Kako se navodi (parlament.gov.rs), predvidjeno je taj zakon stupi na snagu 1. septembra 2014, jer tog dana pocinje da se primenjuje Zakon o javnom beleznistvu i odredjene nadleznosti sudova preuzimaju javni beleznici.
Vlada Srbije je Predlog zakona o prometu nepokretnostu uputila na uvajanje po hitnom postupku.
U Predlogu se kao razlog za donosenje novog zakona o prometu nepokretnosti navodi da je neophodno izvrsiti uskladjivanje zakona sa Zakonom o javnoj svojini i Ustavom iz 2006. koji predvidja pretvaranje drustvene svojine u privatnu i uvodi kategoriju javne svojine.
Predlogom Zakona o prometu nepokretnosti predvidjeno je da je za sastavljanje ugovora o prometu nepokretnosti u obliku javnobeleznickog zapisa iskljucivo nadlezan javni beleznik na cijem se podrucju nalazi nepokretnost koja je predmet ugovora.
Predvidjeno je da se prenosom prava svojine na zgradi ili drugom gradjevinskom objektu, prenosi i pravo svojine, odnosno pravo koriscenja ili zakupa na zemljistu na kojem se zgrada nalazi i zemljistu koje sluzi za redovnu upotrebu zgrade.
Zakonodavac je predvideo pravo prece kupovine, kojim se suvlasnik nepokretnosti koji namerava da proda svoj suvlasnicki udeo obavezuje da ga prethodno ponudi na prodaju ostalim suvlasnicima.
U slucaju kad ima vise suvlasnika, prvenstvo u ostvarivanju prava prece kupovine ima suvlasnik s vecim suvlasnickim delom, navodi se u Predlogu zakona o prometu nerpokretnosti.
U slucaju da ima vise suvlasnika koji bi imali pravo prece kupovine, suvlasnik nepokretnosti ima pravo da sam odluci kome ce od njih prodati svoj deo nepokretnosti.
U slucaju poljoprivrednog zemljsta, kako se navodi, vlasnik koji namerava da proda poljoprivredno zemljiste, ako nema suvlasnika, duzan je da ga prethodno ponudi na prodaju vlasniku susednog poljoprivrednog zemljista.
Predvidjeno je da u slucaju kad ima vise vlasnika susednog zemljista prvenstvo u ostvarivanju prava prece kupovine ima vlasnik susednog zemljista cije se poljoprivredno zemljiste preteznim delom granici sa zemljistem prodavca.

Предмет: Иницијатива за хитно усклађивање прописа у Републици Србији са
прописом Сједињених Америчких Држава (САД) под називом FATCA
Поштовани господине Дачићу,
Удружење банака Србије п.у. на основу закључака усвојених на седници Управног
одбора која је одржана 12.06.2013. године обраћа Вам се са захтевом да Влада
Републике Србије заједно са својим надлежним Министарствима предузме све
неопходне мере потребне да се ускладе прописи у РС са прописом Сједињених
Америчких Држава под назимом FATCA.
Концепт прописа FATCA базира се на обавези усклађивања иностраних финансијских
институција са условима утврђеним прописом Сједињених Aмеричких Држава (САД)
под називом Закон о усаглашености пореза на иностране рачуне, скраћено FATCA
(Foreign Account Tax Compliance Act), коју је донело Министарство финансија САД,
заједно са Сектором интерних прихода (скраћено „SIP“) при Пореској управи САД, чија
је последња верзија ступила на снагу у јануару ове године.
Крајњи циљ доношења овог прописа је спречавање утаје пореза, односно наплата
пореза од САД пореских обвезника који поседују средства на рачунима отвореним у
страним финансијским институцијама.
За реализацију овог циља, неопходно је да свака инострана финансијска институција
(попут банака, фондова, осигуравајућих друштава и других финансијских институција)
склопи споразум са пореском агенцијом САД, почев од 1. јануара 2013. а најкасније 1.
јула 2013. године којим би се обавезала:
• да ће међу својим клијентима идентификовати пореске обвезнике САД и да ће
SIP-у поднети извештај са извесним финансијским информацијама;
2. • да ће наплатити 30% од појединих уплата оних клијената који не доставе
тражене информације (они се дефинишу као „Непослушни држаоци рачуна“),
као и од оних иностраних финансијских институција које одбију да учествују
(скраћено „NPFFI“)
Потребно је истаћи да када је реч о банкама и другим финансијским институцијама,
усаглашеност са FATCA актом захтева се од свих финансијских институција чланица
Групе („Проширена афилирана група“ како је дефинисано и регулисано предложеном
регулативом). Уколико једна једина финансијска институција одбије да се усагласи,
читавој Групи биће ускраћено усаглашавање са FATCA концептом (према предложеној
регулативи.)
