TRAINING WORKSHOP ON: FLEGT-VPA AND ITS POTENETIAL IMPACT ON
BUSINESS STRATEGIES

IMPLEMENTATION PROCESS IN VIETNAM”

I. Introduction
The project “Promoting the private sector engagement with the Voluntarily Partnership
Agreement (VPA) implementation in Vietnam” is funded by FAO-UN. The project is designed
to enhance the understanding of and compliance to legal frameworks, to promote legal
production and the best management practices throughout the timber product value chain
in Vietnam, and to strengthen public-private dialogues to advance the VPA process in
Vietnam. There are two specific objectives: to increase business access to information on
legality requirements according to Vietnamese laws and regulation on Timber Legality (TL);
to strengthening public – private dialogues in advancing VPA process. The objectives will be
achieved through following activities:
One day launching and participatory planning workshop: 30 participants (including
association members from Da Nang, Binh Dinh, Binh Duong);
Training materials revised for businesses and agenda for one-day business trainings;
Network of trainers established and maintained (for support businesses, sharing
experience, online networking);
Five one-day training courses for at least 150 business representatives;
One regional public – private forum with 50 participants;
One national public private forum with 70 participants;
A comprehensive communication plan.
The training workshop “FLEGT-VPA and its potential impact on business strategies” was held
by the Center for Education and Development (CED) and Binh Duong timber Processing
Association (BIFA) on 28 November 2016 in Binh Duong province as one of the project
activities. The objective of the training workshop was to build a capacity for businesses to
adapt with VPA requirements. The training workshop focused on: introduction to major
elements of VPA, key principles and criteria of the Legality Definition (LD) and guidance for
the businesses to comply with these requirements; assessment of readiness of participating
businesses in Binh Duong and nearby provinces to VPA; providing updates and Q&A on
customs regulations for timber processing businesses, introduction of environmental funds
for timber processing companies to improve its environmental management systems.
II. Training workshop contents and process
The one day training workshop were held with participation from 80 representatives from
BIFA members, Binh Duong Department of Industry and Commerce, Binh duong department

of Natural Resources and Environment (DONRE), Provincial Department of Forest
Protection, Binh Duong Department of Customs and selected media. The workshop was very
informational and provided updates for businesses. The businesses had the chance to
interact and have dialogue with local government agencies and the opportunity to assess
their readiness for VPA and its requirements (Please see attached training workshop agenda
for more information).
The training workshop applied practical methodologies, focused on discussion, exchanges
and sharing among businesses and facilitating learning among participants through group
work and discussions. The workshop also encouraged dialogue between businesses and the
local public.
Participants were staff from import and export departments or other relevant
positions in their companies, we also encourage participation from businesses
leaders;
Participants from each business will have to prepare information about their
companies to share with the others and to use in group work and discussions.
Session 1: Workshop - FLEGT-VPA and its potential impact to business strategies.
After the opening remarks from BIFA and Binh Duong Department of Commerce and
Industry, participants were introduced to the VPA and its major commitments, including:
1. List of products and items included in VPA
2. Timber legality definition (LD)
3. Supply Chain control
4. Timber Legality Assurance System (TLAS)
5. FLEGT licensing process
6. Independent monitoring
The workshop also provided an update on negotiation results, requirement and
commitments in the VPA (verify timber originality, import timber control, organization
classification systems, FLEGT licensing, and independent monitoring). The road map for VAP
implementation from negotiation concluded in November.

After that, a trained trainer from NEPCON project presented major elements of VN-TLAS
(see the figure below) and mentioned about the organization classification systems (using
updated information from VNFOREST as of November 2016).

Legality definition (LD)
The workshop also presented the most updated LD (as of November 2016), listing all
Vietnamese laws and regulations related to LD. LD is organized as two parts: LD for
households and LD for organizations given the difference in size, organization and
operations of these two groups. The separation of LD from households and organizations
will make it easier for future compliance and VNTLAS as well. The difference between LD
and organizations and households is described in the introduction of the annex II of the VPA.

The organization Classification System (OCS) and verification are based on risk assessment,
including: criteria and types of risks, as follows:
Compliance with all dynamic evidence to ensure that the timber is legally sourced
Commitment to implement all steps in supply chain controls and fully meeting
reports requirements.

