Children are one of the most valued assets of the future generation who are required to be protected. Recently, there is an unprecedented increase in the juvenile crime rate. This is due to many changes such as behavioral change, lack of education, subjugation, upbringing environment, harassment, lack of parental care, sexual indulgence, violent treatment, poverty, and the advent of modern lifestyle. Shrewd criminals indulge children in criminal activities especially, the ones between 6-12 years because at this point minds are innocent and can be easily manipulated as well as lure them to the world of crime. However, children below 7 years of age cannot be held criminally responsible for an offence because of a lack of understandability and are known as “Doli Incapax Maxim”.

The child sexual abuse is an under reported offence in India, which has reached epidemic proportion. A recent study on prevalence of sexual abuse among adolescents in Kerala, reported that 36 per cent of boys and 35 per cent of girls had experienced sexual abuse at some point of time. A similar study conducted by the Government of India in 17,220 children and adolescents to estimate the burden of sexual abuse revealed shocking results and showed that every second child in the country was sexually abused among them, 52.94 per cent were boys and 47.06 per cent were girls. Highest sexual abuse was reported in Assam 57.27 followed by Delhi 41 , Andhra Pradesh 33.87 and Bihar 33.27 . 1 Sexual abuse and sex trafficking remain highly prevalent and are among the serious problems in India. In the last two decades, an increase in the prevalence of sexually transmitted diseases has been shown in children. Children who are victims of sexual abuse often know the perpetrator in some way. Hence, the problem of child sexual abuse needs to be addressed through less ambiguous and more stringent punishment. Sexual violence case on children in Indonesia is increasing significantly. There are some factors that is causing it, such as the nurture pattern deviation in family. Various kinds of strategies have been applied by government, but the result is still not as it is supposed to be. One of the applied strategy is by promoting health. Promotion strategy is performed by advocacy, society empowerment and building environment. Promotion strategy in conventional way, like preaching and counseling, does not attract nice attention from toddler’s parents, in fact it is weary. Promotion is performed periodically from trained health workers, training staff for Integrated Service Post (Posyandu) and the other staff, after that it is shared to the toddler’s mother by educational programs. Toddler is the main target of the educational program. Material about sex education, that is adapted by the age of the toddler, begins from the third year or when phallic phase begins.

- 2. POSCO, “Protection of children from sexual offence Act 2012 was formulated on order to effectively address sexual abuse and sexual exploitation of children POSCO Act 2012 received the president’s assent on 19th of June 2012 and was notified in the gazette of India on 20th June 2012”.
- 3. The Act defines a child as a any person below 18 years of age it defines different forms of sexual abuse, Including penetrative and non-penetrative of assault, as well as sexual harassment and pornography.
- 4. Short term effects 1. Feeling of powerlessness. 2. Anger / Fear. 3. Feeling of guilty. 4. Loss of esteem and confidence. 5. Anxiety. Long term effects 1. Depression and thoughts of suicide. 2. Poor body image and low self esteem. 3. Issues in maintaining relationships.
- 5. The protection of Children from Sexual Offence ( POSCO) Act 2012 is applicable to whole of India. Its defines a child as any person below the age of 18 year and provides protection to the all children under the age of 18 years from sexual abuse.
- 6. Why? Before this Act, child sexual was prosecuted under : IPC 375 – RAPE. IPC 354 – Outraging the modesty of a women. IPC 377 – unnatural sexual offence. IPC 511 – Attempt.
- 7. Regarding the details of the assault including the time and place, frequency, description of clothing worn and so on. Interview to be should conducted by a trained professional. The interviews are forensic rather than therapeutic interviews thereby for the purposes of being sensitive, unbiased and truth seeking. The purpose of the interview would be to support accurate and fair decision making in the criminal justice.
- 8. To get a picture of the child’s physical and emotional state. To get a picture of child’s relationship with their parents or family now the circumstances leading to the concern. To establish whether the child needs urgent medical attention. To find out who the child trusts. To assure the child that he/she is now safe and would be cared for.
- 9. Penetrative sexual assault (sec3)-not less than 7 years which may extend to imprisonment for life, fine (sec4). Aggravated penetrative sexual assault (sec5)-not less than 10 years which my extend to imprisonment for life and fine (sec6). Sexual assault (sec7)-not less than 3years which may extend to 5 years and fine (sec8). Aggravated sexual assault (sec9)-not less than 5 years which may extend to 7 years, and fine (sec10). Sexual harassment of the child (sec11) – 3 years and fine (sec12). Use of child pornographic purpose (sec13)-5 years and fine and in the event of subsequent convention, 7 years and fine (sec14(1)).
