S. R. O. No. 71l2013.-In exercisc of the powcrs conferred by sub-section (1)
of section 2 of thc Kerala Public Services Act, 1968 (19 of 1968), read with
section 3 thereof, thc Government of Kerala, hereby make the following rules
funher to amend the Kerala Scrvice Rules, namely:-

7. Short title and commen(:ement.*-(l) These ruies may be called the Kerala
Scrvicc. (4th Amcndmcnt) Rulcs, 2013.
(2) 1'hcy shall come intn force at once.
2. ,4mendment of the Rules.---'In Part I of the Kerala Service Rules, in rule
140, after sub-rule (b), the following sub-rule shall be inserted, namely:-

"(c) The period of deputation to foreign service shall be initially for one
year and may be extended year by year up to a continuous period of five years
in the aggregate. The officer on foreign'scrvice shall be relieved of his dutics on
the date of expiry of the sanctioned period unless the competent authority has,
with requisite approval, extended the period of depuktion, in writing, prior to the
date.of its expiry. In the event of the officcr overstaying he shall be liable to
disciplinary action and the period of overstay shall not be corintcd for the
purpose of pension and that any incremcnt due during the period of ovcrstay
shall be defened with cumulative effect, till the date on which the officer rejoins
his parent cadre. No ex post facto approval for regularization of ovcrstay on
foreign service shall be allowed. Thc ofliccr shall be precluded from drawing
pay and allowances from the datc on which ths sailctioncd term of foreign
service expires:
Provided that the period of leavc, if any, taken by an officer, as pcr rulcs
applicable to him, on the conclusion of foreign servicc and beforc jorning his
post shall not be considered as an overstay under this sub-rule.
The provisions of this sub-rule shall rnutatis mutandis apply to an officer
on deputation from one service to another or.from onc Department to anothcr
within the same service.".

As per rule 140(b) of Part I of the Kerala Service Rules, no officer shall
normally be allowed to remain on dcputation to forcign service for more than
five years continuously. f)espite the abovc provision, there has been a growing
tendency among officers oi deputation/foreign service to overstay the
sanctioned term of deputatron which, often, causes considcrable adrninistrative
inconvenience both to the Government and the lcnding and borrowing
Departments/institutions. Scvcral instances have come to thc noticc of

Government,,wherein, the officers remained on deputation/foreign service for
ycars without Government sanction and they seek ex post facto sanction of
(iovernment to regularisc thc overstay pcriod after rejoining duty in the parent
cadrc. l'he (iovcrnment have dccided to incorporate necessary provisions in
Part i of the Kerala Scrwice Rules with a view to chcck the tendency.