After presentations and updates on VPA and elements of TLAS, participants were provided
updates about new laws and regulations on imports and exports from Binh Duong
department of Customs (including: Laws on import and export taxes numbered
107/2016/QH13; Decrees numbered 134/2016/NĐ-CP; and other relevant guidance and
legal documents from General Department of Customs of Vietnam). Representatives from
the Department of Customs presented throughout the workshop and training and they were
willing to provide clarification and answer any questions from participants.
In addition, businesses were provided information on the environment fund of Binh Duong
province. This is the provincial fund that was established by the decision numbered
2719/QĐ-UBND dated 07 July 2009. After seven years of implementation, The Fund has
provided financial support for 55 projects to invest in their environment protection system
valued 172 billion VND. The operational capital is 125 billion VND. The timber processing
companies located in Binh Duong can access this fund to implement projects to meet
requirements about the environment protection. Following projects will be considered for
support.
• The projects on the treatment of waste water, reduced emissions, and solid wastes.
• Projects to produce environmentally friendly products.
• The project to implement change to environmentally friendly technologies, reducing
pollutions.
• Projects to produce products using recycled materials.
• Projects to support vehicles and equipments for trash collection, transportation and
treatment of daily solid waste.
• Projects to invest in infrastructure to collect waste water rain water.
After more than seven years in operation, the fund has provided financial support for 55
projects to invest in company’s environmental protection systems with the amount of 172
billion VND. The operational capital of the fund is currently 125 billion VND. At the moment,
the environmental protection fund has provided soft loans to companies to invest in
projects to protect environment.

The training session started with readiness assessment of companies with VPA. After this
assessment, it can be said that most of participating companies are able to comply with
newrequirements from VPA (see the assessment checklist for more information).
Companies answered 13 questions designed to check their compliance possibility with
FLEGT-VPA (Please see annex 1). The form is available online and companies can use it check
if they are compliant with VAP requirements as the first step: http://flegtvpa.com/doanh-
nghiep-ban-san-sang-voi-flegt-chua.html.
Assessment checklist results will be calculated according to the following results:
10 - 13 answers: Yes, you are on the right track!
6-9 answers: Yes, you have a lot of work to do to ensure your business is ready to adapt to
FLEGT-VPA!
0-5 answers: Yes, you should plan to adapt to FLEGT-VPA immediately!
With 46 assessments from participants, most of the companies are able to adapt with VPA.
Specific responses are listed below:
With the question, is your business is legally registered and licensed according to relevant
laws and regulations;
All participants said their companies fulfill all obligatory taxes and fees required by laws and
regulations and relevant environmental requirements.
There were 42 participants that said their companies are compliantwith all occupational
health and safety requirements (only 4 participants were unsure and/or assessed their
companies are not compliant).
44 participants said their companies are compliant with all labor laws and regulations, only 2
participants said unsure and no one said no.
44 participants said their companies are compliant with transport, trade, import or export
regulations, procedures and restrictions, only 2 participants were unsure.
42 participantshave said their businesses have maintained their filing of trade transactions
throughout the supply chain and known their supply chain, 4 participants were unsure.
42 participants said that they know their businesses use legal timber, 4 participants said
they were unsure.

26 participants said that they have had access to information about your forest product
supply chains to a level that allows you to confirm and document that the material/products
originate from forest sources with low risk of legal violations or that potential risks have
already been mitigated. There, 16 participants were unsure and 4 participants said they do
not have.
34 participants said their businesses have avoided high risk sources, including wood from
countries with sanctions imposed by the UN Security Council or the EU Council on timber
imports or exports and wood from countries or areas with prevalence of armed conflicts. 10
participants were unsure and 2 participants said no.
36 participants said their businesses have a necessary and/or appropriate system of
segregation or a chain of custody system (CoC). Eight participants were unsure and 2
participants said no.
40 participants said that their businesses have a comprehensive record keeping system in
place. Six participants were unsure.
42 participants said their businesses have maintained the records for at least 5 years. Four
participants were unsure. (See figure 9: VPA readiness among participated companies).

According to the assessment, there were only 4 out of 46 participants who were unsure or
do not have information on their systems and evidences to prove that their timbers are
from legal sources. They may face difficulties if they have not changed or upgraded their
governance and management systems.

In this session, there are presentations from company best practices on how to buy and use
timber from legal sources (videos and presentations). There are discussions and Q&A
sessions from participants and speakers and representatives from local government offices.
Group work and discussions
In this session the participants are dived into five groups to partake in exercises on how the
companies can adapt to the current LD structures and criteria. There are five groups as
follows:
Group 1: Companies focuses on imported timber,
Group 2: Companies are using mainly timber from domestic sources,
Group 3: Companies focus on transportation and exploitation,
Group 4: companies focus on processing and manufacturing indoor furniture and
Group 5: companies focus on exporting.
Each group will nominate one company as a case study for group work and discussion using
actual information and current practices they are using. After the introduction about the
supply chain,each group will be asked to develop their own supply chain for the companies
selected. Upon completion of the supply chain, group participants will review their
operations and practices against principles and criteria in the LD. Five groups will present
their groups discussions around principles and criteria that the selected companies have to
follow:

IV. Results of the workshops and training (based on participants’ assessment)

General assessment of the training workshop
The training workshops have been attended by 80 participants from Binh Duong and nearby
provinces, of which there were 57 representatives from timber processing businesses in
Binh Duong and 23 representatives from related organizations and agencies in Binh Duong
and nearby provinces. By the end of the training workshop there were only 46 participants
from businesses that filled out assessment forms. In general, the participants were satisfied
with the methodologies and losigtics arrangements of the training. Specially, the
methodologies and logiostics have been rated 4.1 out of 5 as highest. The trainers, speakers
and training materials have rated 3.9 out of 5. See figure 10.

