This document summarizes a case handled by the Commission for Protection Against Discrimination in Bulgaria. The case involved statements made by the Mayor of Ovcha Kupel district on a radio broadcast opposing a proposal to temporarily house 150 Roma families in the neighborhood. The Mayor's statements compared Romas to cows and dung and claimed they were incapable of living civilly with others. This prompted a discrimination complaint. The equality body investigated, held public hearings, and ultimately ruled the Mayor's statements constituted harassment on the basis of ethnicity and violated anti-discrimination laws. The Mayor was fined and instructed to apologize. The decision was upheld on appeal. The case established precedents for the equality body to rely on constitutional protections and international law

This case concerned the validity of stop and search powers under sections 44-47 of the UK Terrorism Act 2000. The House of Lords unanimously found these powers to be valid and not in violation of the European Convention on Human Rights. The Lords held that the word "expedient" in the Act allowed for stop and searches that were of practical value in preventing terrorism, even if not strictly necessary. They also found that brief stop and searches did not constitute a deprivation of liberty or violate privacy rights, and that the powers were sufficiently clear and accessible to satisfy legal requirements. The House of Lords thus dismissed the appeals and upheld the use of stop and search powers under the Terrorism Act 2000.
This document provides a legal overview of media pluralism in the EU. It discusses key cases and directives that have established the legal framework, including the 1974 Sacchi Case, 1980 Debauve Case, 1989 Television Without Frontiers Directive, 2007 Audiovisual Media Services Directive. It also covers public service broadcasting and the role of fundamental rights and the European Convention on Human Rights in the legal framework.
1. The approval of the Optional Protocol to the International Covenant on Economic, Social, and Cultural Rights establishes an important mechanism for victims of violations of ESC rights. It creates a system for individuals to file complaints with the Committee on ESC Rights and for the Committee to investigate serious and systematic violations.
2. The Optional Protocol allows individuals to file communications with the Committee after exhausting domestic legal options. It also establishes procedures for the Committee to investigate violations, including field visits with state approval, and issue recommendations to states.
3. The Protocol will help address interdependence of all human rights and protect victims of Colombia's armed conflict, who often suffer violations of ESC rights like housing, education, and subsistence rights

This document provides an overview of international humanitarian law (IHL) and its application to the armed conflict in Ukraine since 2014. It defines IHL as the branch of international law that regulates violence during armed conflicts. The document outlines the main treaties that are the sources of IHL, including the Geneva Conventions. It notes that while Ukraine is party to most IHL treaties, it has not ratified some, like the Rome Statute establishing the International Criminal Court. The document discusses challenges in applying IHL during the conflict in Ukraine and the need for Ukrainian judges to properly interpret and apply international law and national legislation regarding IHL.
Are Moral Rights Human Rights? Presentation to BLACA/IPKat seminar 12 Februar...Graham Smith
This document discusses whether moral rights are human rights and the implications if they are. It begins by outlining sources of human rights obligations including various international treaties and conventions. It then examines different types of human rights obligations, including negative obligations to abstain from interference and positive obligations to act. The document analyzes specific rights from the European Convention on Human Rights including property rights under Article 1 Protocol 1, privacy rights under Article 8, and freedom of expression under Article 10. It discusses how rights are balanced against each other. The document concludes that moral rights relating to protecting the integrity and reputation of creative works must be balanced with freedom of expression, and outlines how limitations and exceptions can help accommodate both rights.
This thesis examines access to justice for Roma EU citizens facing discrimination that undermines their free movement rights. It analyzes the legal framework protecting Roma from discrimination under EU law, including the Charter of Fundamental Rights, EU citizenship provisions, anti-discrimination directives, and free movement rights. It then assesses available means of judicial protection at the EU level, such as preliminary rulings, infringement procedures, and the role of equality bodies. The thesis uses the 2010 French expulsions of Roma as a case study to demonstrate challenges and advantages of existing enforcement mechanisms. The main hypothesis is that discrimination of Roma by Member States jeopardizes their free movement, though restrictions may formally comply with EU law, their discriminatory application
This bill aims to protect children from violent video programming by prohibiting its distribution during hours when children are likely to comprise a substantial portion of the audience. It tasks the National Telecommunications Commission to define terms like "violent programming" and set hours for the ban. Cable operators would need to comply with these standards to be granted or renew franchises. Violators face fines, and repeated offenses could result in license revocation. Exemptions are made for news, documentaries, and premium cable channels.
The EUI seminar focus on the legal framework in Europe regarding whistle-blowing, leaking confidential information, “illegal” newsgathering and protection of journalistic sources. In its Recommendation 1916 (2010) on the protection of whistle-blowers, on 29 April 2010, the Parliamentary Assembly of the Council of Europe, referring to its Resolution 1729 (2010) on the protection of whistle-blowers, has stressed the importance of whistle-blowing as a tool to increase accountability and strengthen the fight against corruption and mismanagement.

