PAN International organised a historic session of the Permanent People’s Tribunal in Bangalore on December 3-6, 2012, attended by hundreds of peasant farmers, agricultural workers, and activists. Witnesses from all over the world gave testimony on the human rights violations perpetrated by the agrochemical transnational corporations (TNCs). Below is a brief summary of the Tribunal’s Findings and Recommendations.
Tribunal Findings:
The six TNCs are responsible for gross, widespread and systematic violations of the right to health and life, economic, social and cultural rights, as well as of civil and political rights, and women and children’s rights.
The United States, Switzerland, and Germany (Home States), have demonstrably failed to comply with their internationally accepted responsibility to promote and protect human rights, especially of vulnerable populations. These three States, where the six corporations are registered and headquartered, have failed to adequately regulate, monitor and discipline these entities by national laws and policy; have unjustifiably promoted a double standard approach prohibiting the production of hazardous chemicals at home while allowing their own TNCs unrestrained license for these enterprises in other States, especially of the Global South.
Technology-importing (Host) states are responsible for not adequately protecting human rights and social movement activists from vexation and harassment; not adequately protecting independent scientists; not fully pursuing alternatives and less hazardous forms of agricultural production; and not honouring obligations from the ILO Conventions.
Some of the policies of the WHO, FAO and ILO are not fully responsive to the urgency of regulation and redress, as articulated by suffering peoples, and human rights and social movement activist groups and associations. A more proactive role is especially indicated in the field of hazardous agrochemicals and agribusiness TNCs. UNESCO ought to take expeditious and effective steps for the protection of academic and scientific freedom of researchers and specialists who raise justifiable alarm over the long term impact of pesticides.

Prof. (Dr.) Anna Konert is an Attorney at
Law and Professor of Aviation Law, Dean of
the Faculty of Law and Administration, and
Director of the LL.M Programme in Aviation
Law at the Lazarski University in Warsaw.
She also possesses a Professional Pilot
License and serves as a Member on the
Committee of European Air Law Association.
She has also formerly served as legal counsel
for Air France at their New York office.
Prof. Anis Bajrektarevic
Prof. Anis H. Bajrektarevic is the Department Head
for Strategic Studies on Asia at the International
Institute IFIMES. He is also the UN Permanent
Representative to Austria and Vienna-based IOs and
a Visiting Professor for International Law at the
University in Geneva. Additionally, Prof.
Bajrektarevic is an elected arbiter and mediator
before numerous permanent national arbitrational
tribunals (including those of the Law of the Sea) in
Europe and in Asia. This includes capacities such as
being a Board Member to the GlobalCompliance
Business Counciland to the International
Commercial Dispute Tribunal. Prof. Bajrektarevic
has also authored dozens presentations,
publications, speeches, seminars, research
colloquiums as well as of numerous public events
(round tables & study trips, etc.). He also serves as
Editor of Geopolitics, History and Intl. Relations
Journal, and is an editorial board member of several
similar specialized magazines on three continents.
4. Dr. Attila Sipos
Dr. Attila Sipos is currently Bar Association
Advisor at the Aviation Division of HM EI Co.
He is also an Honorary Professor at ELTE ÁJK.
He served the HungaroControl in various
positions, including as Legal Director, Alliance
Director, and Advisor to the CEO (2008–2014).
He was the Representative of Hungary on the
Council of ICAO (2004–2007) and the Vice-
President of the Council of ICAO (2006–2007).
He had worked at MALÉV Hungarian Airlines as
Flight Operation Officer, Crew Manager, Legal
Advisor and Legal Director (1989–2004). He has
also been a committee member of the European
Air Law Association (EALA) since 2004.
Dr. Divya tyagi
Dr. Divya Tyagi is an Assistant Professor of
Law at the Gujarat National Law University,
India. He teaches several disciplines including
Securities and Investment Law and Air and
Space Law for the UG and PG Programme. He
has an extensive record for presenting papers
before conferences and seminars on several
areas of interest such as Corporate Law,
Securities Law, Investment Law, and Air and
Space Law. He has also served as the Convenor
for the several editions of the GNLU Air and
Space Law Academy and accompanying
conferences. Some of his publications include
a chapter in Bimal N Patel et al. (eds,) 'The
Companies Act 2013: Key Conceptual
Transformation' (2017).
