Commentary
The subject of ethics in mental health is interesting and can be examined in many ways. We can examine it from the requirements of a particular discipline (public health, social work, etc.), from a legal perspective, from the treatment aspect, from an economics point of view and so on.
As a first step to studying the ethical treatment of persons with mental illness, we suggest that you review Lesson 4 on Mental Health Policy and the Law. In that lesson, we saw how the treatment of persons with mental illness has become more humane, stemming from the Civil Rights movement and several important legal cases, including Schloendorff v. Society of New York Hospital (1914), Brown v. Board of Education (1954), Pate v. Robinson (1966), Ford v. Wainwright (1986) Addington v. Texas (1979), and Olmstead v. L.C. (1999). From these important legal cases stemmed protections such as the right to treatment, right to a competency trail, awareness of the risks and harms of treatment, required informed consent to receive treatment, the right to a humane treatment plan and the right to participate in individual treatment planning. These legal cases have served as the foundation of the ethical treatment of individuals with mental illness.
In this lesson we will explore ethical codes. In addition to the above mentioned legal cases, ethical codes have been developed in the psychology, social work and public health fields to preserve the rights of all persons who receive treatment, including those with physical and/or mental illness. We will examine various aspects of professional ethics, some discipline codes and the Health Insurance Portability and Accountability Act (HIPAA), one of the federal acts that further protect individual and privacy rights. The Family Education Rights and Privacy Act (FERPA) is another act that protects the privacy of students’ educational records and has some implication here.

Research with human subjects can occasionally result in a dilemma for investigators. When the
goals of the research are designed to make major contributions to a field, such as improving the

SUMMARY: On July 12, 1974, the National Research Act (Pub. L. 93-348) was signed into law, there-by creating the
National Commission for the Protection of Human Subjects of Biomedical and Behavioral Research. One of the
charges to the Commission was to identify the basic ethical principles that should underlie the conduct of biomedical
and behavioral research involving human subjects and to develop guidelines which should be followed to assure that
such research is conducted in accordance with those principles. In carrying out the above, the Commission was
directed to consider: (i) the boundaries between biomedical and behavioral research and the accepted and routine
practice of medicine, (ii) the role of assessment of risk-benefit criteria in the determination of the appropriateness of
research involving human subjects, (iii) appropriate guidelines for the selection of human subjects for participation in
such research and (iv) the nature and definition of informed consent in various research settings.
The Belmont Report attempts to summarize the basic ethical principles identified by the Commission in the course of
its deliberations. It is the outgrowth of an intensive four-day period of discussions that were held in February 1976 at
the Smithsonian Institution's Belmont Conference Center supplemented by the monthly deliberations of the
Commission that were held over a period of nearly four years. It is a statement of basic ethical principles and
guidelines that should assist in resolving the ethical problems that surround the conduct of research with human
subjects. By publishing the Report in the Federal Register, and providing reprints upon request, the Secretary intends
that it may be made readily available to scientists, members of Institutional Review Boards, and Federal employees.
The two-volume Appendix, containing the lengthy reports of experts and specialists who assisted the Commission in
fulfilling this part of its charge, is available as DHEW Publication No. (OS) 78-0013 and No. (OS) 78-0014, for sale by
the Superintendent of Documents, U.S. Government Printing Office, Washington, D.C. 20402.
Unlike most other reports of the Commission, the Belmont Report does not make specific recommendations for
administrative action by the Secretary of Health, Education, and Welfare. Rather, the Commission recommended that
the Belmont Report be adopted in its entirety, as a statement of the Department's policy. The Department requests
public comment on this recommendation.

Universality of Human Rights
Last week, you established that human rights are those to which all people are entitled. This idea may seem simple and straightforward; but the question remains as to how and when specific human rights are universally applied. The "Universal Declaration of Human Rights" (UDHR) identifies five core notions, or concepts of basic human rights. Universal rights tend to be flexible and evolve as the social and political landscape changes. For example, universal human rights guide contemporary human rights initiatives such as environmental rights and reproductive rights.
There are an abundance of human rights issues in the global community. Agreement on what constitutes universal human rights is an important step toward addressing social justice issues.