Оно што представља тешкоћу за финансијске институције које послују у Републици
Србији, а већина је започела процес усклађивања са FATCA прописом, је у томе да
домаћи прописи који регулишу питања заштите података, односно банкарске тајне,
забрањују достављање било каквих података о клијентима трећим лицима, без писмене
сагласности клијента, док FATCA регулатива захтева извршавање обавеза извештавања
и наплате пореза и од клијената који на то нису дали сагласност.
Управо је то разлог да су финансијске институције, као што су банке, осигуравајућа
друштва, друштва за управљање пензијским или инвестиционим фондовима, које
послују у Републици Србији доведене у положај да због описаног неслагања захтева
FATCA, са једне, и домаћих прописа са друге стране, њихово усклађивање у овом
тренутку није изводљиво.
ПРАВНЕ ИМПЛИКАЦИЈЕ FATCA ПРОПИСА
Имплементација захтева FATCA прописа има снажан утицај са правне тачке гледишта,
имајући у виду неопходност обелодањивања личних финансијских података за извесне
категорије клијената, који су уобичајено заштићени банкарском тајном или Законом о
заштити података о личности. Национални регулаторни систем намеће строге
рестрикције, чиме се онемогућава да финансијске институције легално испуњавају
FATCA захтеве.
Последице неусклађивања финансијских институција са FATCA прописом су озбиљне и
односе се на читаве групације финансијских институција. Финансијске институције које
се не укључе у FATCA систем сматраће се неусклађеним финансијским институцијама
и биће предмет опорезивања од 30% на одређене финансијске трансакције које
посредно или непосредно потичу из САД.
Неусклађеност са предметном регулативом би изложило домаће финансијске
институције, поред финансијског и репутационом ризику, што би могло довести и
до прекида пословних односа са међународним пословним партнерима. У том
смислу, постоји велика вероватноћа да ће иностране финансијске институције које
учествују у FATCA систему ограничавати или чак прекидати пословне односе са
банкама које нису у FATCA систему, те да ће бити угрожени коресподентски
односи домаћих банака са страним финансијским институцијама. Успостављање
3. нових коресподентских односа биће отежано ако не и онемогућено банкама које не
учествују у FATCA систему.
Рок за укључење финансијских институција у FATCA систем почиње 15.07.2013., а
завршава се 25.10.2013. године.
Користимо прилику да наведемо да је Пореска Управа САД објавила неколико модела
међудржавних споразума за олакшану имплементацију прописа, којој су до сада
приступиле преко 50 држава од којих неколико из региона као нпр. Мађарска, Хрватска,
Словенија, Бугарска и Румунија. Билатералне споразуме са САД су већ закључиле или
су у преговорима, Немачка, Италија, Француска, Шпанија, Велика Британија,
Швајцарска, Јапан, Данска, Мексико, Аустрија, Чешка, Пољска, Русија и Словачка.
Имајући у виду да би се закључењем билатералног споразума са САД у потпуности
омогућило домаћим финансијским институцијама усклађеност са захтевима FATCA
прописа, а истовремено и поштовање домаћих прописа, сматрамо да је неопходно
предузети мере и неопходне кораке у поступку уласка Републике Србије у групу земаља
које ће сарађивати са пореским органима САД по основу закљученог билатералног
споразума.
Улазак Републике Србије у FATCA систем би, поред описане важности за домаће
финансијске институције, био значајан и са аспекта унапређења међународне сарадње
на активностима спречавања прања новца.
Неусаглашеност са FATCA актом би могла да донесе ризик од избацивања са
међународних финансијских тржишта, као и да штети репутацији финансијских
институција, спречавајући клијенте да инвестирају у средства САД.
Ценећи значај FATCA прописа за финансијске институције које раде и послују у
Републици Србији, молимо Вас да својим ауторитетом помогнете да се хитно приступи
потписивању међудржавног билатералног споразума са Владом САД, како би се
успоставио заједнички приступ у циљу решавања питања утаје пореза обвезника САД-а
и поједноставили захтеви за иностране финансијске институције.
Имајући у виду све напред наведено, а посебно значај хитности потписивања
билатералног споразума са Владом САД за олакшану инплементацију FATCA прописа,
с обзиром да рок за укључење финансијских институција у FATCA систем почиње
15.07.2013. а завршава се 25.10.2013. године, очекујемо Ваше разумевање и помоћ у
хитном решавању ове иницијативе.
