Kidnapping: State V. Stu Dent
List the elements of the crime and facts that establish each element.
Kidnapping is defined by Fla. Stat. § 787.01 as forcibly, secretly and by use of threat confining or imprisoning another person against his or her will and without any lawful authority or intent. The purpose with which Stu Dent confined the victim was to inflict bodily harm her, this is part of the intention that is described by the law. The law states that the victim’s state of mind is an important factor to consider before we can determine that one was kidnapped, in this case the victim was tested for drugs and it was proven that she was not under any drug influence at the time. So she was forcibly abducted against her will as the evidence shows there was some sort of struggle with the defendant before she was tied using ropes.
We can see that the defendant had planned on forceful capture and detention of the victim against her will, he had it in his diary that he would buy a rope whose main purpose would be to tight the victim before he could move her five miles from their home. The detention occurred done against her will since she engaged in a form of struggle with the defendant; this is established by the fact that pieces of human skin were found underneath her finger nail. She was not under influence of drugs therefore we can eliminate any belief that she might have willingly accepted the forceful abduction. The defendant if proven guilty of the charge of kidnapping will be guilty of felony of the first degree.

Last year, on the mid-afternoon of October 18th, the defendant, Stu Dents, left his apartment on Main Street and drove to Broadway and 83rd. Two eyewitnesses say the defendant then walked through the Broadway Arms apartment building to his girlfriend’s apartment, number 156, and entered the apartment.
It is unclear how the defendant entered the apartment, but no signs of force were evident. Witnesses could not say if the defendant used a key. The victim, Uma Opee, was not home at the time. Coworkers say Uma Opee was last seen when she left work at 5:10 p.m.
The body of the victim was found October 19th at 7:45 a.m. behind an abandoned building approximately 5 miles from her residence. The victim was found with cloth stuffed in her mouth, her arms and legs tied with rope restraints, having been stabbed to death.
Uma Opee worked at a music store within walking distance of her apartment. She had a previous criminal record that included shoplifting, drug possession and sale, assault, and disorderly conduct. Uma completed court-ordered rehabilitation just .

prisoner abuse at Abu Ghraib, the photographs, which have become
iconic, created the context and the meaning of what took place. We
think we know the contours of that story: a few soldiers on the night
shift violated established military rules and subjected prisoners to
humiliating abuse and terror. Chaos in the line of command, an
overstretched military, a bewildering insurgency: all contributed to
incidents that were alien to the values of the United States and its
military. The scandal was an aberration. It was appalling.
Responsibility was taken. Reports were issued. Hearings continue.
But the photographs lied. They told us a shard of the truth. In
retrospect, they deflected us away from what was really going on, and
what is still going on. The problem is not a co-ordinated cover-up. Nor
is it a lack of information. The official government and Red Cross
reports on prisoner torture and abuse, compiled in two separate
volumes, ''The Abu Ghraib Investigations,'' by a former Newsweek
editor, Steven Strasser, and ''Torture and Terror,'' by a New York
Review of Books contributor, Mark Danner, are almost numbingly
exhaustive in their cataloging of specific mistakes, incidents and
responsibilities. Danner's document-dump runs to almost 600 pages
of print, the bulk of it in small type. The American Civil Liberties
Union has also successfully engineered the release of what may
eventually amount to hundreds of thousands of internal government
documents detailing the events.
That tells you something important at the start. Whatever happened
was exposed in a free society; the military itself began the first
inquiries. You can now read, in these pages, previously secret
memorandums from sources as high as the attorney general all the
way down to prisoner testimony to the International Committee of the

Over the period, the United States of America has been at war. Not a physical battle, but a fight with drug abuse and various forms of domestic violence. Authorities have put their efforts on bringing the culprits to justice. Those who are typically found culpable for either of the crimes have been sentenced to some periods in prison as a way of rectifying their illegal actions (Int'L, 2015). That is why; looking at the case involving Abby and Bobby there is a clear basis in the law that can be applied in bringing them to books.
In law, there is an aspect that states 'a person arrested remains as a suspect until proven guilty.' Proving of a case depends on the shreds of evidence that get presented in court by the prosecutor. Therefore, in proving a case against a suspected criminal, a prosecutor will majorly have to rely on the pieces of evidence that are gathered at the scene of the crime. Having this information, as a police officer, the evidence which I witnessed at the couple’s house must be protected so that the same can get applied during the trial process the said couple. In safeguarding the evidence, it will be instrumental for me to undertake two critical actions. First, I will need to inform both Christiana and David who were to remain at the scene of the crime about the illegal things which I saw in the house so that they become aware of the same as they continue to code off the house. Secondly, it will be of importance if I equally take photos of these illegal products in the house which in any case, can be used in backing up the case against
the two. Besides, in case of any further discovery of evidence either from their house or in their possession, an almost similar procedure can equally apply. The only distinction will be the need to take the said evidence and keep them under my jurisdiction or take them directly to the prosecutor who might decide to keep them as per the court’s acts on procedures of storing evidence.