National Commission for the Protection of Human Subjects of Biomedical and Behavioral Research. One of the
charges to the Commission was to identify the basic ethical principles that should underlie the conduct of biomedical
and behavioral research involving human subjects and to develop guidelines which should be followed to assure that
such research is conducted in accordance with those principles. In carrying out the above, the Commission was
directed to consider: (i) the boundaries between biomedical and behavioral research and the accepted and routine
practice of medicine, (ii) the role of assessment of risk-benefit criteria in the determination of the appropriateness of
research involving human subjects, (iii) appropriate guidelines for the selection of human subjects for participation in
such research and (iv) the nature and definition of informed consent in various research settings.
The Belmont Report attempts to summarize the basic ethical principles identified by the Commission in the course of
its deliberations. It is the outgrowth of an intensive four-day period of discussions that were held in February 1976 at
the Smithsonian Institution's Belmont Conference Center supplemented by the monthly deliberations of the
Commission that were held over a period of nearly four years. It is a statement of basic ethical principles and
guidelines that should assist in resolving the ethical problems that surround the conduct of research with human
subjects. By publishing the Report in the Federal Register, and providing reprints upon request, the Secretary intends
that it may be made readily available to scientists, members of Institutional Review Boards, and Federal employees.
The two-volume Appendix, containing the lengthy reports of experts and specialists who assisted the Commission in
fulfilling this part of its charge, is available as DHEW Publication No. (OS) 78-0013 and No. (OS) 78-0014, for sale by
the Superintendent of Documents, U.S. Government Printing Office, Washington, D.C. 20402.
Unlike most other reports of the Commission, the Belmont Report does not make specific recommendations for
administrative action by the Secretary of Health, Education, and Welfare. Rather, the Commission recommended that
the Belmont Report be adopted in its entirety, as a statement of the Department's policy. The Department requests
public comment on this recommendation.

Alicia is a sixth grade student currently receiving resource support for math and written expression. She attends all other subjects within the general education classroom.
Her special education teacher, Ms. Kauffmann, reports that Alicia has average reading decoding skills and average to above average reading comprehension skills. She particularly does well analyzing multiple choice and short answer questions related to reading content. Alicia does have difficulty summarizing what she has read using her own thoughts and ideas and relies heavily on visual supports to aid in comprehension.
Alicia does write complete sentences but struggles in organizing her ideas for writing and needs extensive support for pre-writing, development of topic sentences, and organization of essays. In writing short answer questions, she does so with few grammatical errors. When writing paragraphs and short essays, Alicia needs help editing her own work and making corrections. Punctuation errors are frequently evident. Hospitals have been some of the earliest adopters of wireless local area
networks (WLANs). The clinician user population is typically mobile and
spread out across a number of buildings, with a need to enter and access
data in real time. St. Luke's Episcopal Health System in Houston, Texas
(www.stlukestexas.com) is a good example of a hospital that has made
effective use wireless technologies to streamline clinical work processes.
Their wireless network is distributed throughout several hospital buildings
and is used in many different applications. The majority of the St. Luke’s
staff uses wireless devices to access data in real-time, 24 hours a day.
Examples include the following:
• Diagnosing patients and charting their progress: Doctors and
nurses use wireless laptops and tablet PCs to track and chart patient
care data.
• Prescriptions: Medications are dispensed from a cart that is wheeled
from room to room. Clinician uses a wireless scanner to scan the

Colonel Pete Novak was assigned to com-
mand an air force squadron that airlifted sup-
plies to combat units during the Korean War.
The squadron had more than 200 men and
several cargo planes.When he assumed com-
mand, the situation was bleak. They were
short of supplies, personnel, and replace-
ments. Organization and coordination were
poor, and there was little cooperation and
teamwork among different sections. Morale
was low due to the unrelenting workload,the
constant bickering and disagreements, and
the stress of flying into combat zones.Colonel Novak held a meeting of the
squadron to introduce himself and talk about
how important their mission was to the success
of the war effort. He talked about how the
men in the front lines were counting on the
squadron to bring them the supplies and am-
munition they needed to keep the enemy

them that every man had a vital function in
the operation of the squadron.
Then Colonel Novak set out to learn more
about the men in his unit, beginning with the
officers. He held frequent staff meetings with
the section heads and some key noncommis-
sioned officers (NCOs) to discuss the meth-
ods used to carry out the mission of the
squadron.He visited the enlisted men at work
and off duty, talking to them and showing a
personal interest in them.He listened to their
complaints, and whenever possible tried to
deal with their concerns about the poor living
conditions at the base.He flew along with the
airplane crews on some of the supply mis-
sions. On one occasion when supplies were
desperately needed at the front lines and the
squadron was shorthanded,he pitched in and
worked beside the men all during the night to
load the planes.
It was not long before Colonel Novak had
learned each person’s name, what his job was,
and something about his background. As he
found out more about the capabilities of the
men, he reorganized the squadron to place people where the best use could be made of
their skills and experience. In staff meetings,
disagreements were discussed and worked
out, and responsibilities were assigned when
all concerned were present. Authority was
clearly delegated to reduce confusion and
duplication of orders. The NCOs were held
responsible for the actions of their men and,
within limits, their decisions were enforced
without question.
Within two months the effects of the
changes were evident.The officers and enlist-
ed men learned what was expected of them
and began to see themselves as an essential

