Two Types of Drink Driving Offences
According to Road Transport (Safety and Traffic Management) Act 1999 (NSW)
1. Driving While Under the Influence of Alcohol
2. Driving with the Prescribed concentration of alcohol.
It is most often the case that police will charge you with the second offence because they will usually have a precise blood alcohol reading. The police will charge you with driving under the influence of alcohol, however, if they do not have a reading. This would occur if you refused to be tested, there was a technical problem, or there was some other reason why a reading could not be obtained.

There are Types of Drink Driving Offences with which you can be charged, both of which are established by the Road Transport (Safety and Traffic Management) Act 1999 (NSW). Whether or not you wish to plead guilty to the drink driving offence you are charged with, it is advisable that you get legal advice. In some circumstances, you may be able to get a legal aid solicitor to deal with your matter, but in most instances you will need to retain a private solicitor. A solicitor will be familiar with the procedures of the local court - where your matter will be heard - and will be best placed to present your case in the appropriate and indeed, most advantageous fashion.
If you refer to a solicitor well in advance of your court date they will be able to ensure all evidence is provided to the court on the day, and further, that other action that will assist your case is taken prior to your appearance.

Drink Driving Offences
There are Types of Drink Driving Offences with which you can be charged, both of which are established by the Road Transport (Safety and Traffic Management) Act 1999 (NSW). The first for driving while under the influence of alcohol (s 12) and second for driving with the prescribed concentration of alcohol (s 9). It is most often the case that the police will charge you with the second offence because they will usually have a precise blood alcohol reading.
Whether or not you wish to plead guilty to the drink driving offence you are charged with, it is advisable that you get legal advice. In some circumstances, you may be able to get a legal aid solicitor to deal with your matter, but in most instances you will need to retain a private solicitor. A solicitor will be familiar with the procedures of the local court - where your matter will be heard - and will be best placed to present your case in the appropriate and indeed, most advantageous fashion.
If you refer to a solicitor well in advance of your court date they will be able to ensure all evidence is provided to the court on the day, and further, that other action that will assist your case is taken prior to your appearance.
It is particularly important that you consult a solicitor if you have been charged with a major drink driving offence (for example, your prescribed concentration of alcohol is 0.15 or more) and you have already been charged with a major traffic offence, or if there are significant aggravating features.
Aggravating features include the following:
1. There were passengers in the car (particularly if of a young age)
2. The drink driving lead to an accident.

Revocation of Power of Attorney
Your Power of Attorney can be revoked or cancelled at any time by you nothing the attorney. Although it can be done orally it should always be done in writing. If you are concerned that the attorney may have bound you to things you do not want to be bound to without your authority you should also write to any person or body who may act on the basis of the power of attorney to advise them it has been revoked.
Discretion of Attorney Limited by Three Interrelated Factors:
1. Fiduciary duties imposed at common law.
2. The terms of the EPA instrument itself.
3. Statutory restriction.
4. Obviously, a person giving someone their attorney must consider two things:
a) The integrity and trustworthiness of the proposed attorney; and
b) The ability of the attorney to perform the role the Grantor wants them to perform.
Scope of Attorney’s Powers And Duties
A power of attorney empowers your attorney to do almost anything you can lawfully do for yourself.
It binds you to the terms of any agreements and documents the attorney signs on your behalf whether for personal or business purposes. Generally you are bound by the terms and conditions imposed by the acts of the attorney regardless of whether you are aware of them or not.
You power of attorney remains in force even you are declared bankrupt.
The few things the general power of attorney does not empower the attorney to do are:
1. Make or revoke a will for you
2. Vote for you in any election
3. Marry or divorce on your behalf
4. Give oaths on your behalf (statutory declarations, affidavits etc.)
5. Make medical, dental or lifestyle decision for you.

Enduring Power of Attorney & Guardianship Some Things to Think About
A Power of Attorney is an instrument in which one person (The Grantor) authorises another person (The Grantee or Attorney) to do acts and things on behalf of the grantor on the grantor's instructions.
Enduring power of attorney continues the attorney's power after the granter has lost capacity to give instructions. Effectively the attorney becomes a financial manager.
Enduring power of attorney can be very useful and beneficial for the grantor or it can be a vehicle for abuse and fraud in the hands of the wrong person.

"Lifting the Corporate Veil" is a legal concept that refers to the judicial act of disregarding the separate legal personality of a corporation or limited liability company (LLC). Normally, a corporation is considered a legal entity separate from its shareholders or members, meaning that the personal assets of shareholders or members are protected from the liabilities of the corporation. However, there are certain situations where courts may decide to "pierce" or "lift" the corporate veil, holding shareholders or members personally liable for the debts or actions of the corporation.
Here are some common scenarios in which courts might lift the corporate veil:
Fraud or Illegality: If shareholders or members use the corporate structure to perpetrate fraud, evade legal obligations, or engage in illegal activities, courts may disregard the corporate entity and hold those individuals personally liable.
Undercapitalization: If a corporation is formed with insufficient capital to conduct its intended business and meet its foreseeable liabilities, and this lack of capitalization results in harm to creditors or other parties, courts may lift the corporate veil to hold shareholders or members liable.
Failure to Observe Corporate Formalities: Corporations and LLCs are required to observe certain formalities, such as holding regular meetings, maintaining separate financial records, and avoiding commingling of personal and corporate assets. If these formalities are not observed and the corporate structure is used as a mere façade, courts may disregard the corporate entity.
Alter Ego: If there is such a unity of interest and ownership between the corporation and its shareholders or members that the separate personalities of the corporation and the individuals no longer exist, courts may treat the corporation as the alter ego of its owners and hold them personally liable.
Group Enterprises: In some cases, where multiple corporations are closely related or form part of a single economic unit, courts may pierce the corporate veil to achieve equity, particularly if one corporation's actions harm creditors or other stakeholders and the corporate structure is being used to shield culpable parties from liability.