This document summarizes the proceedings of the Supreme Court of India regarding a writ petition filed in response to a television program called "Bindaas Bol" aired on Sudarshan TV news. The court heard arguments from lawyers representing the petitioners and respondents. After subsequent episodes of the program were aired, the petitioners argued it constituted hate speech against Muslims. While the respondents argued it was an investigative report, the court observed the intent seemed to be vilifying Muslims. The court noted two inaccurate claims made in the program. Considering the program code and India's diversity, the court said vilifying a community must be viewed unfavorably, and it is the court's duty to ensure compliance with constitutional values.

This petition requests that the ICC investigate war crimes committed in Suriname between 1980 and 1992, and from 2010 to present, during periods of military dictatorship. It argues that an amnesty bill passed in 2012 shields perpetrators and prevents prosecution. Over 155 individuals were murdered by the military regime and affiliated civilians through acts including: arbitrary arrests and detention, torture, disappearances, rape and extrajudicial killings of civilians and military personnel. Several specific cases are described in detail to support allegations of war crimes and the need for investigation, as the crimes have never been properly investigated by Surinamese authorities and impunity remains. The petition requests the ICC assess the situation proprio motu under the Rome Statute.
This document discusses the evolving role of intermediaries on the internet and challenges of regulating their liability for user-generated content. It provides examples of early court cases that established intermediary liability principles and summarizes safe harbor provisions and other legislation that have sought to limit intermediary liability by implementing notice-and-takedown regimes and graduated response policies for copyright infringement. It also discusses ongoing legal cases and policy debates around intermediary liability and how countries are approaching regulation.
Under UK law, local councils are obligated to investigate complaints of nuisance from residents, including noise complaints. If the council determines a nuisance exists, it must serve an abatement notice to the responsible individual, restricting or forbidding the nuisance. Failure to comply with a notice is a criminal offense. When considering a noise complaint, the council examines the nature, location, time and duration of the noise, and whether the activity has value. The definition of legal nuisance is unreasonable interference with another's property use and enjoyment. Multiple complaints from affected neighbors are also considered. This document requests that MPs discuss ways to more easily deal with and evict problem tenants who violate noise abatement notices or are otherwise abusive.

She intends to focus on economic, social, cultural and environmental rights, and will examine good practices, country situations, alleged violations, and thematic issues over her three-year term, following up on prior recommendations.

The Brussels Satellite Convention of 1974 aimed to regulate the legal issues raised by international television broadcasts via satellite. It obligates member states to prevent the unauthorized distribution of satellite signals within their territories. The convention defines key terms like "satellite", "program", and "signal". It establishes exceptions for short excerpts used in news reporting, educational purposes, and signals intended for public reception. The convention has 35 member states as of 2011 but has not been widely adopted due to opposition from broadcasters.
This document summarizes a discrimination case from Bulgaria that was referred to the European Court of Justice. A Roma man complained that the electricity meters in his neighborhood were placed 7 meters high, preventing residents from checking readings, while meters in other neighborhoods were at a normal height. The equality body found this constituted indirect discrimination but was overruled nationally. To resolve legal issues, it referred questions to the ECJ on interpreting discrimination definitions and burden of proof under EU law. If the ECJ finds the national interpretations do not comply, the equality body would not apply them in this and similar cases.
This document discusses multiple/intersectional discrimination, which refers to discrimination on more than one protected ground. It provides several definitions for multiple discrimination, including discrimination occurring on different grounds in separate situations, additive discrimination where grounds compound each other, and intersectional discrimination where grounds interact and are inseparable. The document examines why multiple discrimination is an important issue given that individuals have multiple identities. It provides examples of discrimination cases from Bulgaria where courts found discrimination on the grounds of both age and gender, and both gender and personal status. Finally, it notes that while EU law does not expressly prohibit or consider multiple discrimination, some directives recognize the intersection of grounds, and Bulgarian law explicitly protects against discrimination on multiple grounds.
