Scegliere la forma giuridica
Molte sono le variabili di cui tener conto nella scelta della forma giuridica da dare all’impresa.
Il punto di partenza è decidere se siamo soli o no.
La forma giuridica più semplice è quella dell’impresa individuale (detta impropriamente “ditta individuale”), che può configurarsi anche come “impresa familiare”.
Se, invece, due o più persone si accordano per svolgere insieme un’attività economica siamo di fronte ad un’impresa collettiva, cioè a una società.
I vari tipi di società
- società di persone (società semplice, società in nome collettivo, società in accomandita semplice);
- società di capitali (società a responsabilità limitata, società unipersonale a responsabilità limitata, società a responsabilità limitata semplificata e a capitale ridotto, società per azioni, società in accomandita per azioni);
società cooperative.
La scelta di un tipo di società piuttosto che di un altro dipende da molti fattori (tecnici, giuridici, amministrativi, fiscali ecc.) parlatene con consulenti esperti;
