Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

2 ICCJ - Decizia nr. 928/2013/ Dosar nr. 7964/2/2012 : “Se poate aprecia că există urgenţă atunci când executarea
actului administrativ aduce o atingere gravă şi imediată unui interes public, situaţiei reclamantului sau intereselor pe care acesta înţelege să
le apere.
Revine judecătorului de contencios administrativ, investit cu soluţionarea unei cereri de suspendare, să aprecieze în mod concret, având
în vedere argumentele prezentate de reclamant, dacă efectele actului aflat în discuţie sunt de natură să justifice urgenţa.
Aceasta din urmă poate justifica măsura provizorie a suspendării executării unui act administrativ, fără ca ea să aducă atingere hotărârii
judecătoreşti ce urmează a se pronunţa cu privire la cererea de anulare a actului.
Alături de argumentele expuse mai sus, Înalta Curte are în vedere şi recomandarea nr. R/89/8 din 13 septembrie 1989 a Comitetului de
Miniştri din cadrul Consiliului Europei privind protecţia jurisdicţională provizorie în materie administrativă.
Aşa cum s-a arătat de altfel şi în recomandarea nr. 16/2003 a Comitetului Miniştrilor din cadrul Consiliului Europei, executarea deciziilor
administrative trebuie să ţină cont de drepturile şi interesele persoanelor particulare.
Aceeaşi recomandare reaminteşte principiile din recomandarea nr. R/89/8 a Comitetului de Miniştrii care cheamă autoritatea
jurisdicţională competentă, în speţă instanţa judecătorească, atunci când executarea unei decizii administrative este de natură să provoace
daune grave particularilor cărora li se aplică decizia, să ia măsuri provizorii corespunzătoare”
In acest sens - Jurisprudenta TRIBUNALUL ILFOV
“ Măsura suspendării actului administrativ, în contextul conturat, nu este de natură a crea un prejudiciu pârâtei şi oricum măsura dispusă
este în acord şi cu Recomandarea nr. R(89) 8 adoptată de Comitetul de Miniştrii din cadrul Consiliului Europei la data de 13.09.1989,
referitoare la protecţia jurisdicţională provizorie în materie administrativă, în cuprinsul căreia se arată că executarea imediată şi integrală a
actelor administrative contestate sau susceptibile de a fi contestate, poate cauza, în anumite circumstanţe, un prejudiciu ireparabil, pe care
echitatea îl impune să fie evitat în măsura posibilului.”

a COMITETULUI DE MINIŞTRI CĂTRE STATELE MEMBRE
PRIVIND PROTECŢIA PROVIZORIE ACORDATĂ DE INSTANŢĂ PE PROBLEME ADMINISTRATIVE

Comitetul de Miniştri, în conformitate cu termenii articolului I5.b din Statutul Consiliului Europei,
Având în vedere că scopul Consiliului Europei este de a realiza o uniune mai strânsă între membrii săi;
Având în vedere că autorităţile administrative sunt active în numeroase domenii şi că activităţile lor sunt
de natură să afecteze drepturile, libertăţile şi interesele individului;
Având în vedere că executarea imediată, deplină de acte administrative care au fost contestate sau sunt
pe cale de a fi atacate. poate, în anumite circumstanţe, aduce atingere intereselor persoanelor într-un
mod ireparabil care, pentru motive de echitate, ar trebui să fie evitat pe cât posibil ; Considerând că este
de dorit să se garanteze persoanelor fizice protecţie cu titlu provizoriu de către instanţele
judecătoreşti, în cazul în care aceasta este necesară, fără a neglija necesitatea unei acţiuni
administrative eficiente; Reamintind principiile generale privind protecţia individului în raport cu
actele autorităţilor administrative stabilite în Rezoluţia sa (77) 31 şi principiile cu privire la exercitarea
puterilor discreţionare de către autorităţile administrative cuprinse în Recomandarea nr R (80) 2,
Recomandă guvernelor statelor membre de a se inspira, în dreptul şi practica lor din principiile
enunţate în prezenta recomandare.
INTRODUCERE
Următoarele principii se aplică la protecţia provizorie din partea instanţei împotriva actelor
administrative. Fără a aduce atingere următorului sub-paragraf, termenul de “act administrativ”
înseamnă, în conformitate cu Rezoluţia (77) 31 privind protecţia individului în raport cu actele adoptate
de autorităţile administrative, orice măsură sau decizie individuală care este luată prin exercitarea
autorităţii publice şi care este de natură să afecteze în mod direct drepturile, libertăţile sau interesele
persoanelor. În acele sisteme juridice în care actele administrative de reglementare pot fi contestate în
faţa unei instanţe, următoarele principii se aplică, de asemenea, în cazul protecţiei provizorii împotriva
actelor administrative de reglementare.

PRINCIPII
I Atunci când o instanţă este sesizată cu o contestatie referitoare la un act administrativ, iar instanţa
nu a pronunţat încă o decizie, solicitantul poate cere aceleiaşi instanţe sau unei alte instanţe
competente să ia măsuri de protecţie provizorie împotriva actului administrativ. Persoana în cauză
trebuie să aibă acelaşi drept de a solicita unei instanţe competente să ia măsuri de protecţie
provizorie, înainte de contestarea actului în conformitate cu primul sub-paragraf, în caz de urgenţă
sau atunci când o plângere administrativă, care nu cuprinde în sine niciun efect suspensiv, a fost
depusă împotriva actului administrativ şi nu a fost încă solutionată.
II În decizia privind acordarea protecţiei provizorii solicitantului, instanţa trebuie să ia în considerare
toţi factorii relevanţi şi interesele. Măsuri de protecţie provizorii pot fi acordate, în special, în cazul în
care executarea actului administrativ este susceptibilă de a provoca daune severe, care ar putea fi
remediate cu dificultate şi dacă există un caz prima-facie împotriva valabilităţii actului.
III Măsurile de protecţie provizorie dispuse de către instanţa competentă pot lua forma de
suspendare a executarii actului administrativ, în întregime sau parţial, prin care se dispune în totalitate
sau parţial restabilirea situaţiei care a existat la momentul adoptarii actului administrativ sau la orice
modificare ulterioară, şi de impunere asupra administraţiei a oricarei obligaţii corespunzătoare, în
conformitate cu competenţele Curţii. Măsurile de protecţie provizorie se acordă pentru perioada
stabilită de instanţă. Ele pot fi supuse anumitor condiţii si pot fi revizuite. Măsurile de protecţie
provizorie nu pot aduce în nici un fel atingere deciziei care urmează să fie luată de instanţa sesizată cu
privire la contestarea actului administrativ.
IV Procedurile prezentate instanţei trebuie să fie rapide. Cu excepţia cazurilor de urgenţă, procedura
trebuie să se facă în contradictoriu şi trebuie să permită accesul persoanelor terţe interesate. Atunci
când, în cazuri de urgenţă, persoanele interesate nu au putut fi audiate înainte ca instanţa să acorde
măsura de protecţie provizorie, problema va fi supusă unei noi examinări într-un timp scurt, în cadrul
unei proceduri în conformitate cu alineatul precedent.
