (додаткова).
Часткова (дольова) відповідальність передбачає, що кожна з зобов’язаних осіб несе
відповідальність тільки у своїй частці.
Солідарна відповідальність передбачає, що кредитор має право звернути стягнення як в частині,
так і в цілому на майно всіх боржників, частини їх або одного з них. Виконання солідарного
зобов’язання одним із декількох боржників звільняє решту від відповідальності. Солідарна
відповідальність настає лише у випадках, прямо передбачених законом або договором. Якщо одна з
цих осіб відшкодує потерпілому збитки, то вона має право зворотної вимоги (регрес) до кожного з
решти боржників у рівній частці.
Субсидіарна (додаткова) відповідальність передбачає наявність крім основного боржника ще й
додаткового. У разі неможливості відшкодування збитків основним боржником до відповідальності
притягається додатковий. Наприклад, неповнолітній у віці від 15 до 18 років сам несе
відповідальність за вчинену ним шкоду за наявності у нього власного майна. Якщо неповнолітній
не має такого майна, або майна недостатньо, відшкодовувати заподіяну ним шкоду зобов’язані його
батьки чи піклувальники, які несуть субсиді-арну відповідальність.

7. Мірою цивільно-правової відповідальності є також втрата завдатку однією стороною або
повернення його у подвійному розмірі другою стороною. Завдатком визнається грошова сума,
що видається однією з договірних сторін у рахунок належних з неї за договором платежів
другій стороні на підтвердження укладення договору і забезпечення його виконання. Якщо за
невиконання договору відповідальною є сторона, яка дала завдаток, то він залишається у
другої сторони. Коли ж відповідальною за невиконання договору є сторона, яка одержала
завдаток, вона повинна сплатити другій стороні подвійну суму завдатку.
І відшкодування збитків, і сплата неустойки, і втрата завдатку є додатковими (до основного)
обов'язками, бо основний обов'язок боржника полягає у передачі майна, виконанні роботи,
наданні послуг тощо і він виконується на еквівалентних та сплатних засадах. Сплачуючи ж
неустойку, втрачаючи завдаток або відшкодовуючи кредиторові заподіяні збитки, боржник не
отримує від нього жодної компенсації, отже на боржника покладаються всі невигідні майнові
наслідки порушення зобов'язання.

10. Моральна шкода полягає у:
- фізичному болю та стражданнях, яких фізична особа зазнала у зв'язку з каліцтвом або
іншим ушкодженням здоров'я;
- душевних стражданнях, яких фізична особа зазнала у зв'язку з протиправною
поведінкою щодо неї самої, членів її сім'ї і близьких родичів;
- душевних стражданнях, яких фізична особа зазнала у зв'язку зі знищенням чи
пошкодженням її майна;
- приниженні честі, гідності, а також ділової репутації фізичної або юридичної особи.
Принципи компенсації моральної шкоди:
наявність вини в діях (бездіяльності)
медичного працівника (за винятком
заподіяння шкоди життю і здоров'ю
джерелом підвищеної небезпеки);
реальна наявність порушення або
посягання на особисті немайнові права
(блага) пацієнтів;
пацієнт має сам пред'являти докази
наявності фізичних і (або) моральних
страждань;
пацієнт вільно обирає розмір компенсації
моральної шкоди, однак остаточне рішення
ухвалює суд;
моральна шкода компенсується незалежно
від відшкодування майнової шкоди.
11. Ефективність цивільно-правової
відповідальності залежить передусім
від її застосування, реалізації до
конкретних осіб, винних у скоєнні
цивільного правопорушення. Проте,
керуючись принципом
диспозитивності, властивим як
цивільному праву в цілому, так і
окремим його інститутам, зокрема
інституту відповідальності,
потерпіла сторона сама вирішує,
застосовувати чи не застосовувати
міри відповідальності до
правопорушника. Іншими словами,
застосування майнових або
немайнових санкцій, у тому числі
відповідальності, за чинним
законодавством є правом, а не
обов'язком суб'єктів цивільних
правовідносин. Це стосується і
юридичних осіб, які самостійно
вирішують питання щодо здійснення
належних їм прав.
12. Отже цивільно-правова відповідальність — це покладення на
правопорушника основаних на законі невигідних правових наслідків,
які виявляються у позбавленні його певних прав або в заміні
невиконаного обов'язку новим, або у приєднанні до невиконаного
обов'язку нового додаткового. Юридичною підставою такої
відповідальності є закон, а фактичною — склад цивільного
правопорушення
Однією з необхідних умов цивільно-правової відповідальності є наявність
безпосереднього причинного зв'язку між протиправною поведінкою
правопорушника і збитками потерпілої сторони. Протиправна дія або
бездіяльність заподіювача є причиною, а збитки, що виникли у потерпілої
особи, — наслідком протиправної поведінки заподіювача.