. It essentially criticizes the polyvinylchloride-related industries for not using environmentally safe procedures, and for allowing PVC derivative compounds to leach into water tables. The current theory is that these compounds can later cause cancer in the human body. John was especially surprised to learn that vinyl siding on homes is considered to be one of the main contributors to groundwater and water table pollution. The documentary noted that a variety of home builders receive special incentive discounts to use vinyl siding. One such builder is Habitat for Humanity, which has used inexpensive vinyl siding in its homes for years, because Habitat receives vinyl siding at a reduced rate from the vinyl industry as a corporate tax shelter contribution. Video streaming on Netflix accounts for 32 percent of all bandwidth use in the United States, and Google’s YouTube for 19 percent of Web traffic at peak hours. If user demand overwhelms network capacity, the Internet might not come to a screeching halt, but users could face sluggish download speeds and video transmission. Heavy use of iPhones in urban areas such as New York and San Francisco has already degraded service on the AT&T wireless network. AT&T reported that 3 percent of its subscriber base accounted for 40 percent of its data traffic. Internet service providers (ISPs) assert that network congestion is a serious problem and that expanding their networks would require passing on burdensome costs to consumers. These companies believe differential pricing methods, which include data caps and metered use—charging based on the amount of bandwidth consumed—are the fairest way to finance necessary investments in their network infrastructures. But metering Internet use is not widely accepted, because of an ongoing debate about net neutrality. Net neutrality is the idea that Internet service providers must allow customers equal access to content and applications, regardless of the source or nature of the content. Presently, the Internet is neutral: all Internet traffic is treated equally on a first-come, first-served basis by Internet backbone owners. However, this arrangement prevents telecommunications and cable companies from charging differentiated prices based on the amount of bandwidth consumed by the content being delivered over the Internet. The strange alliance of net neutrality advocates includes MoveOn.org; the Christian Coalition; the American Library Association; data-intensive Web businesses such as Netflix, Amazon, and Google; major consumer groups; and a host of bloggers and small businesses. Net neutrality advocates argue that differentiated pricing would impose heavy costs on heavy bandwidth users such as YouTube, Skype, and other innovative services, preventing high-bandwidth startup companies from gaining traction. Net neutrality supporters also argue that without net neutrality, ISPs that are also cable companies, such as Comcast, might block online streaming video from Netflix or Hulu in order to force customers to use the cable company’s on-demand movie rental services. 4. Importing a different style is far from a panacea. As discussed in this chapter, a different style can be prone to problems when applied poorly across culture. Many Western companies want leaders who encourage ideas, innovation, and speedy decision making. But leadership in Asia conjures up words like order, paternalism, and formality. That certainly describes the leadership approach in many large Korean companies over the past 50 years. Over this half century of great economic success, the power to make key decisions was concentrated at the top of rigidly bureaucratic corporate structures. And these structures were themselves tied to larger interrelated and co-owned conglomerates—the Korean

The situation:
Back office operations supporting the global operations were all in HQ in the United States. While some countries had financial staff, the majority of business financial services were supplied from this HQ group.
Problems:
Processing expense and budgetary costs for this unit were skyrocketing (over 20% a year).
The operation is very people intensive and is seen as highly inefficient (by management, the workers in the unit are frustrated too, and the “internal customers” are clearly not satisfied with the quality and timeliness of the work).
One measure of the problem is that the regions and local countries vociferously complained about the charge backs from the unit. Better services could be gotten locally, for less cost.
Internal interviews and a questionnaire uncovered backlogs in work, especially in answering customer inquiries. Audits showed proof problems, and records did not match. There was high turnover and poor training of newer staff. Errors were increasing, and adding a quality and compliance staff did not seem to help at all.
Actions:
When the problem was first raised, the internal OD team conducted a series of interviews with management and customers. They suggested that the employees take a survey to assess motivation and identify problems from their view. The survey used was a Job Diagnostic, derived from the work of Hackman and Oldham on job enrichment. It measured the five classic elements: task significance, variety, and identity (along with autonomy and feedback).
The survey was mailed to the employees' homes so they would not feel threatened, but no announcements at work were made. The return rate was so poor, several meetings were held (by management without a consultant) to explain why they were sent and what they were hoping to do. Given all the problems and concerns raised at these meetings, the internal consulting team was asked to hold team building sessions. They did, and the same issues were raised—everything seemed to be .
