Conditional Use Permits
The Scott County Fiscal Court has asked the Planning Commission staff to re-evaluate the
standards and procedures for approving Conditional Uses in the County.
What are Conditional Uses? In rural areas, certain uses that serve rural residents or require
additional acreage or are of a rural nature and not incompatible with rural character are permitted
with special approval by the Scott County Board of Adjustment. These special uses could be
conditionally allowed, with whatever special restriction the Board of Adjustment would apply to
the use to protect against negative impacts to the surrounding area. Conditional Use Permits are
easier to obtain than a property rezoning, and Conditional Use Permits are tied to the owner and
operator, not the property itself. So when the property is sold or the use stops, the Conditional
Use expires.
Some examples of the types of operations that require a Conditional Use Permit in County
Agricultural Districts are churches and private schools, retail plant nurseries, animal hospitals and
clinics, and private parks or recreational areas.
It has long ago been recognized that some flexibility in available options for land use are nec-
essary to allow for economic growth. Conditional Uses allow for new investment and increased
rural vitality with the benefit of limiting the need to rezone property for any type of limited rural
quasi-commercial activity.
The flip side is that once approved, it is necessary to monitor Conditional Use Permitees to
make sure they adhere to the requirements of their permits. Areas the Planning staff will be eval-
uating are: Increase community notification requirements when these applications are being
heard? Is there a need to set a maximum size for buildings associated with Conditional Use ap-
plications? Limit or expand the types of uses that are eligible for a Conditional Use Permit? Any
changes eventually proposed to existing regulations will have to go through a public hearing pro-
cess and adopted by Scott County Fiscal Court.

Conditional Use Permits are easier to obtain than a property rezoning, and Conditional Use Permits are tied to the owner and operator, not the property itself. So when the property is sold or the use stops, the Conditional Use expires. Some examples of the types of operations that require a Conditional Use Permit in County Agricultural Districts are churches and private schools, retail plant nurseries, animal hospitals and clinics, and private parks or recreational areas. It has long ago been recognized that some flexibility in available options for land use are nec- essary to allow for economic growth. Conditional Uses allow for new investment and increased rural vitality with the benefit of limiting the need to rezone property for any type of limited rural quasi-commercial activity.
