3. Introduction
The drug and magic remedies act came into force on
1 April 1955 and was amended in 1963. It extends to
the whole of India except the state of Jammu and
Kashmir.

4. Objective
 An Act to control the advertisement of drugs in certain cases.
 To prohibit the advertisement for certain purposes of
remedies alleged to possess magic qualities and to provide for
matters connected there with

5. Definitions
Advertisements- Includes any notice, circular, label and
any announcement made orally .
Drug- Any substance intended to be used for or in the
diagnosis, cure, treatment or prevention of disease in human
beings or animals.
Magic remedy- Includes a talisman, mantra, kavacha
which is alleged to possess miraculous powers for the
diagnosis, treatment of human being or animals

6. Prohibition of certain advertisement
Object to provision of this act, publication of the following
classes of advertisements is prohibited under section 3, 4
and 5 of the act.
Section 3- Advertisements, related to drugs likely to be used for-
 Procurement of miscarriage or prevention of conception in woman
 Correction of menstrual disorders in woman
 Maintenance or improvement of capacity to human beings for sexual pleasure

7. Section 4- Misleading advertisement of drugs containing any matter which-
 Directly or indirectly gives a false impression regarding true character of the drug.
 Make false claim for the drug
 In otherwise false or misleading in any material particular
Section 5- Advertisement of magic remedies on certain disease or disorders.
 Any advertisement of any magic remedy which directly or indirectly claims to be
efficacious for any of the purposes specified in section 3 of the act.

8. Classes of exempted advertisement
Advertisements in the below mentioned manner can be made without
any prohibition .
 Any sign board or notices displayed by a registered medical
practitioner on his premises indicating that treatment for any disease,
condition in undertaken relating to which advertisements otherwise
are prohibited.
 Any book dealing with any of the matters relating to the disease or
condition which are otherwise prohibited to be advertised provided
published from a bona fide scientific or social standing.

9. The advertisement contains only such information as is required for the
guidance of registered medical practitioner in respect of matters
relating to:-
Therapeutics indication of the drugs
Its administration
Its dosage
Its side effects
The precautions to be observed in the treatment with the drug
