The Appellate Division held that before issuing a full stay-away temporary order of protection (TOP) that would immediately deprive a defendant of a significant liberty or property interest, due process requires that the court hold a prompt evidentiary hearing on notice to the parties. The hearing must allow the court to ascertain the necessary facts to determine if the TOP should be issued. In this case, the defendant presented evidence that the TOP barring her from her apartment, where she lived with her children, could result in losing her housing lease. The initial court that issued the TOP did not properly evaluate this evidence or hold a sufficient hearing.
