Polaze i od rezolucija Narodne skupštine Republike Srbije od 24. jula 2007,
14. februara 2007. i 21. novembra 2005. godine, u kojima su utvr ena na ela
i smernice sprovo enja državne politike Republike Srbije u odnosu na Kosovo
i Metohiju,
Imaju i u vidu realnu opasnost po suverenitet i teritorijalni integritet Republike
Srbije, koja proisti e iz pretnji jednostranim proglašenjem nezavisnosti
Kosova od strane privremenih institucija samouprave u pokrajini, kao i iz
izjava nekih država da e priznati jednostranu nezavisnost Kosova,
Stavljaju i do znanja svim me unarodnim iniocima da Republika Srbija,
poštuju i Povelju UN i svoj Ustav, ima pravo i obavezu da se legalnim
sredstvima suprotstavi ovakvom mogu em razvoju doga aja,
Izražavaju i svoju spremnost da i u postoje oj situaciji, u kojoj se ugrožava
suverenitet i teritorijalni integritet države, Republika Srbija doprinese mirnom i
sporazumnom rešavanju ovog pitanja na osnovu na ela i normi
me unarodnog prava i svog Ustava,
Rukovo eni neophodnoš u kontinuiteta jedinstvene državne politike i brane i

Na osnovu lana 99. ta ka 7. Ustava Republike Srbije i lana 134. Poslovnika
Narodne skupštine Republike Srbije („Službeni glasnik RS”, br. 56/05 – pre iš eni
tekst i 81/06), Narodna skupština Republike Srbije, na Sedmoj sednici Drugog
redovnog zasedanja u 2007. godini, održanoj 26. decembra 2007. godine, donela je
REZOLUCIJU
NARODNE SKUPŠTINE REPUBLIKE SRBIJE O ZAŠTITI
SUVERENITETA, TERITORIJALNOG INTEGRITETA I
USTAVNOG PORETKA REPUBLIKE SRBIJE
1. Na osnovu usvojenog Izveštaja Državnog pregovara kog tima o pregovorima
vo enim pod mandatom Trojke Kontakt grupe o budu em statusu Kosova i
Metohije (10. avgust – 19. decembar 2007.) Narodna skupština Republike
Srbije konstatuje da je albanska strana izbegavala da stvarno pregovara na
isti na in kao što je to inila u prvoj fazi koju je vodio M. Ahtisari. Glavni razlog
njene opstrukcije nalazi se u stavu nekih zapadnih država da Kosovo treba da
dobije nezavisnost. Usled takvog stava zapadnih država, nije bilo pravog
podsticaja da albanska delegacija u pregovara kom procesu traga za
kompromisnim rešenjem pitanja o budu em statusu Kosova i Metohije.
2. Narodna skupština Republike Srbije konstatuje da se neke zapadne države
oštro protive nastavku pregovora o budu em statusu Kosova i Metohije, što je
onemogu ilo Savet bezbednosti da prona e kompromisno rešenje ovog
pitanja. Ove države ohrabruju albanske predstavnike na Kosovu i Metohiji da
proglase nezavisnost pokrajine i prete Republici Srbiji priznanjem ovog
protivpravnog ina.
3. Narodna skupština Republike Srbije sa posebnom zabrinutoš u konstatuje da
je, zaklju cima svog Predsedništva od 14. decembra 2007. godine (zaklju ci
br. 65-70), Savet Evropske unije nagovestio aktivnosti u vezi sa Kosovom i
Metohijom, i u samoj pokrajini, koje bi neposredno ugrozile suverenitet i
teritorijalni integritet Republike Srbije.

