Mental health has been in the news quite a bit lately. Dozens of U.S. states are currently suing Meta for contributing to the youth mental health crisis by inserting addictive features into their products, while the U.S. Surgeon General is touring the nation to bring awareness to the growing epidemic of loneliness and isolation. The country has endured periods of low national morale, such as in the 1970s when high inflation and the energy crisis worsened public sentiment following the Vietnam War. The current mood, however, feels different. Gallup recently reported that national mental health is at an all-time low, with few bright spots to lift spirits.
To better understand how Americans are feeling and their attitudes towards mental health in general, ThinkNow conducted a nationally representative quantitative survey of 1,500 respondents and found some interesting differences among ethnic, age and gender groups.
Technology
For example, 52% agree that technology and social media have a negative impact on mental health, but when broken out by race, 61% of Whites felt technology had a negative effect, and only 48% of Hispanics thought it did.
While technology has helped us keep in touch with friends and family in faraway places, it appears to have degraded our ability to connect in person. Staying connected online is a double-edged sword since the same news feed that brings us pictures of the grandkids and fluffy kittens also feeds us news about the wars in Israel and Ukraine, the dysfunction in Washington, the latest mass shooting and the climate crisis.
Hispanics may have a built-in defense against the isolation technology breeds, owing to their large, multigenerational households, strong social support systems, and tendency to use social media to stay connected with relatives abroad.
Age and Gender
When asked how individuals rate their mental health, men rate it higher than women by 11 percentage points, and Baby Boomers rank it highest at 83%, saying it’s good or excellent vs. 57% of Gen Z saying the same.
Gen Z spends the most amount of time on social media, so the notion that social media negatively affects mental health appears to be correlated. Unfortunately, Gen Z is also the generation that’s least comfortable discussing mental health concerns with healthcare professionals. Only 40% of them state they’re comfortable discussing their issues with a professional compared to 60% of Millennials and 65% of Boomers.
Race Affects Attitudes
As seen in previous research conducted by ThinkNow, Asian Americans lag other groups when it comes to awareness of mental health issues. Twenty-four percent of Asian Americans believe that having a mental health issue is a sign of weakness compared to the 16% average for all groups. Asians are also considerably less likely to be aware of mental health services in their communities (42% vs. 55%) and most likely to seek out information on social media (51% vs. 35%).

2. Obiettivi della Direttiva (UE) 2015/2302
Garantire un elevato livello di tutela dei consumatori
Adeguare la normativa allo sviluppo del settore, su cui ha inciso in via principale
l’avvento di internet
Assicurare una maggiore uniformità normativa all’interno degli Stati membri, optando
per un’armonizzazione di tipo “forte”, tramite una disciplina dettagliata e prescrittiva
3. Ambito di applicazione
Art. 32 : la disciplina dei contratti del turismo organizzato si applica:
ai pacchetti offerti in vendita o venduti da professionisti a viaggiatori e ai servizi
turistici collegati la cui offerta o vendita a viaggiatori è agevolata da
professionisti.
4. ESCLUSIONI
Sono esclusi dall’applicazione della disciplina dei contratti del turismo organizzato:
Pacchetti e servizi turistici collegati della durata inferiore a 24 ore, salvo che sia incluso
un pernottamento;
Pacchetti e servizi turistici venduti o agevolati occasionalmente e comunque non più di
due volte l’anno, senza fini di lucro e a un numero ristretto di persone senza offerta al
pubblico dalle associazioni di cui all’art. 5 o dalle scuole;
Pacchetti e servizi turistici collegati acquistati nell’abito di un accordo generale per
l’organizzazione di viaggi di natura professionale conclusi tra un professionista e altro
soggetto che opera nell’ambito della propria attività commerciale, imprenditoriale,
artigianale o professionale.
