Sub: Petitioner’s response to the oral instruction
given by Branch Officer Section X to remove Prayer ‘B’
and ‘C’ from the Misc. Application-reg.
Ld. Madam,
1.That the section X of Supreme Court of India has
notified objection letter dated 10.09.2018 in Misc.
Application D.NO.32273/2018 PID:163126/2018 for
P[1](SEC) filed by petitioner on 29.08.2018 that
the same is defective because (a) Prayer 'B' and
'C' of the Misc. Application is not proper. (b)
Complete cause title is not given.
2.That the Petitioner has cured both the defects and
refiled the same on 11.09.2018 vide diary
no.130820/2018 before Supreme Court of India.
3.That the objection was raised by you that the
Prayer 'B' and 'C' of the Misc. Application is not
proper which proliferates the connotation that the
drafting of prayer is not proper.
4.Hence, the petitioner has redrafted the Prayer 'B'
and 'C' of the Misc. Application and made it proper
by seeking direction to comply the Order XXXVIII of
Supreme Court Rule, 2013 and listing of the matter
before the Constitution bench of Hon’ble Supreme
Court of India.
5.Now, you are asking the petitioner over telephone
on 13.09.2018 to remove the prayer ‘B’ and ‘C’ from
the petition which happens to be the heart and
kidney of the petition.
6. If heart and kidney are removed from the body
then the body will not remain alive. Likewise, if
prayer ‘B’ and ‘C’ are removed from the petition
then petition will not remain alive because it has
been filed against the final order of final court.
Therefore petitioner is categorically stating that
he will not remove the prayer ‘B’ and ‘C’ from the
Misc. Application at any cost.
7. However, you have neither supplied the same
oral instruction of removal of prayer ‘B’ and ‘C’
in writing till date nor processed the said appeal
as per the rule of law i.e. Supreme Court Rule,
2013.
8. This delaying tactics of registry will result
in gross miscarriage of justice and cause another
planned judicial murder of Shri Om Prakash herein
petitioner no.01.
9.Registry of Supreme Court of India is violating
Rule of Law and Human Rights of the petitioner by
way of Oral instruction through Branch Officer,
Section X, Supreme Court of India to remove Prayer
‘B’ and ‘C’ from Crl.M.P.D.NO.32273/2018 which will
cause another planned judicial murder of Shri Om
Prakash herein petitioner no.01.
10. Earlier in 2017, Registry has violated the same
which has resulted in planned judicial murder of
Late Smt Asha Rani Devi, petitioner no.02 against
which M.A. 84 of 2017 in W.P. Criminal D.NO. 3913
of 2017 entitled “Om Prakash and Another VS
Registrar Supreme Court of India and Another” has
been filed before Supreme Court of India.
11. Hence, the question arises:
i)Why Crl.M.P.D.NO.32273/2018 has not been converted
into registered case and not been allotted case
number and not been placed before Hon’ble the
Chief Justice of India as on date even after
removal of objection/defects which has been
refiled on 11.09.2018 vide diary no.130820/2018
before Supreme Court of India?
ii) Why have you given oral instruction over
telephone on 13.09.2018 to remove Prayer ‘B’ and
‘C’ from the Crl.M.P.D.NO.32273/2018 which
happens to be the heart and kidney of the
petition i.e. direction for compliance of the
Order XXXVIII of Supreme Court Rule, 2013 and
listing of the matter before the Constitution
bench of Hon’ble Supreme Court of India.?
iii) Why Registry has neither sent removal
notification letter nor sent NOTICE for listing
the matter before Hon’ble Judge in Chamber for
direction as on date?
iv) What action has been taken against the petitioner’s
letter dated 05.09.2018 filed vide diary
no.127223/2018 in Crl.M.P.D.NO.32273/2018 with a
Prayer for Processing and Listing of CRL.MP.D.NO.
32273 of 2018 during the tenure of present Hon’ble
the Chief Justice of India because the said appeal
contains serious complaint with Justification
against Hon’ble Justice Rajan Gogoi who is supposed
to be our next Chief Justice of India?
v) Why Registry is violating the Rule of Law and Human
Rights of the petitioner again in 2018 which has
resulted in planned judicial murder of Late Smt
Asha Rani Devi, petitioner no.02 in 2017 against
which M.A. 84 of 2017 in W.P. Criminal D.NO. 3913
of 2017 entitled “Om Prakash and Another VS
Registrar Supreme Court of India and Another” has
been filed before Supreme Court of India?
vi) Whether the Criminal M.P. D.NO. 22539/2018 will
be listed before the present Hon’ble the Chief
Justice of India for hearing or NOT?