4. Narodna skupština Republike Srbije utvr uje da bi proglašenje nezavisnosti
Kosova, kao i priznanje nezavisnosti pokrajine od strane bilo koje države,
predstavljali grubo kršenje me unarodnog prava, a pre svega Povelje UN,
Završnog akta iz Helsinkija i Rezolucije SB UN 1244. Takvim aktima i
aktivnostima bili bi neposredno ugroženi suverenitet, teritorijalni integritet i
ustavni poredak Republike Srbije.
5. Narodna skupština Republike Srbije utvr uje da bi uspostavljanje predložene
misije EU za sprovo enje odba enog Ahtisarijevog plana predstavljalo akt
ugrožavanja suvereniteta, teritorijalnog integriteta i ustavnog poretka
Republike Srbije. Savet bezbednosti tokom jula 2007. godine nije prihvatio
šest nacrta rezolucije koji su se zasnivali na Ahtisarijevom planu, a pre svega
na aneksima 10 i 11 Ahtisarijevog plana. To su bili aneksi o postavljanju
misije EU i NATO vojnih snaga na Kosovu i Metohiji. Imaju i ovo u vidu,
Narodna skupština Republike Srbije zahteva da se pre dolaska bilo koje
misije koja bi zamenila postoje u administraciju UN mora putem pregovora
prona i kompromisno rešenje za budu i status pokrajine Kosovo i Metohija,
koje e odobriti SB UN. Narodna skupština Republike Srbije traži od Vlade
Republike Srbije da sa EU utvrdi da misija EU ne može do i na teritoriju
Srbije, na Kosovo i Metohiju, bez adekvatne odluke Saveta bezbednosti.
6. Zbog ukupne uloge NATO pakta, od protivpravnog bombardovanja Srbije
1999. godine bez odluke Saveta bezbednosti do Aneksa 11 odba enog
Ahtisarijevog plana, u kome se odre uje da je NATO „kona an organ” vlasti u
„nezavisnom Kosovu”, Narodna skupština Republike Srbije donosi odluku o
proglašavanju vojne neutralnosti Republike Srbije u odnosu na postoje e
vojne saveze do eventualnog raspisivanja referenduma na kojem bi se donela
kona na odluka o tom pitanju.
7. Imaju i u vidu navedene injenice, Narodna skupština Republike Srbije
utvr uje slede e stavove kao okvir delovanja državnih organa i drugih javnih
inilaca u odbrani suvereniteta, teritorijalnog integriteta i ustavnog poretka
Republike Srbije:
a) Odbrana Kosova i Metohije kao integralnog dela Republike Srbije predstavlja
prioritet državnih institucija i svih javnih inilaca u državi, sve dok ne bude usvojeno
kompromisno rešenje ovog pitanja na osnovu Rezolucije SB UN 1244.
b) Svi akti proglašenja i priznanja nezavisnosti Kosova i Metohije, kao i sve
aktivnosti u me unarodnom okruženju koje bi proisticale iz ovih akata, ma ko ih
donosio i primenjivao, bi e proglašeni ništavnim i protivnim ustavnom poretku
Republike Srbije. Shodno tome, Kosovo i Metohija e se i u unutrašnjim i u spoljnim
aktivnostima države, njenih organa i javnih inilaca, smatrati sastavnim delom
Republike Srbije. Ovaj stav bi e merodavan za svaki pojedina ni akt ili aktivnost
državnih organa i javnih inilaca sve do iznalaženja kompromisnog rešenja ovog
pitanja na osnovu Rezolucije SB UN 1244. Posebno e se preispitati diplomatski i svi
drugi odnosi sa državama koje eventualno priznaju nezavisnost Kosova i Metohije.
v) Obavezuje se Vlada Republike Srbije da donese konkretan i sveobuhvatan
plan mera koje e biti preduzete u svim oblastima njenih nadležnosti u slu aju
protivpravnog proglašenja nezavisnosti Kosova i Metohije.
g) Obavezuje se Vlada Republike Srbije da što efikasnije primenjuje ustavne
nadležnosti Republike Srbije na Kosovu i Metohiji, kao i da poja a delovanje državnih
institucija u ostvarivanju tih nadležnosti. Posebno se obavezuje Vlada Republike
Srbije da u svim okolnostima koje bi mogle nastupiti efikasno deluje na zaštiti života i
imovine, prava i sloboda gra ana pokrajine, a posebno srpskog i nealbanskog
stanovništva.

d) I pored nastojanja nekih zapadnih država da blokiraju dalje pregovore kojima
bi se mirnim putem našlo rešenje statusa Kosova i Metohije u skladu sa Rezolucijom
SB 1244, ovlaš eni predstavnici Republike Srbije treba da nastave napore kako bi se
obnovili pregovori i pronašlo rešenje u duhu me unarodnog prava.
) Narodna skupština Republike Srbije nalaže Vladi Republike Srbije da
me unarodni sporazumi koje Republika Srbija zaklju uje, uklju uju i i Sporazum o
stabilizaciji i pridruživanju, moraju biti u funkciji o uvanja suvereniteta i teritorijalnog
integriteta zemlje.
e) Narodna skupština Republike Srbije traži od državnih organa Republike Srbije
da upotrebe sva pravna sredstva pred odgovaraju im me unarodnim i nacionalnim
sudovima radi zaštite suvereniteta i teritorijalnog integriteta države Srbije.
8. Narodna skupština zahteva od Vlade Republike Srbije da je redovno
izveštava o razvoju doga aja u vezi sa Kosovom i Metohijom i sprovo enju
ovde navedenih aktivnosti i mera za zaštitu suvereniteta, teritorijalnog
integriteta i ustavnog poretka Republike Srbije.