5. Pacchetti turistici definizione
E’ un pacchetto turistico la combinazione di almeno due tipi diversi di servizi turistici ai fini dello stesso
viaggio o della stessa vacanza, se si verifica almeno una delle seguenti condizioni:
1. tali servizi sono combinati da un unico professionista, anche su richiesta del viaggiatore o
conformemente a una sua selezione, prima che sia concluso un contratto unico per tutti i servizi;
2. tali servizi, anche se conclusi con contratti distinti con singoli fornitori, sono:
acquistati presso un unico punto vendita e selezionati prima che il viaggiatore acconsenta al pagamento;
offerti, venduti o fatturati a un prezzo forfettario o globale;
pubblicizzati o venduti sotto la denominazione "pacchetto" o denominazione analoga;
combinati dopo la conclusione di un contratto con cui il professionista consente al viaggiatore di scegliere
tra una selezione di tipi diversi di servizi turistici oppure
acquistati presso professionisti distinti attraverso processi collegati di prenotazione online ove il nome del
viaggiatore, gli estremi del pagamento e l'indirizzo di posta elettronica sono trasmessi dal professionista
con cui è concluso il primo contratto a uno o più professionisti e il contratto con quest'ultimo o questi
ultimi sia concluso al più tardi 24 ore dopo la conferma della prenotazione del primo servizio turistico;
6. Servizi turistici collegati, definizione
Fattispecie disciplinata per la prima volta dalla Direttiva:
Almeno due tipi diversi di servizi turistici acquistati ai fini dello stesso viaggio o della stessa
vacanza, che non costituiscono un pacchetto e che comportano la conclusione di contratti
distinti con i singoli fornitori di servizi turistici, se un professionista agevola, alternativamente:
al momento di un'unica visita o un unico contatto con il proprio punto vendita, la selezione
distinta e il pagamento distinto di ogni servizio turistico da parte dei viaggiatori;
l'acquisto di almeno un servizio turistico aggiuntivo presso un altro professionista quando tale
acquisto è concluso entro le 24 ore dalla conferma della prenotazione del primo servizio turistico.
7. Obblighi di informazione nel contratto di vendita di
pacchetto turistico
L’art. 34 elenca le informazioni che l’organizzatore o il venditore devono fornire al
viaggiatore prima della conclusione del contratto
Caratteristiche principali dei servizi turistici
Nome e recapiti dell’organizzatore e del venditore
Il prezzo totale del pacchetto comprensivo di tasse e tutti i diritti aggiuntivi calcolabili oppure
un'indicazione del tipo di costi aggiuntivi che il viaggiatore potrebbe dover ancora sostenere;
modalità di pagamento
informazioni in materia di passaporti e visti e le formalità sanitarie del paese di destinazione
gli estremi della protezione in caso di insolvenza dell’organizzatore o del venditore
8. Revisione del prezzo
Se espressamente previsto nel contratto, il prezzo del pacchetto può essere aumentato
solo in casi specifici (aumento prezzi del carburante, tasse, diritti e tassi di cambio)
comunque, non oltre 20 giorni dall'inizio del pacchetto.
Se è previsto l’aumento di prezzo, il viaggiatore ha diritto a una riduzione di prezzo se vi è
una diminuzione dei costi pertinenti.
Se l'aumento del prezzo è superiore all'8 % del prezzo del pacchetto, il viaggiatore può
risolvere il contratto.