Regarding the training time, most participants said one-day training is adequate (78%). 43%
of participants have said that the training workshop’ objectives and results have achieved at
the excellent level, 48% assessed at the good level and 9% assessed at the average level. The
following contents and information were highlights appreciated by participants: provided
updates on VPA requirements, major commitments and implementation roadmap, and
exercise and group discussion helped participants learn a lot for their businesses, legality
definition and application to their businesses, Q&A about customs regulations and decree
ND134/20/2016NĐ-CP about import and export fees and Q&A about VN-TLAS.
To the question whether they can apply what they have learned to their businesses, six
participants did not provide an answer, 40 participants said they can apply what they have

learned to their businesses. Specifically, six participants indicated they can use updated
information about FLEGT-VAP, VNTLAS to update and prepare their companies, two
indicated that they would apply the knowledge to their control system to ensure legal
timber is used, four indicated that they can use LD as a system to assess their compliance
with seven LD principles and criterion, 20 participants said they can use updated
information about the decree 134 on import and export taxes, and eight participants said all
knowledge and skills can be applied to their businesses.
Assessment of relevance of the training contents to business needs:
Participants reported that their knowledge increased/updated through the different training
sessions: information updates, training exercises on VPA compliance; Q&A about customs,
forest protection, and environment. Participants rated highest scores for group work and
exercises among businesses 3.9 out of 5, information updates on customs, forest protection
and environment are 3.8 out of 5 and all presentations are rated 3.7 out of 5. See figure 11

To the question: “what can be improved in the training course”, there were only five
participants who gave the following feedback (among 46 assessment questionnaires): need
to provide more information on the timing to provide FLEGT licenses, there should be
clearer and more information for participants with examples and practices for businesses to
refer to and there should be case studies and practical examples so that businesses will be

more interested. Materials should be sent to participants before the training and workshops
so they can be better prepared for discussions and groups work.
VPA Readiness assessment:
After the workshop about 50% of participants said that their skills and knowledge are
improved after the training, 30% said their knowledge and skills are much improved after
the training, and 30% have assessed that their knowledge and skills have been improved but
still need time for further improvement. See figure 12

To the question, what additional support is needed for businesses to comply with FLEGT-
VPA requirements, 40% participants said they need technical support and guidance from
experts to meet requirements of VNTLAS, 30% participants said they need additional
training and information on FLEGT-VPA details (annexes) and need support from local
agencies and authorities to provide advice and answers as needed (forest protection
agencies, customs, businesses associations). In sum they need some agencies to provide
advice, support and log complaints when needed and possibly to organize forum with
businesses. See figure 13.

To the question: whether businesses are interested in contents such as LD for households
and organizations and how to set up and verify evidence and proof for legal timber for each
step in the supply chain, internal section and monitoring, verification of timber legality
compliance of households and organizations, including organization classification system
(OCS) risk-based assessment classification, FLEGT licensing, and independent monitoring, it
can be said that most of participants are interested in the a.m content and issues (88% said
they are necessary), there are about 12% said that they are not necessary.
100% of participants are interested in LD information and criteria, 90% of participants are
interested in information related to FLEGT licensing, verification of business compliance of
household and organizations, OCS based on risk assessment and how they can create, verify
and approve evidence in each step of the supply chain. About 80% of participants are
interested in internal inspection and monitoring and about 70% of participants are
interested in independent monitoring. See figure 14.

To the question, which information channel their companies would like to receive
information and updates on VPA from, 45% want to receive information through website,
about 28% want to receive information through e-newsletters, 13% through social network
and media, about 8% want to receive through publications and printed materials and 6%
want to receive through traditional media such as television, radio and newspapers. See
figure 15

V. Conclusions and recommendations
The training and workshop have been successfully implemented and meet their
requirements and expectation of the participants. The group of trainers, speakers and
resource persons are diverse and provide a lot of useful updated information for businesses,
provide new knowledge and skills, and there is also a lot of sharing among businesses
participants. Although, due to limited time some of the expectations from participants were
not met such as: more sharing among businesses, more time for presentations from
businesses and time for exercises, and detailed information on FLEGT licensin; all in all the
workshop met its objectives as designed and provided a lot of information for further
expansion of the programs and trainings for other businesses.

There are some recommendations from business participants to improve the training in the
coming months:
- Provided further information on the FLEGT licensing process and procedures and
time frame for getting a license;
- Provide practical examples of issues and problems that businesses face when appling
to FLEGT-VPA;
- Send materials for businesses before the trainings so they can prepare information
for discussions and will be more ready for group work.
- More collaboration on events from other business association such as HAWA and
Binh Dinh (FPA) to get more attention from businesses as well as receive better
representation from diverse groups of businesses to also save costs for the project.
- Through the quick survey from businesses, it is necessary to promote information
provision through web-social media and other means leveraging technologies such
as e-newsletters. Information for newsletters may focus on results and updates from
signing VPA, updated information on FLEGT licensing, independent monitoring, LD
for households and organizations.
