human burial purposes, and perpetual care funds (operated in connection with such exempt organizations) are
deductible as charitable contributions on the donor's federal income tax return. However, a donor may not
deduct a contribution made for the perpetual care of a particular lot or crypt. Payments made to a cemetery
company or corporation as part of the purchase price of a burial lot or crypt, whether irrevocably dedicated to
the perpetual care of the cemetery as a whole or earmarked for the care of a particular lot, are also not
deductible.

The number of disasters, poverty people deaths, and unemployment brings great need for the services of
ONA. Red Cross and others are attending to the needs of the living and injured, but there is no organization

There are also companies offering loans for mortuary, etc. benefits, but the bereaved have no means to repay
and are further buried in debt trying to get closure over the deceased loved one.

3. Operation Noah's Ark has the stock pile of 200 caskets that are secured for the next disaster.
Except for holders of preferred stock (discussed later), no person may have any interest in the net earnings of
a tax-exempt cemetery company or crematorium. Therefore, if property is transferred to the organization in
exchange for an interest in the organization's net earnings, the organization will not be exempt so long as that
interest remains outstanding.

requests about what they would like to be reflected in each urn, this has help to evolve our designs, from the

personal, and companies that ask for a special design, unique for their funeral home.
For the creation of our urns we use a variety of different woods with natural tones combine to complete each
design, we do not use paint, only transparent wood finishing or natural wax to burst their natural beauty.

6. Dear O.N.A. Supporters and active Internal Command members,
I have included in this personal email a brief summary of what my immediate intentions are, my future goals
and my mission and objectives with the organization Operation Noah's Ark (FEIN 91-2151249).
As we are becoming a qualified and certified organization, I will be the overseer as Incident Commander for
any common to catastrophic disaster, assisting the affected communities with funeral related products and
other compassionate services for the deceased and their loved ones.
My passion has always been to help the families involved, and to help them attain a sense of security and
peace that will effectively allow proper closure. I intend to be an on-site operations incident commander and
run an on-site incident command system (ICS).
I am also proud to inform you that I have completed course IS100-b, Introduction to Incident Command
Systems, and am now certified by the Department of Homeland Security and FEMA.
My current focus is also become an active and certified disaster relief chaplain through the Emergency
Response Chaplains Corps (ERCC).
The organization's next step in 2012 is to present to the communities across the world with the 2012
PowerPoint to clearly define and fine-tune our objectives for Operation Noah's Ark's.
As our plans develop over the next few months, our objectives can become more clear and concrete. As

Operation Noah's Ark began as a vision in 2001, shortly after I attended the funeral of a very close family
friend. Brook was just only 19 when he was killed in a single car accident on his way home from finishing his
first year term at Old Miss.
The family, was grief stricken as, there were his many as 4000 close friends and associates tat attended this
funeral in May of 1998. The funeral was the most beautiful event with gorgeous flowers, a handsome casket
and a headstone that will last for eternity.

7. As I, sat at in the funeral service next to his mother, father and older sister and we all had celebrated his short
but meaningful life, I found myself , thinking how fortunate this family was to be able to invest in this lovely
service for a much-loved child. In the next days that followed, I was able to observe first hand how important
the funeral rites were to the peace and proper closure in the mind of the family...seeing how much comfort the
funeral service and the flowers and everything else really did provide.
Over the following days and weeks, I couldn't help but to contrast this experience for what I imagined
families that could not afford even the most meager funeral or bereavement services most need to experience.
I couldn't get this contrast out of mind. 3 years from Brooks tragic in 1998 in 2001 Operation Noah's Ark was
born.
Some in the funeral industry have marked up their products and services as high as 350% above beginning
cost associated , giving these indigent families even to the families with moderate income limited or no
choices in their funeral arrangements.
As, the founder and president of this one of a kind Charitable Organization, I am committed to giving these
families the dignity and respect through the charities opportunity for allowing the comfort and closure
following the passing of a loved one, that is not dependent on income or social class.

On February 9, 2012, ACE Caskets, Jim Malamas and the other defendants in long running litigation with
The York Group, Inc. scored a major victory when the Fifth Circuit Court of Appeals ruled the federal court
in Houston, Texas did not have jurisdiction over the case and dismissed it.
ACE Caskets, Jim Malamas and the other defendants, including one of its suppliers Wuxi Taihu Tractor
Company, have spent years challenging a default judgment York obtained in July of 2007 in violation of the
defendants' due process rights. Throughout this time, York has aggressively sought to enforce the default
judgment against casket companies in North America. The challenge to the default judgment now proceeds in
the Houston, Texas state court where it originated.
ACE Caskets and Jim Malamas have never wavered and have always remained confident in its belief that the
default judgment York obtained is not valid and that ACE Caskets and the other defendants will prevail.
The decision by the Fifth Circuit is an important victory and a big step toward righting a wrong. ACE Caskets
and Jim Malamas will continue to vigorously defend their rights and looks forward to a complete victory in
the state court.

A pending Ventura County Non-Profit Organization was “Blessed” with a Section 501 (c) (3) status tax
exempt status. Operation Noah’s Ark (O.N.A.2001) Corporation is located in the Ventura County California
area, had received its non-profit section 501 ( c) (3) tax exemption ,that is now operating as a publicly
supported charity, The Letter of Exemption was filed and active in 2001 and organization was revived after a
brief time period with a 3557 Reviver was requested by the Franchise Tax Board on March 2011.
When Japan was tragically devastated the morning of March 11, 2011 at 9:11am Laura Bacon who is the co-
founder of Operation Noah's Ark is also the charities current President on the board of Directors, Laura
Bacon called, The Department of Treasury (IRS) and the Franchise Tax Board had expedited over the
telephone with Bacon who was following up on its current pending reviver status.
Bacon, was informed upon the departments opening and operating hours that once again is a public charity
now listed as a current tax exempt status, after filing 2005, 2006, and 2007 forms of the 990 that was
determined and requested by the IRS.
The process was a short term application process. Bacons phone call with the IRS, was somewhat a shock to
her unexpectedly determined she, was expecting a longer time period, figuring the grace period would be
around 40-60 more days from the last week’s filing.
Normal, a pending grace period can take a minimum of 60 days and it could even take even up to 3 and even
10 years to get this type of “Blessing” from the Federal and State. It only had taken this entity a little over
one week to regain and get its exempt status back.
This really is, a unique and rare circumstance in the not-for profit Industry.
Operation Noah’s Ark (O.N.A.2001) charity can now accept donations for a 100% fair market value as a
100% write off to any donor.