9. Recesso del viaggiatore
Diritto di trasferire il pacchetto ad un'altra persona, previo ragionevole preavviso
Facoltà del viaggiatore di recedere dal contratto in ogni momento prima dell’inizio del pacchetto

accadimenti straordinari nel luogo di destinazione o nelle immediate vicinanze
Diritto di recesso di pentimento entro 14 giorni nel caso di contratti conclusi fuori dai locali
commerciali
10. Responsabilità dell'organizzatore per l'inesatta
esecuzione del pacchetto
L'organizzatore è responsabile dell'esecuzione dei servizi turistici previsti dal contratto di vendita di
pacchetto turistico, prestati dallo stesso organizzatore o da altri fornitori di servizi turistici
Difetto di conformità di un servizio turistico compreso
in un pacchetto:
1. Il viaggiatore informa tempestivamente
l’organizzatore
2. L’organizzatore pone rimedio al difetto di
conformità, altrimenti:
A. il viaggiatore ha diritto alla riduzione del
prezzo e al risarcimento di eventuali danni
B. Il viaggiatore rimedia personalmente al
difetto L’organizzatore rimborsa le spese
necessarie, ragionevoli e documentate
Una parte pari o superiore al 25% del valore del
pacchetto non può essere fornita in conformità al
contratto
1. l’organizzatore offre soluzioni alternative:
A. Di qualità equivalente o superiore, senza
supplemento di prezzo
B. Di qualità inferiore, con riduzione di prezzo
2. Il viaggiatore può respingere le proposte
alternative e optare per il recesso se:
A. le soluzioni offerte non sono comparabili con
quanto previsto in contratto o
B. se la riduzione di prezzo è inadeguata
11. Obblighi dell’organizzatore
Laddove è impossibile assicurare il rientro del viaggiatore come pattuito nel contratto di vendita
di pacchetto turistico a causa di circostanze inevitabili e straordinarie, l'organizzatore sostiene i
costi dell'alloggio necessario, ove possibile di categoria equivalente, per un periodo non
superiore a tre notti per viaggiatore
12. Protezione in caso di insolvenza
Polizze assicurative o garanzie bancarie o fondi appositamente costituiti che garantiscono
Pacchetti turistici
In caso di insolvenza o fallimento dell'organizzatore
o del venditore
il rimborso del prezzo versato per l'acquisto
del pacchetto, senza ritardo su richiesta del
viaggiatore
il rientro immediato del viaggiatore nonché,
se necessario, il pagamento del vitto e
dell'alloggio prima del rimpatrio.
Servizi turistici collegati
In caso di insolvenza o fallimento del soggetto
agevolatore dei servizi turistici collegati
il rimborso dei pagamenti già effettuati al
soggetto agevolatore per servizi non prestati a
causa dello stato di insolvenza dello stesso
se necessario, il rimpatrio.
1. Tale protezione non prevede un rimborso in caso
di insolvenza del pertinente fornitore di servizi,
ma solo del soggetto agevolatore.
2. Ove non si rispetti l’obbligo di informare il turista
che non si tratta di pacchetto turistico, saranno
applicate tutte le maggiori tutele previste per i
pacchetti turistici
13. Responsabilità del venditore di pacchetto turistico
Il venditore è responsabile
della corretta esecuzione del mandato
conferitogli dal viaggiatore con il
contratto di intermediazione di viaggio
per eventuali errori di prenotazione,
anche se dipendenti da difetti tecnici
nel sistema di prenotazione che gli
siano imputabili
Il venditore risponde come un organizzatore
Se non fornisce al viaggiatore il modulo
informativo di cui all’allegato A alla bozza di
decreto
Se non fornisce al viaggiatore le
informazioni relative all'organizzatore
Se non informa il viaggiatore che egli agisce
in qualità di venditore.
14. Sanzioni amministrative
In adempimento a quanto previsto dalla Direttiva, la bozza di decreto ha previsto
un impianto sanzionatorio specifico per la violazione delle disposizioni in esame.
Sanzioni pecuniarie da 1.000 a 20.000 euro, aumentate di un terzo in caso di reiterazione e
raddoppiate in caso di ulteriore reiterazione.
In caso di violazione delle disposizioni relative agli obblighi di protezione in caso di
insolvenza, si applica la sanzione amministrativa accessoria della sospensione dell’attività da
15 gg a 3 mesi e, in caso di reiterazione, la cessazione dell’attività.
15. Entrata in vigore
La nuova disciplina entrerà in vigore il 1 luglio 2018
Le nuove regole saranno applicabili ai contratti conclusi
a far data dal 1 luglio 2018
