“We the people of India, having solemnly resolved to constitute India
into a sovereign, socialist, secular, democratic republic and to secure to
all its citizens JUSTICE; social, economic and political, LIBERTY; of
thought, expression, belief, faith and worship.
EQUALITY of status and of opportunity and to promote among all its
citizens;
FRATERNITY assuring the dignity of the individual and the unity and
integrity of the nation.
In our Constituent Assembly this twenty-sixth day of November, 1949,
do hereby adopt, enact and give to ourselves this Constitution.”
The concept of access to justice, primarily,
necessitates a potential system securing
appropriate legal remedies within the Civil and
Criminal justice fields.
Judiciary, being an integral part and parcel of
an effective judicial system, hence has a
greater role in ensuring access to justice.
Since our country is a secular and democratic
republic, rights of different religious peoples and
minorities, linguistic or cultural, are protected
under the Constitution. As well, the rights under
the personal laws and customary rights are
protected subject to the provisions of fundamental
rights guaranteed in Part III of the Constitution of
India. Such rights include the right of inheritance
and succession, right to marry, right of performing
religious rituals etc.

The NCRB figures show that the number of dowry deaths has seen a
steady growth during the period between 2007 and 2011.
The Dowry ProhibitionAct of 1961 prohibits the payment and
acceptance of dowry.
Statistics from the State Crime Records Bureau(SCRB) show an
increase of 50% in cases of rape registered between January and July
2013 in spite of the past incidents which prompted so called
“stringent” laws.
Cyber crime cases in the country registered under the ITAct last year
rose by about 61% to 2876 with Maharashtra recording the most
number of cases.
We have been mooting for the constitution of “gram Nayayalays” but even
their establishment may heal the wound to some extent but we are leaving
the large extent of wound without medicine and it certainly kills at one
stage.
A major drawback lies in the selection of incompetent legal professionals, it
may sound weird that some of them can not even draft an adjournment
application even after 10years of practice. How can we expect the courts to
deliver results speedily without the assistance of truly qualified
professionals.
We fail to realise that even our constitutional court emphasises the
importance of reducing the pending cases before various courts.
We all are familiar with the gang rapes of two
women in Delhi as well as Mumbai. What
happened to them, stirred something in out hearts
and a new face of India was born, ready to protest.
 On an average, 2 out of every 3 women in India have been sexually harassed
at some point of their lives.
 A new report from the World Health Organisation has drawn
together data from dozens of studies and found that 35% of women have
experienced violence - and that the consequences for their health can be
devastating.
 For every woman who obtains a job, two women are killed at birth, abused In
childhood, burnt over dowry, or sexually harassed at work.

A civil case should be considered as old if the period of one year elapses
from the date of registration to the date of pronouncement of the
judgement.
In case of sessionTrials, the above period should include the period of
pendency of commitment proceedings.
A criminal case should be disposed off within six months from the date
of report.
 TIME TAKEN IN SCRUNITY OF THE COMPLAINT SHOULD NOT
EXCEED ONE WEEK.
 STRINGENT AND PROMPT ACTION SHOULD BE TAKEN AGAINST
PROCESS SERVERS MAKING FALSE REPORTS.
 THERE MUST BE SOME STANDARD FOR THE NUMBER OF CASES
PENDING IN THE COURT; WHENEVER THER ARE INDICATIONS THAT
THE NUMBER IS GOING BEYOND THE STANDARD; ADDITIONAL
COURTS MUST BE CREATED.
 ENTIRE EVIDENCE, AS FAR AS POSSIBLE, SHOULD BE RECORDED IN
A SINGLE STRECH.
 THERE IS A TENDENCY TO OVER-PROVE ALLEGATIONS OF THE
FACTS. UNNECCESSARY PROLONGATIONS OF DEPOSITIONS
SHOULD BE AVOIDED.