5. Ms. Jessica Los Banos
Jessica Los Banos is a Foreign Lecturer at the
Faculty of Law, Universitas Pelita Harapan
(UPH) in Indonesia where she teaches contracts,
legal skills, IHL, and other international law
courses. She is the General Adviser to UPH
teams participating in international moot court
competitions including the Philip C. Jessup
Moot Competition, the FDI Arbitration Moot,
the ICRC IHL Moot, Asia Cup International Law
Moot Court Competition, and the John Jackson
WTO Moot. Her research interests include
aviation and space law, investment law, and the
law of the sea. She has published a chapter on
Commercial Human Space Flight and the
Adequacy of the International Liability Regime
Governing Suborbital Space Tourists, in Recent
Developments in Space Law: Opportunities &
Challenges (Springer, 2017).
Prof. (Dr.) Mario Folchi
Dr. Mario Folchi is a Lawyer and Doctor in
Law and Social Science by the University of
Buenos Aires. He currently serves as the
Director of the Postgraduate Specialization
on Aeronautical, Space and Airport Law in
the National University of Defense. He is
also the President of the Latin American
Association of Aeronautical and Space Law
and a member of many Institutes and
Specialized Academic Entities in Air Law
and Tourism in Latin America and Europe,
including the Argentine Academy of
Tourism. Throughout his career, he has
published twelve books on Aeronautical Law
subjects and Tourism.
6. Prof. Patrick Honnebier
Dr. Tomasz Balcerzak
At the University of Mississippi, School of Law,
LL.M. in Air and Space Law Programme, Prof.
Patrick Honnebier is Professor of the unique
(online) Full Semester course International
Aviation Financing and Leasing Laws. He joined
the International Air Transport Association
(IATA) in May 2019 as an instructor for the course
Aircraft Acquisition and Financing. Prof.
Honnebier is also one of the founder-members of
Rep Law Aviation where he advises major
manufacturers, banks, lessors, and airlines in
relation to international financing and leasing of
aircraft, helicopters, and engines. He was also the
expert legal counsel of the Governments of Aruba,
the former Netherlands Antilles and the Dutch
Ministry of Foreign Affairs concerning the
adoption by the Kingdom of the Netherlands of
the Cape Town Convention on 1 September, 2010.
He was also Editor of Journaal
Luchtrecht/Netherlands Journal of Air Law.
Dr. Tomasz Balcerzak is Adjunct Professor at
the Lazarski University - Faculty of Law and
Administration. He also serves as an Expert for
the European Commission-Research Executive
Agency (REA) and European Global Navigation
Satellite Systems Agency, and an Advisor for
the Malta Council for Science and Technology.
Previously, he has served as an Adjunct
Professor at the Silesian University of
Technology with the Aviation Faculty. Per
education, he graduated from the Air Force
Academy and received a pilot and engineering
degree and a PhD at the Warsaw University. He
also completed his MBA at the Warsaw School
of Economics. Additionally, he has authored or
coauthored more than fifty publications in
transportation, logistics, aviation, and space.

Dr. Shouvik Guha
Prof. (Dr.) Sandeepa Bhat is working as a
Professor of Law and Director of Centre for
Aviation and Space Laws at WBNUJS, Kolkata. He
has the experience of researching on five Major
Research Projects sponsored by World Bank,
ISRO, the WB Judicial Academy, Ministry of
Justice and Ministry of Environment, Forest and
Climate Change. He is also a Member of
International Institute of Space Law (IISL). Dr.
Bhat has published six books and more than fifty
articles in the journals of international and
national repute. He has presented over hundred
research papers in international and national
conferences including the coveted International
Astronautical Congress. He also has the
distinction of being the member of Indian Space
Research Organization’s Expert Advisory Group
for drafting the National Space Act for India.
Dr. Shouvik Kumar Guha is currently working as
an Assistant Professor of Law (Senior Scale) at
WBNUJS, after having completed his B.A., LLB.
(Hons.), LL.M. and Ph.D. in law. He is the
Associate Director of the Centre for Aviation and
Space Laws, NUJS, and a member of the global
forum of Sustainable Market Actors for
Responsible Trade (SMART), the Network of
Indian Competition Experts - Cartel Working
Group (NICE-CWG). He is also associated with
several leading national and international law
journals in an editorial and reviewing capacity,
and has to date to his credit about sixty-five
publications including book chapters, conference
papers, and journal articles.
