This document summarizes various court cases from the 1860s dealing with contracts that stipulated payment in gold coin or specie during a time when paper currency not backed by gold was the prevailing legal tender. The majority of cases found that specifying payment in gold did not preclude payment in the legal paper currency, as long as the nominal dollar amount was paid. However, some cases such as those involving payment of gold as rent ruled that the contract required payment of the specified quantity of gold.
