  1. Justice refers to the use of authority to uphold what is lawful in a completely impartial and fair manner. However, from the law itself, to the administration of the law by the police and judges, and the prisons there is bias against certain categories of people.
  2. Many criminal laws are the result of public consensus on what kinds of behaviors should be punished (such as murder, rape, and theft). The laws devised to make these acts illegal and to specify the extent of punishment for violators are non-discriminatory because they do not single out a particular social category as the target. Some laws are discriminatory in that people can exert their power to make certain acts against the law. At every stage in the processing of criminals, authorities make choices based on personal bias, pressures from the powerful, and the constraints of the status quo.
