1. Euclid University Treaty
Is it true that Euclid University is a treat-based university and what other universities are like that?
2. First, what is a treaty?
๏ The authoritative definition is found in the Vienna Convention on the Law of Treaties of
1969:
๏ โan international agreement concluded between States in written form and governed by
international law, whether embodied in a single instrument or in two or more related
instruments and whatever its particular designationโ.
3. Is there a verification source?
๏ Under the terms of the Charter of the United Nations (which is itself a treaty), in Article 102:
๏ Paragraph 1: Every treaty and every international agreement entered into by any Member of the
United Nations after the present Charter comes into force shall as soon as possible be registered
with the Secretariat and published by it.
๏ Paragraph 2: No party to any such treaty or international agreement which has not been
registered in accordance with the provisions of paragraph 1 of this Article may invoke that treaty
or agreement before any organ of the United Nations.
4. UNTS
๏ Treaties are submitted by the parties or depositary, then checked and published in the
United Nations Treaty Series at http://treaties.un.org
๏ Due to the large amount of treaties being submitted for review and publication, the delay
can be long: up to 5 years.
๏ The EUCLID constitutive text, in the form of two related treaties, was published in
December 2010, thanks to an expedited process and the ongoing cooperation of the UN
Treaty Section
5. UNTS 49006 and 49007
๏ Open Memorandum of Understanding (MOU) between the Participating EUCLID Parties
regarding their Participation in the Educational Framework defined herein (Entry into force:
16/04/2008
๏ ) Updated Framework Agreement regarding the Parties' Participation in EUCLID as
Constituted and Defined herein (Entry into force: 03/09/2009)
6. Depositary?
๏ In the case of a multilateral treaty, it is customary and practical for the State parties to
designate a depositary who has the responsibility to register the treaty with the United
Nations and to be the interface between the State parties for all treaty-related events.
๏ The depositary can be: the Secretary-General of the United Nations, the chief officer of
another intergovernmental organization, a State party
๏ In the case of the EUCLID, the EUCLID Secretary-General is the depositary, a role defined
in the Vienna Convention on the Law of Treaties.
